CASE OF BEING ON DEPUTATION, AS ON 01.01.2006, & BEING PROMOTED WHILE STILL ON DEPUTATION, w.e.f. 29.09.2006 IN PARENT DEPARTMENT, BUT ACTUALLY THE PROMOTION BECAME EFFECTIVE w.e.f. 27.11.2006, ON REPATRIATION TO THE PARENT DEPARTMENT

A. On 24.4.2000, while drawing basic pay of Rs. 11950/-, in the pay scale of Rs. 10000-325-15200, and with next date of increment on 01.05.2000, I joined another Central Govt. Department, in the higher grade of Rs. 12000-375-16500.

B. Exercising option under FR 22 (I) (a) (i) for pay in the grade of deputation post, my basic pay was fixed at Rs. 12375/- in the grade of Rs. 12000-375-16500.

C. As on 01.01.2006, while still on deputation my basic pay in the deputation grade was Rs. 14250/-, which increased to Rs. 14625/-, w.e.f. 01.04.2006.

D. While still on deputation, vide order dated 29.9.2006, I was promoted to the next higher grade, i.e. Rs. 12000-375-16500, in my parent department, alongwith two other persons one senior and other junior to me;

E. The pay of the person junior to me, on promotion was fixed at Rs. 15,000/-, w.e.f. 30.09.2006, on which very date he also retired.

F. On premature repatriation, I was relieved from my deputation post on 27.11.2006 (F.N.), while drawing basic pay of Rs. 14625/-, and joined back my department, the same day, i.e. 27.11.2006 (A.N.).

G. My pay, in the promoted scale of Rs. 12000-375-16500, in my parent department w.e.f. 28.11.2006 was fixed at Rs. 14625/-.

MY QUERRIES

(i) What should be my basic pay, consequent to implementation of 6th CPC?

(ii) Should not my basic pay, on promotion be fixed at Rs. 15,000/- (not Rs. 14625/-), i.e. same as that of my immediate junior, w.e.f. 30.9.2006, (he was junior to me in the lower grade, as also in the promoted grade)?
