    Post Cbi duty.

    Sir,

    Sometimes CBI department request employees from other Department of central Government to assist them . In any CBI case sometimes they require witness other than their office . In such cases they ask authority of other department to send any person to appear as witness. Is such kind of duty is mandatory, or the person concern may give his consent as unwilling to attend such duty . Is their any such rule in this matter which can help us.

    After being nominated by the competent authority, the duty is mandatory. If one has any pressing need which can be verified as deemed fit by the competent authority, one should immediately bring it in notice for an alternate nomination. If duty was not performed without a reason where circumstances were beyond the control of govt servant, this amounts to dereliction of duty and competent authority may start deptl proceedings on report received from CBI office.

    Not only in r/o CBI duty, this principle hols true for any duty assigned.
