1. ## fixation when going FROM HIGHER GRADE PAY TO LOWER GRADE PAY post

Resp. sir,
I reached basic=15670 in the pay scale 9300-34800, gp-4400,

than i selected and joined the post having pay scale=5200-20500, g.p.2800 in the same organization.

if pay protection is available then my query are:
(1)what will be my first basic and total basic in the new post..i.e. how my fixation will be done?

(2)how will be calculated my future increaments?

plz ans with figures........

Pay Fixation will be done as follows:

Pay in the higher post : Rs. 15,670/- + GP 4200/-
Pay fixed in the lower post : Rs. 15,670/- + GP 2800/-

Future Increments will be calculated on (15,670 + 2800).

but IN DOPT OM word "pay in pay band" is confusing" to me. my question is:
in 6th cpc we all have two basics i.e. first basic and total basic and we all get d.a., hra etc on total basic, not on first basic.
so as per pay protection rule (or as per logic behind pay protection..!) what will be protected ? first basic or total basic ?
i.e. in my case :

in pay band 9300-34800 (gp-4400) there is starting pay (or total basic) fixed at 15210.
in this there is 10810 [U]first basic[/U] + 4400 gp... combines and makes 15210 (total basic.).

after one increament i reached at: 11270 (first basic) + 4400 gp= 15670 (total basic).

now if i join post having pay scale 5200-20500 g.p.2800. and pay protection is available than what will be my first basic and total basic?

4. Post 6CPC, Basic Pay consists of two components viz. 'Pay in the Pay Band' and 'Grade Pay'. There are NO two 'Basics'.

As per the DOPT OM dated 21.10.2009 only the pay in the pay band will be protected (subject to maximum of the lower pay band) and not the Grade Pay.

From the details you have given now, it appears that you were drawing Rs. 11,270/- as 'Pay in the Pay Band' before your apointment in the lower post/scale.

Hence, your pay in PB2 will be fixed at Rs. 11,270 and your Grade Pay wil be Rs. 2800. Your Basic Pay accordingly will be Rs. 14,070/- (11,270+2800). My earlier post #2 stands corrected to this extent.

PS: There is no GP 4400 as per 6CPC pay structure.

5. Victor sir,
What would be the position relating to fixation (if a person has been granted ACP/MACP, but at a later point of time gets reverted to lower post). The ACP provisions say that if a person defers promotion, then his ACP benefit will also gets deferred. But in this case, reversion to lower place is taking place. Hence, will there be notional fixation downwards (reversing the ACP).

i thought that my total basic rs.15670 may be protected by giving g.p.2800 + 1600 as special or personal pay. so i joined the lower post.
another thing for knowledge: here three g.p. available in gujarat : 4200, 4400 and 4600 in the pay band - 9300-34800. and its starting total basic (i.e.basic+g.p.) fixed at .........., 15210, and 17120 respectively.

In such cases (where the pay in the PB is protected but grade pay is brought down, what would be the effect on future increments? Will they continue to get the future increments or will have to wait till the extra pay in the Payband is absorbed in the future incrmeents?

Also, an UDC, on his own volition, came to another establishment as LDC (for domestic convenience). Hence her pay has been fixed as it was in the Pay band and the Grade pay has been fixed as Rs. 1900/- (LDC). She has been arguing for GP Rs. 2400/- (which she was drawing earlier) and people here have advised her to go to Court/ CAT and file a case for the higher GP. - Your comments, Sir.

Increments will be admissible based on the pay in the band fixed and lower grade pay.

As regards the case of the lady, the admissibility of GP 2400 is out of question.
