    Default ACP and MACP

    Dear Friends,
I would like to know the opinions of our forum on the recent verdicts quoted by staff association of Survey of India on MACP which states that MACP has to be given in promotional hierarchy, not in the next grade pay. I think the Government may appeal in the forthcoming cases at the level of Supreme court to insist their point.

Friends, Delhi High Court on 26.07.2013 (W.P 4662/2013) stayed order of CAT Delhi till reply from respondents is heard. https://www.dropbox.com/s/d1u8g5wker...0of%202013.doc

Court gave order on flimsy ground presented by GOI which says The Punjab and Haryana High Court did not take into account that when the MACP scheme was introduced the recommendations of the 6th Pay Commission were in place and hithertofore concept of pay scale came to be replaced by pay bands and grade pay.

My take, no one has objection 6th CPC introduced Pay band and grade pay. But financial upgradation into immediate next higher grade pay in hierarchy of pay band after 10, 20 & 30 years of service (MACP) and not to grade pay in promotional hierarchy (ACP) is objection.

    Lets wait for final judgement.

    Dear Friends,
The next date of Delhi High Court case (W.P 4662/2013) which had stayed order of CAT Delhi, is 11th November 2013. Lets hope the High Court Delhi will support the CAT, Delhi Judgement order 2012 in favour of numerous employees who wants MACP in hierarchy of promotional posts.
