    Default Applicability of ACP/MACP for those who changed departments on direct recruitment

    Some employees after entering into Government service in "A" dept., apply for direct recruitment to higher posts in other departments say "B" dept and further join "C" dept. by direct recruitment. In such cases, the employee by his own volition joins newer departments on a higher post on direct recruitments and there is no promotion from the department's side.

    In such cases, the question is whether MACP be applicable and the 10 year period be reckoned from the date of joining in "A" department (ignoring the direct recruitments to higher posts). Or for the purpose of MACP, the period of 10 years will be reckoned from the date of joining in "C" department.

    Refer para 9 of Annexure to MACP Scheme dated 19.5.2009 according to which 'Regular Service' for the purpose of MACP will start from the date of direct recruitment. However past continous regular service in a post carrying same grade pay prior to regular appointment without a break, shall also be counted for the purpose of MACP.

    In the instant case the period of 10 years will be reckoned from the date of joining Department 'C' assuming the Grade Pay in Department 'A', 'B' & 'C' are not same.
