If you are already a government servant pay protection + grade pay of new post will be given. If first appointment then as explained by mr. kanwal and mr. aneesh and mr ramaswamy is correct.

    Default Pay protection

One of my colleague who was working in the pay scale of 5000-8000 in a govt. organisation joined in the higher scale of 5500-9000. He had applied through proper channel. He was an ex-serviceman before joining civil service. His appointment in our office is the second appointment under civil service. He was drawing a basic pay of Rs.5450 before joining the second office. After his joining 6 cpc was implemented and both the scales were merged. In our office his pay was fixed at 5500 in the pre revised scale and also at minimum after 6 cpc. In his previous office his pay was fixed under 6 cpc but his pay in the pay band in our office is less than what has been fixed in his previous office. Is he eligible for pay protection. Is there any other rule that his pay should be fixed at the minimum as he was an ex serviceman. What is the correct pay fixation in his case. Please clarify.

please be specific with the dates and pay fixed to give a better clarification.
Assuming that the pay of the individual is fixed at 5500 in 5500/9000 at the time of joining in your office and also as on 01-01-2006 his pay will be fixed at 10230 + 4200 gp and not at the minimum viz. 9300.

    Sir,

He joined his previous office in the year 2004 in the scale of 5000-8000 under ex-serviceman quota and had earned 3 increments. His basic pay was Rs.5450/- He joined our office on 30th July2008 in the scale of 5500-9000 and his pay was fixed at the minimum of the scale i.e., Rs.5500/- Consequent on implementation of 6 cpc both the scales are merged. In his previous office his pay was fixed at Rs.9580/- under 6 cpc as on 1.1.2006 and on 1.7.2008 it was 10870/-. But in our office his pay was fixed at the minimum of Rs.9300/- plus gp 4200/-. pl inform whether it is in order. If not what will be his correct pay fixation.

No it is not in order. It should be Pay 10870 + GP 4200 only. The principle of Rule 8 of CCS(RP) Rules 2008 shall not apply. FR 22/FR23 shall apply in this case. Pay of a Govt. Servant cannot be reduced as per CCS(RP) Rules 2008 even if he opts to go on transfer to a lower post. Rule 8 shall apply only to first time recruits and not to personnel appointed on transfer counting past services.

    Default Pay Fixation

I have appointed as Stenographer Gr. III in All India Radio in December 1994. I got first ACP on 6th December' 2006. After the implementation of 6th pay commission my pay has been fixed from 1.1.2006 by giving GP 2400. Before implementation of 6th pay commission i have got first acp. While fixing the pay i have granted GP 4200. After implementation of MACP my department has asked me to give an option as per MACP and fixed my pay directly from 06.12.2006 without giving any sixth pay commission benefits and arrears has been given from 06.12.2006 only not from 1/1/06. Kindly clarify from which date my pay has to be fixed.

This point has been already discussed in different threads. Taking an option from the date of ACP seems to be a bad misintrepretation of the orders. The orders are clear you should get arrears from 01-01-2006 and ACP benefits from December 2006 as MACP is effective from 01-9-2008 only. This is very clear from para 9 of MACP orders. A clarification is badly required on the point 6.1 of Annexure I from DOPT(Establishment-D) to avoid victimisation of a selective class of people. Being an affected person you can very well represent against through proper channel.
