    Default grade pay 5400 to the Supdt.

    As clarified by the CBEC dated 21.11.08 that grade pay 5400 should be given after 4 years counted from the promotion/placed in the scale of 7500-12000 abd correspoing scasle given as on1.1.06. The interpetion done by the department that scale of Supdt. 7500-12000 has been implemented in the year 2004 and 4years should be counted from the scale of 7500 which Supdt.has been placed. please clarify

    The query pertains to our department(Customs and C.Excise).
    The participants of and readers in this forum may recall that the CPC recommended GP 5400 to those Superintendents/Appraiser who complete four year regular service. While transforming the recommendation into Rules for implementation, the Rules put it as Four year service in the Grade pay (of 4800).
    This led to the doubt as to whether it was incumbent on an officer to complete four year service from 1.4.2006 that is only from 1.4.2010.
    The implementation cell(Expenditure Department), in its reply (dated 24.10.2008) to some RTI Application, clarified that "Four years of Regular Service in Pre revised scale of 7500-12500 will be counted from the date of promotion in this grade".
    Susequently, CBEC has come out with the clarification referred to by Shri Kaloliyajee.
    While it is true that the third para in the Board's letter gives an impression that the period will be counted from 21.4.2004, it is worth noting that the same para states that if an officer has completed 4 years as on 1.1.2006 he will be given this NFGP of 5400 from 1.1.2006.
    Under the circumstances, in my view, such of those officers who completed 4 years in the Grade of Supt (obviously functional Supts) as on 31.12,2005 shall be granted the said NFGP of 5400 from 1.1.2006.
    Having said that, the Board could have done well by avoiding the general term of Officer and instead used the actual designation, "Superintendent/Appraiser".

    I am attaching herewith the DoPT OM issued in 1992 which governs all issues of upgradation arising out of pay commission etc.

    Please go through para 2.2 of the said OM, which specifically states as:

    Where the up-gradation involves a higher replacement scale without higher responsibilities or higher educational qualifications, but with a higher eligibility service, the incumbent need not be assessed for their suitability, but it should be ensured that they have completed the requisite qualifying service for appointments to the upgraded post. In case they have completed the qualifying service on or before the date notified by the Government, they may be appointed to the upgraded post from that date. In the case of others who fulfill the qualifying service on a later date, they should be appointed to the upgraded post from the date on which they complete the qualifying service. This would be subject to the condition that irrespective of the date of appointment, the original seniority of the incumbent in the grade prior to the up-gradation will be maintained for appointment to the upgraded post.

    My reading of the said OM implies that four years regular service as Supdt/Appraiser/ITO is enough for an officer to get the upgradation.

    I request the seniors of this forum to give suggestions/clarifications and possible way to clear this mess

    A supdt of central excise who got first ACP during 2000 and promoted to the grade of supdt in 2006 is claiming for grade pay of rs5400 from 21/4/08 after completion of 4yrs in the payscale of 7500. pls clarify whether the same is correct or not???

    The three different answers lie, one at the end of each different route;-

    Route one: Tour conducted by Expenditure Dept: (through RTI enquiry)
    The querist has not stated the date on which the individual
    was promoted. Any way, going by the Rply dated 30.10.2008 , the Superintendent referred to in the query, shall start
    getting GP of 5400 from the day following the day on which he
    completes 4 years in 2010.
    Route two: Tour conducted by CBEC vide its letter circulated amoung CCs/
    DGs, the Superintendent will start getting Grade Pay of 5400
    from 21.04.2008, since the officer's post was upgraded from
    prev scale of 6500 to pre revised scale of 7500 with prospective
    effect from 21.04.2004.( I belong to this category -
    joined as Inspector in 1992, got ACP in 2004, pre rev scale of
    7500 on 21.04.2004, promoted as Superintendent(functional )
    in OCT 2007).
    Route three:CBEC's letter referred to herein above is interpretted in a number
    of commissionerates in such a way that , even (DR)Inspectors
    who have got the first ACP and started getting Pay in the
    upgraded pre revised scale of 7500 on 21.04.2004, would get
    GP of 5400. When inspectors get, there can not be any doubt
    that the Superintendent referred to in the query would get GP of
    5400 from 21.04.2008 only.
    Conclusion: I am constrained to leave it to the querist.

