    Default Regular promotion in continuation to ad-hoc promotion

    My department ABC has conducted DPC on 28-11-2008 and given adhoc promotion UDC for one year w.e.f 28-11-08 vide office order dated 4/2/2009.But, later on issued corrigendum that adhoc promotion is effective from the date of joining in the post. Is this correct? Date of promotion is effective from date of DPC or date of joining in the post? please clarify.I have joined in this post on 24/2/2009 and pay fixation is done by my department as given below:-

    1)Pay on 23/2/2009 in the payband 5200-20200 is Rs.7160+ 1900(GP)
    2)pay after notional increment of 3% in the above pay band is Rs.7160+280+1900
    3)Pay in promoted post fixed as on 24/2/2009 in the pay band
    of Rs.5200-20200+GP2400 is Rs.7440+2400

    4) no annual increment has given on 1/7/2009
    Will i get annual increment ?
    5)My promotion is regularised w.e.f 01/5/2010 vide order dated 18/5/10
    6) No option for pay fixation has given by department but given increment on 1/7/2010

    Sir, the above is correct or not?

    According to me the pay fixation should be done as below:-
    1)pay on 27/11/08 is 7160 +1900(GP)
    2) pay to be fixed on 28/11/08 (w.e.f DPC date) is 7160+2400 (GP)(Grade pay to be given)
    3)pay on 1/7/2009 is 7440+1900 (GP) (giving annual increment in the lower grade)
    4)pay on 1/5/2010 is same as above because my option would be fixation of pay from the next date of increment(option for fixation of pay is admissible when ad-hoc promotion is followed by the regular promotion)
    5)pay on 1/7/2010 is Rs.7440+280+1900 (giving annual increment in the lower grade)
    and pay on 1/7/2010 is Rs.7720+290+2400 (giving notional increment on account of promotion.
    6) therefore pay should be on 1/7/2011 is 8330+2400 (after giving annual increment)
    7)pay on 1/7/2012 is 8600+2400(after giving annual increment)
    8)pay on 1/7/13 is 9000+2400(after giving annual increment)

    Promotions are effective from a prospective date after the competent authority has approved the same.

    Hence, it is logical that ad hoc promotion in your case is effective from the date of assumption of the post.

    Pay fixation is correct.

    However, if adhoc promotin is followed by regular promotion without break, then option for pay fixation is admissible from the date of initial promotion, under FR 22.

    You have not replied to my earlier post to confirm whether which pay fixation was correct either mine or my departments..however i noticed a mistake in my calculation
    and recalculated as below:-

    given adhoc promotion on 28/11/08 and pay at that time is 7160+1900=9060
    I was regulairsed w.e.f 1/5/2010 my calculation is given below:-

    on 28/11/2008 -7160+2400=9560 (only grade pay given on ad-hoc promotion)
    on 1/7/2009 - 7440+1900=9340 (giving annual increment in the lower grade first and
    7730+2400=10130(pay fixation done giving notional increment on promotion
    on 1/7/2010-8040+2400=10400 (annual increment)
    on 1/7/2011-8360+2400=10760 (annual increment)
    on 1/7/12- 8690+2400=11090
    on 1/7/13-9020+2400=11420 and so on...

    please confirm whether my pay fixation is correct or not?

    The pay fixation done by your department which is reproduced below is correct:

    Pay in promoted post fixed as on 24/2/2009 in the pay band of Rs.5200-20200+GP2400 is Rs.7440+2400

    sir,

    my adhoc promotion is regularised w.e.f 1/5/10 then option for fixation of pay will be admissible from the date of initial promotion i.e 28/11/08. If i choose option to fix pay from the date of next promotion my calculation is above right Sir? Please reply

    Please clarify as to what is the actual date of promotion 28/11/2008 or 24/02/2009.

    Dear victor sir,

    As per our ministry direction date of promotion was 28/11/2008 but ,our department some how stated that date of promotion was effective from 24/2/09(i am going to represent this matter as i have ministry order which is a separate issue)and regularised w.e.f 1/5/2010 without any break. Now my latest calculation is correct or not? even if promotion is effective from 24/2/2009 the calculation holds good.(i.e date of pay fixation would be on 1/7/2009 which is 7730+2400=10130. please confirm.Sir,thank you very much for giving all the replies.

    If adhoc promotion is followed by regular promotion without break, then option for pay fixation is admissible from the date of initial promotion, under FR 22. The calculation in both the cases i.e. Date of Promotion being reckoned as 28/11/2008 or 24/02/2009 is as follows:

    (A) Date of Promotion: 28/11/2008

    Pay w.e.f. 27/11/2008: Rs. 7160 + GP 1900 (Before pomotion)
    Pay w.e.f. 28/11/2008: Rs. 7440 + GP 2400 (On promotion)
    Pay w.e.f. 01/07/2009: Rs. 7740 + GP 2400 (Annual Increment)
    Pay w.e.f. 01/07/2010: Rs. 8050 + GP 2400 (Annual Increment)
    Pay w.e.f. 01/07/2011: Rs. 8370 + GP 2400 (Annual Increment)
    Pay w.e.f. 01/07/2012: Rs. 8700 + GP 2400 (Annual Increment)
    Pay w.e.f. 01/07/2013: Rs. 9040 + GP 2400 (Annual Increment)

    (B) Date of Promotion: 24/02/2009

    Dear Victor Sir,

    Thanks for all your help.I have given representation in my department. When I was regularised w.e.f 1/5/2010 neither my department intimated to give option form for fixation nor I am aware of the rule to submit option form.Now, our accounts officer is objecting that I have not given option at that time. It is the responsibility of the Administration to inform me to give option form filled up. My fixation can be regularsied now by submitting option form? Please reply urgently sir....

    Administration is required to indicate the clause of option in the promotion order itself. This is mandatory as per DOPT OM dated 12/12/1997 (http://ccis.nic.in/WriteReadData/Cir...ec,%201997.htm).
