Red face Attendant to Autistic child aged 3 years

    Dear all,

I had travelled to CMC Hospital, Vellore under valid permission of Competent Authority for treatment of my daughter aged 3 years with permission for "one attendant apart from the mother of the child". I was permitted to be the attendant of the patient.

After the journey was completed, office did not reimburse my TA and says only one attendant is permissible under MA Rules, which is the mother.

However, treating specialists at Vellore clearly certified that the patient required one attendant apart from the mother. Please guide how to proceed.

From CS(MA) Rules, 1944 it appears that only one attendant is allowed TA in addition to the patient.

I have learnt that Courts have allowed attendant in addition to the mother of infant, as she is attached to the baby at all times for baby's needs and can not perform duties of an attendant which requires procuring medicines, going to labs to collect reports, obtaining doctor's appointments etc.

Shall be thankful if any references are quoted.