    Dear friends,

    one of the supdts in our office (central excise) has a problem in fixation of pay.
    The details are:
    pay as on 1.1.06 : 9250
    pay as on 1.2.06 : 9500 (The officer has opted to come to the revised pay w.e.f 1.2.06 , his original date of increment in the old scale)
    Date of promotion to
    the grade of supdt : in the middle of 2001
    Date of 2nd ACP : 22.6.06
    He has exercised option to get the 2nd ACP benefit w.e.f 22.6.06.
    In this case, I am having 2 doubts.

    i. whether he should be given grade pay of Rs.5400 w.e.f 1.2.06 as he had completed more than 4 years of service in the grade of supdt as on 1.1.06 (based on RTI reply &
    clarification dated 4.11.08 of Dept of posts as the issue is similar to them also)
    ii If the 4 ys service is counted w.e.f 21.4.04, the date of implementation of 7500/- ( based on cbec's letter dated 21.11.08 ) he will be eligible for 5400/- only from 21.4.08.As he is benefitted by ACP and has been given 5400 from 22.6.06 itself, the question of upgradation does not arise if this method is followed.

    Please guide me which of the above said 2 is correct.

    Dear friends,

    I would like to express my views on the subject:

    The words 'after 4 years' given at col.4 of Section II of Notification against the post of Supdt of C.ex/Customs/ITO/Appraisers :-

    Years of service will always qualify the post and not the scale. The scale is used only for drawing pay.

    Therefore, the words 'after 4 years' will mean that 'after four years service' in that particular post, i.e. 'regular service' in that post.

    The words 'regular service' is also seen in the resolution.

    Further, at Rule 3(6) of the RPRules, 'Grade Pay' is the fixed amount coresponding to the pre-revised pay/ post.
    Therefore, it is clear that the pre-revised pay/post will get same important as Grade Pay gets in the new pay structure. Accordingly, the regular service in GP 4800 shall include the service prior to 1.1.2006 in the post irrespective of scale.

    It is also to be noted that, no where in the notification it is mentioned that the words 'after 4 years' is in the scale of Rs.7500-12500. The words given just below the notional scale of Rs.8000-------.

    Therefore, in my view, there is no need of worry, all who completed 4 years as on 1.1.2006 in the post of Supdt will get the Grade Pay of Rs.5400.

    Dear Friends,
    Differentiation of Department of Revenue staff on comparison to other equivalent staff of Government of India.

    There is a anomaly in the pay of Superintendent o Customs & Central Excise in the 6th Pay Commission report revised by the cabinet committee.
    On comparison of pay band awarded to Superintendent of Customs & Central Excise with
    1. Section officer /PS/equivalent of Staff in the secretariat.
    2. Assistant Nursing Superintendent, Deputy Nursing Superintendent and nursing Superintendent of Nursing and para medical staff.
    3. Post Graduate Teacher, Vice Principal of Teachers.
    4. Audit / Accounts officer of Organised Accounts Cadres.
    5. Master Gazetted in military Schools of Ministry of defence, Department of defence.
    6. Section Officer (excluded) of Ministry of finance Department of Economic affairs.
    7. Entry Grade in DANICS DANIPS, Pondicherry Civil service and Pondicherry Police Service.
    8. Senior divisional Accounts officer in Indian Audit Accounts Department.

    On Careful examination of pay band of awarded to Superintendent of Customs & Central Excise with the aforementioned eight cadres there is a step motherly treatment in fixing pay band to Superintendent of Customs & Central Excise. The details are as below.
    1. Comparison of pay band awarded to Superintendent of Customs & Central Excise with Section officer /PS/equivalent of Staff in the secretariat.
    Section officer /PS/equivalent of Staff in the secretariat had present scale of 6500-10500. This has been revised to 7500-12000 and to 8000-13500 after completion of our years and has been given PB-3 Band with grade pay o 5400.Where as Superintendent of Customs & Central Excise who were in the present pay scale of 7500-12000 has been placed in the revised band of 7500-12000 with pay band PB2 with grade pay of 4800 and revised pay scale of 8000-13500 with a pay band o PB-2 and grade pay of 5400 after completion of 4 years.


