I have been redeployed through surplus in Indian audit and accounts department in December 2005. I was working in the scale of Rs. 4000-100-6000 after getting Ist financial up gradation w.e.f. 9/8/99 before joining this office.
Sir In a copy of appointment order it was mentioned that the pay should be fixed in terms of rule 5(2) (ii) of CCS Redeployment of (Surplus staff) rule,1990but pay was not fixed up accordingly & was continuously given the scale of Rs. 4000-100-6000 which is not a scale of accounts cadre . Since the scale of Accountant in the accounts cadre is Rs. 4500-125-7000 which does not match to my current pay scale rule 5(i)(ii) & further Accounts cadre scale is not matching pay scale as maximum of the pay scale is more than 10% of maximum scale hold by me in terms of Rule 5(2)(iii)
Sir In this regard it is clarified that if an employee as transferred as LDC in the scale of Rs. 3050-75-4590 which similar scale of LDC in Accounts cadre and was given Ist ACP in Accounts cadre he has to given Accountant scale in 4500-125-7000 scale & automatically while giving 2nd ACP to Sr.Accountant scale of Rs. 5500-175-9000 ,which is demanded by me .
Sir, Since I have been given Ist ACP w.e.f. 1999 by the earlier deptt. in the scale of Rs. 4000-100-6000 Therefore at first pay is required to be fixed in the Accounts cadre in the scale of Rs. 4500-125-7000 in term of rule 5(3) and then IInd ACP may please be given in the next post of Sr. Accountant scale of 5500-175-9000.
Sir, More than 25 year of service,I am getting less remuneration than junior.
Kindly give your views in this regard.
