    Default Leave

    Sir

My friend working in a Central Autonomous Body suffered an accident while on duty and was granted Special Disability Leave for 85 days. Later he got compensation from the insurance co (Not from ESI or under Workmen's compensation Act) Whether he has to surrender the leave salary in view of the compensation received from insurance co. in accordance with Leave Rule 45. Please clarify at the earliest.

    Default disability leave

Assuming that the term compensation you referred to is medical insurance claim, your friend need not pay anything to the govt in the form of repayment of leave salary while he gets a claim under health insurance

    Dear friend

It is not health insurance. He got compensation from general insurance from the opposite party who had got comprenhensive insurance after fighting the case in court