    2. Comparison of pay band awarded to Superintendent of Customs & Central Excise with Assistant Nursing Superintendent, Deputy Nursing Superintendent and nursing Superintendent of Nursing and para medical staff.
    Assistant Nursing Superintendent, Deputy Nursing Superintendent and nursing Superintendent of Nursing and para medical staff were placed in present scale of 6500-10500, 7500-12000 and 8000-15200. The scale have been revised to 8000-13500, 8000-13500 and 10000-15200 with pay band of PB-3 and grade pay of 5400, 5400 and 6600 respectively. Where as Superintendent of Customs & Central Excise who were in the present pay scale of 7500-12000 has been placed in the revised band of 7500-12000 with pay band PB2 with grade pay of 4800 and revised pay scale of 8000-13500 with a pay band o PB-2 and grade pay of 5400 after completion of 4 years.

    3. Comparison of pay band awarded to Superintendent of Customs & Central Excise with Post Graduate Teacher, Vice Principal of Teachers.
    Post Graduate Teacher, Vice Principal of Teachers cadre had present pay scale of Grade II 7500-12000, Grade I 8000-13500 have been revised to 8000-13500 and 10000-15200 respectively. They have been placed in PB-3 band with grade pay of 5400 and 6600 respectively. Where as Superintendent of Customs & Central Excise who were in the present pay scale of 7500-12000 has been placed in the revised band of 7500-12000 with pay band PB2 with grade pay of 4800 and revised pay scale of 8000-13500 with a pay band o PB-2 and grade pay of 5400 after completion of 4 years.

    4. Comparison of pay band awarded to Superintendent of Customs & Central Excise with Senior Audit / Accounts officer o Organised Accounts Cadres.
    Audit / Accounts officer of Organised Accounts Cadres who were in the present scale of 7500-12000 have been placed in PB-2 band with grade pay of 5400. Where as Superintendent of Customs & Central Excise who were in the present pay scale of 7500-12000 has been placed in the revised band of 7500-12000 with pay band PB2 with grade pay of 4800 and revised pay scale of 8000-13500 with a pay band o PB-2 and grade pay of 5400 after completion of 4 years.


    5. Comparison of pay band awarded to Superintendent of Customs & Central Excise with Master Gazetted in military Schools of Ministry of defence, Department of defence.
    Master Gazetted in military Schools of Ministry of defence, Department of defence who were in the initial pay scale of 7500-12000 have been revised pay scale o 8000-13500 & have been awarded PB-3 Pay band with grade pay of 5400. Where as Superintendent of Customs & Central Excise who were in the present pay scale of 7500-12000 has been placed in the revised band of 7500-12000 with pay band PB2 with grade pay of 4800 and revised pay scale of 8000-13500 with a pay band o PB-2 and grade pay of 5400 after completion of 4 years.

    6. Comparison of pay band awarded to Superintendent of Customs & Central Excise with Section Officer (excluded) of Ministry of finance Department of Economic affairs.
    Section Officer (excluded) o Ministry of finance Department of Economic affairs who were in the initial pay scale of 7450-11500 has been revised to 7500-12000 & to 8000-13500 after completion of 4 years with pay band of PB-2 & PB-3 with grade pay of 4600 and 5400 respectively. Where as Superintendent of Customs & Central Excise who were in the present pay scale of 7500-12000 has been placed in the revised band of 7500-12000 with pay band PB2 with grade pay of 4800 and revised pay scale of 8000-13500 with a pay band o PB-2 and grade pay of 5400 after completion of 4 years.

