    SIR,
    i am appointed in railways on 01-07-1991 and in working so earned two promotions till 2006.there after i got inter railway request transfer to initial grade.at the time of transfer i was in PB-2 + 4200 GP. I was reverted to PB1 + 1900 GP AND TRANSFERED TO NEW ORGANISATION ON 22-01-2007. I was denied ACP at the time transfer on the reason that i had earned two promotions in the previous organisation. In 2010 i got my first promotion in the new organisations in PB 1+ 2400 GP. whether am eligible for first financial upgradation under MACP at the time appointment in the new organisation? and whether eligiblr for second upgration since i had completed 23 years of service. pl clarify

    D.O.A - 01-07-1991

    Date of joining new organisation- 22-01-2007

    last promotion -01-05-2010 in PB1 + 2400

    In cases of transfer on request, it was clarified by OM No.F.No.16/6/2001-Estt. Pay I dated 14-2-2006(http://ccis.nic.in/WriteReadData/Cir...Estt-Pay-I.pdf that the pay will be “ fixed at a stage equal to the pay drawn by him in the higher grade”. This protection is in effect lost vide OM F.No. 13/9/2009-Estt(Pay-I) dated 21-10-2009(http://ccis.nic.in/WriteReadData/Cir...%20(Pay-1).pdf wherein it is stated that in such cases only grade pay of the lower post will be eligible. This OM is an injustice since it denies pay protection which was available on transfer to lower post on request. This OM need to be challenged to get justice in this case. Some benches of the Hon.CAT has already given orders in favour of pay protection in such cases.

    If you were reverted to the lower post before being relieved for the new organisation/ office, then past promotions will be ignored for the purpose of MACPS in the new organisation/ Office. OM dated 4.10.2012 refers (http://ccis.nic.in/WriteReadData/Cir...I-04102012.pdf)
