    Post Fixation of Pay of upgraded scales as result of 6th CPC recommendation

    Somebody may kindly clarify the following
    A Trained Graduate Teacher (TGT) working under the Department of Education is drawing pay of Rs. 5850/ as on 1-1-2006 in the Pre-Revised Scale Rs. 5500-175- 9000 which was upgraded to 7450-225-11500 and Grade Pay is 4600 in Par-B of the section II of the first schedule was granted to Trained Graduate Teachers as per the G.I., M.F. No.1/1/2008-IC dated the 29th August 2008 CCS (Revised Pay) Rules, 2008.
    The pay fixation of government employees whose post has been upgraded as a result of the recommendation of the sixth CPC should be in the Manner Prescribed in accordance with Note 2A clause (A) (i) and (ii) of Rule 7 of CCS (Revised Pay) Rules, 2008 dated 29th August, 2008.

    His pay in the pay band/pay scale after multiplying the existing basic pay (5850) as on 1-1-2006 by a factor of 1.86 and rounding off the resultant figure to the next multiple of 10 is 10890.

    1. Whether the benefit of bunching as per the Illustration 4A specified in the manner prescribed in accordance with Note 2A clause (A) (i) and (ii) of Rule 7 of CCS (Revised Pay) Rules, 2008 dated 29th August, 2008 is admissible in his case?

    2. Whether he is entitled to get his pay fixed in pay band Rs. 13860 (the minimum of the pre-revised scale 7450-225-11500 in the fitment table with Grade pay 4600) as the minimum of the revised pay band/pay scale is more than the amount arrived after multiplying Rs. 5850 by 1.86(i.e 10890)?

    3. How is his pay fixed on 1-1-2006?

    His pay should be fixed by multiplying existing pay into 1.86 as on 1.1.06. If the concerned person have increment between feb to june in 2005, an advance increment would be added with his pay on 1.1.06. For upgradation, the govt servant will be entitled to receive the corresponding grade pay (here 4600).
    However. His pay may be stepped up with his junior if other criteria for stepping up was fulfilled. This was what govt given in 6 coc.

    Illustration 4A of CCS (RP) 2008 is applicable for pay fixation of upgraded posts. However, MOF OM dated 13.9.2008 diverted this issue on the ground that fitment tables are recommended by 6CPC for pay fixation.Illustration 4A is also recommended by 6CPC for pay fixation of upgraded posts. If Illustration 4A is not used why MOF still keeping it in rule book? But fitment tables of Rs. 4000-7000 and above was not incorporated bunching. MOF should clarify for upgraded posts and amend OM dated 13.9.2008 accordingly in order to solve MOF created anomalies.