    7. Comparison of pay band awarded to Superintendent of Customs & Central Excise with Entry Grade in DANICS DANIPS, Pondicherry Civil service and Pondicherry Police Service.
    Entry Grade in DANICS DANIPS, Pondicherry Civil service and Pondicherry Police Service who were in the initial pay scale of 6500-10500, the pay has been revised to the pay scale of 7500-12000 and to 8000-13500 after completion of 4 years. They have been awarded pay band of PB-2 and PB=3 with grade pay of 4800 and 5400 respectively. Where as Superintendent of Customs & Central Excise who were in the present pay scale of 7500-12000 has been placed in the revised band of 7500-12000 with pay band PB2 with grade pay of 4800 and revised pay scale of 8000-13500 with a pay band o PB-2 and grade pay of 5400 after completion of 4 years.

    8. Comparison of pay band awarded to Superintendent of Customs & Central Excise with Senior divisional Accounts officer in Indian Audit Accounts Department.
    Senior divisional Accounts officer in Indian Audit Accounts Department who were in the initial pay scale of 7500-12000, the pay scale has been revised to 8000-13500. They have been awarded the pay band of PB-3 with grade pay of 5400. Where as Superintendent of Customs & Central Excise who were in the present pay scale of 7500-12000 has been placed in the revised band of 7500-12000 with pay band PB2 with grade pay of 4800 and revised pay scale of 8000-13500 with a pay band o PB-2 and grade pay of 5400 after completion of 4 years.
    Thus it can be seen that there is a clear cut step motherly treatment of Superintendent of Customs & Central Excise. There is a time limit of four years for revision to the scale of 8000-13500, but the same time limit is not admissible to
    1. Assistant Nursing Superintendent, Deputy Nursing Superintendent and nursing Superintendent of Nursing and para medical staff,
    2. Post Graduate Teacher, Vice Principal of Teachers.
    3. Senior Audit / Accounts officer of Organised Accounts Cadres.

    5. Senior divisional Accounts officer in Indian Audit Accounts Department.
    There is a time limit of 4 years in respect of
    1. Section officer /PS/equivalent of Staff in the secretariat.
    2. Entry Grade in DANICS DANIPS, Pondicherry Civil service and Pondicherry Police Service.
    3. Section Officer (excluded) of Ministry of finance Department of Economic affairs.

    But, these cadres have been placed in the pay band of PB-3 and not PB-2 as in the case of Superintendent of Customs & Central Excise.

    Also the Superintendent of Customs & Central Excise has been allotted the pay scale of 7500-12000 very recently with the acceptance of pay of 6500-10500 to Inspector of Customs & Central Excise on par with the inspector of CBI. Thus the Superintendent of Customs & Central Excise with the pay scale of 7500-12000 and who have completed 4 years as on 01,01,2006 is NIL. If there are one the are the one who has got their second ACP. As a matter of fact these officers have to be placed in Pay band of PB-3 15600-39100 with a grade pay of 5400 since the next level of promotion from Superintendent of Customs & Central Excise will be only Assistant Commissioner of Customs which is Group A Service. CBEC is a peculiar department where the next promotion opportunity for Inspector is Superintendent of Customs & Central Excise and that for Superintendent of Customs & Central Excise is Assistant Commissioner.

    The time of award of pay scale of 7500-12000 to Superintendent of Customs & Central Excise has not at all been considered neither by sixth pay commission and nor by the review committee. They have not given proper attention to the pay revision of Superintendent of Customs & Central Excise.
    In the present system the number of Inspector available are very less, because of this peculiar problem the Superintendent of Customs & Central Excise has to work both as basic worker and also as a supervisory officer.

    I request all the officers to go deep in to the matter & the Association people to directly refer the matter for redressal at ANAMOLY COMMITTEE.

    Dear friends,

    CBDT has agreed to grant GP5400 all the ITO who have completed 4 years regular service in the post.

    Now the ball is in CBEC's court to extend the same to the Sudpt of CE/Customs and Appraisers.

    There is lack of fine tuning in interpretation of the rules and regulations at implementation stage which cause delay and heart burning.

