    Default Pay fixation of S.O (Accounts) on promotion after 01.01.2006

    Hi..!! I am presently working as Section Officer (Accounts) in the railways. I was in the pay scale of 4500-7000 on 01.01.2006 and my basic pay was 4875/- on 01.01.2006 and the month of increment was March.
    I was promoted in the scale 6500-10500 on 24.07.2007 after passing IREM-III Exams. Now in the Pay commission we have been given the Grade pay of Rs. 4800/-.
    Please guide me in my fiaxtion as on:
    01.01.2006
    01.07.2006
    01.07.2007
    24.07.2007
    01.07.2008

    As per new PC the minimum pay of direct recuits in Grade pay 4800/- is 18150/-, hence it appears that the pay of old employees should not be less than this amoumt. Kindly guide me..!!

    Dear friend
    you will get pay of Rs.4875X1.86+Grade Pay as on 1/1/06. Add 3% increment on 1/7/06 on it and again 3% on 1/7/07 as increment. On date of your promtion you will get only one increment of 3% on this pay+ Grade pay of promotional post.On 1/7/08, you will get one more increment of 3% on it.
    As regards minimum pay, your pay will not be fixed at the minimum of Rs.18150/- applicable to direct recruits. There is no such provision in CCS(RP) Rules 2008. You may be on loss but could get the benefit of stepping up of your pay w.r.t. your junior if any.
    It is the one of the biggest anomaly which is to be sorted out. However MoF is perhaps considering to revise the pay fixation formula from 1.86 to 2.06 in order to remove such anomaly. Hope for the best.

    Thanks Dear for your reply, I would also like to know weather it is possible to get the minimum of 6500/- in ths scale 6500-10500 on my promotion date i.e 24.07.2007, which comes out to to be 6500X1.86 = 12090+4800? If this is so please tell me along with relevent orders of CCS rules. Because one gentlemen told me that if you opt to get your pay fixed from 24.07.2007, then its possbile that you get your pay fixed at 12090+4800, while at the same time lossing the arrears from 01.01.06 to 23.07.2007. Please tell me is this is so, is beneficail in the long run. Thanks, Tauqueer.

    what the said gentlemen has told is correct. If you would have opted the revised pay fixation from the date of promotion, you would have got the higher pay coresponding to Rs.6500/-. But fact is that you must have given your option of pay fixation and this can not be revised now. If there is any possibility of revising the option, you can do it. Loss of arrear will cover in few months with higher pay. If it can not be revised, wait for MoF further clarification which may or may not come. Hope for the best.

    Default 1.86 Vs 2.06

    Dear friends,

    It is now heard that a new multiplying factor (2.06 instead 1.86) is invented to remove the anomalies created in respect of certain categories of post.

    Instead of removing the anomalies, a uniform application of new factor will grant benefits to all. Welcome.

    But the anomalies will remain there.

    In that case, there will be an increase in the pay @10.75% (1.86 to 2.06) of all employees.

    The present 40% increase resulted a burden of abount Rs.20,000 crores in the form of arrears.

    That means an additional burden of Rs.5000 crores (approx) in the new formula which is not a problem.

    But the problem arises on removing any anomalies in respect of certain groups at the cost of 20-50 crores.

    Dear Jitendraacr,
    As per my opinion, in case an employee opted the revised pay structure from the date of his promotion subsequent to 01.01.2006 as per second Proviso to Rule 5 of CCS Revised Pay Rules 2008, his pay in the revised pay structure should be fixed based on his pay in the lower post and then fixed in accordance with Clarification No. 2 of OM F. No. 1/1/2--8-IC dated 13.09.2008. This has been clarified in Clarification 2 of Ministry of Finance Om F.No.1/1/2008-IC dated 29.01.2009 wherein it is stated that in such cases pay will be regulated under proviso to Rule 5 of the Revised Pay Rules 2008 and after switching over to the revised pay structure, Clarification 2 (method of fixation of pay on promotion after 01.01.2006) issued vide Ministry of Finance letter of even number dated 13.09.2008 will apply.

    In case the pay in the promoted post is taken for fixation of pay in the revised pay structure, the question of applying Clarification 2 of OM dated 13.09.2008 does not arise. Further, as per Explanation -1 below Rule 5, the option to retain the existing scale under the provisos to this rule shall be admissible only in respect of one existing scale. This is contradictory to Second Proviso to Rule 5. Kindly clarify.
