Default Can Option be revised when Pay is fixed within 1 month stating Option as NIL by Deptt

A person gets promoted and he is eligible to exercise option within one month of joining. But the Department fixes pay before completion of one month stating option to be NIL.

One month period is not over in this case. Without waiting for completion of one month, it fixed pay and stated option to be NIL on 20th day itself.

Now employee has represented requesting that his option should be revised as one month period was not exhausted for exercising of option. How can the deptt. come to conclusion that no option was there when the one month period itself was not over.

Is this permissible on representation by the employee?

One month's time is permissible in such cases. Employee can exercise his option within this time period. If the same is not accepted then he can represent.