    Please follow the link http://www.cengokerala.org/_document...irNo2-2009.doc where in you will get the latest circular issued by "ALL INDIA ASSOCIATION OF CENTRAL EXCISE GAZETTED EXECUTIVE OFFICERS". Please note that there is no mention of Grade pay for Inspectors who have got ACP & later promoted to the grade of Supdt or still continue in the grade of Inspector.So please send email to [email protected] demanding the same.

    In some offices in karnataka ( i knew) gradepay 5400 was given and later in march '09 withdrawn to 1992 batch INSPECTOR who were prmoted in oct-2007.

    since objective of ACP is to give financial upgradation without actual functional responsibility (i.e. designation change), then WHETHER one becomes supdt. or not..
    ONCE so many years of service entitles for ACP , then any form of financial benefit in the form of salary or grade pay etc. must be given to the employee.
    this will only ensure equality among the employess who joined service in the same cadre in the same year.
    ELSE
    it may so happen that-
    in some state cadre..inspector(1990 batch , say) promoted after 18years and he gets grade pay of 5400 start of 23rd YEAR.
    but, in other state..INSPECTOR (1990 batch) promoted after just 14 years gets grade pay 5400start of 19th year itself
    the above desperity(anomaly, if u call) can be avoided if spirit of giving ACP is also made applicable in extending grade of Rs. 5400/-

    Who will BELL THE CAT. Our Association is making an effort which has not yielded any fruitful Effort.
    They Should have changed their strategy. Altogether a different approach is needed. They should also keep CBEC under pressure. They should get the details of what happened to different cadres who are like wise benefited. Like

    Default Grade pay 5400 to adhoc supdt/appraiser

    The CBEC Circular on this subject referred "Regular" Supdt/Appraiser eligible for grade pay 5400 after 4 years of service in the Supdt/Appraiser post. But who were promoted to Supdt /Appraiser in the year 2003 and not regularised due to different court cases on seniority list are also being denied this grade pay. They were very much promoted to the post of Superintendent /Appraiser and are holding the functional responsibility and the promotion were never temporary as they are continuing for 6 years without revertion, so why they will not get the financial benefits of higher grade pay of 5400 as they have already completed 4 years since April 2004 in the pay scale 7500. In case of Pay benefits the term "Regular" should be "Not in Tempory Promoted Post". Can anybody clarify this matter?

    Hi all

    It appears that good sense has finally prevailed on the Dept of Expenditure on the subject of grant of Grade Pay of Rs. 5400 in PB-2 after four years for the posts of ITO, Supdts etc in the Department of Revenue in Ministry of Finance.

    A latest clarification issued by CBDT in respect of ITOs is available on the web site of ITGOA, Tamilnadu and Pondichery. Here is the link:-

    This clarification makes only two conditions:
    1. The officer should be having four years of regular service in the post of ITO (irrespective of the pay scale of the post);
    2. The officer should be clear from vigilance angle.
    The higher grade pay is to be granted retrospectively with effect from 01-01-2006.

    However this clarification specifically excludes those officers who are in the Grade Pay 4800 in PB-2 on account of ACP. Thus it excludes the ACP Inspectors.

    Dear coolgoose2,

    Our motto was to get the Grade pay of Rs.5400/- to the ACP inspectors from date of ACP. The issue has already been clarified in CBEC also accordingly. Supdt after 4 years are getting Grade pay of Rs.5400/- but it was also givwn to ACP Inspectors also but withdrawn later.

    So fight for Grade pay of RS.5400/- for ACP inspectors also.

    Do u mean to say the Supdts r already given 5400 GP w.e.f. 1.1.2006. My info. is they r given it only from 21.4.2008 as of now.

    Thanks for the info. This issue is being tossed in all possible way by CBEC. Hope the truth and the intention of SPC will prevail ultimately.

    CBEC HAVE CLARIFIED VIDE F NoA-26017/98/2008-Ad II A DATED 16/09/2009 THAT SUDTS/ EQUIVALENTS ARE ELIGIBLE FOR GP 5400 ON COMPLETION OF 4 YRS OF REGULAR SERVICE IRRESPECTIVE OF SCALE OF PAY.
