Default Discrimination against those having the Ist of a month as their date of birth

After the recommendations of the 6th Central Pay Commission, the Government of India introduced a new concept about enhanced pension to those attaing the age of 80 years etc. Of course, this is a welcome decision. In respect of all those born on the 2nd, 3rd onwards would get enhanced pension from the month in which their dates of birth fall. At the time of retirement they would have got pay and allowances etc. for the month in which their dates of birth fell as they would have retired on the last day of that month. But in the case of all those whose date of birth is Ist of any month would get the enhanced pension from the month in which their date of birth fall. BUT CONTRARY TO THE POSION IN RESPECT OF THOSE BORN ON OTHER THAN THE IST OF A MONTH, THEY WOULD HAVE NOT DRAWN THE PAY AND ALLOWANCES FOR THE MONTH OF THEIR BIRTH AS THEY WOULD HAVE RETIRED ON THE LAST DAY OF THE PREVIOUS MONTH.

This is clear cut discrimination against those born on the Ist of a month. This anamoly could be removed by allowing all thos born on the Ist also to retire on the last day of the same month. In respect of those already retired they on the last day of the preceding month could be given notional benefits for one month from the Ist January, 2006. This would be of great benefit to all those born on the Ist January, 1946 as they would have retired on the 31st December,l 2005 losing all the benefits os the sixth pay commission.

Any Association/union may take up the matter in the ensuing meeting of the Anomaly Committee to be held on the 17th July, 2012.

There is no anamoly. In the case of persons having date of birth 1 of the month and retire on last day of previous month the age on next birthday is 60 years for calculating commutation of pension, whereas in the case of others it is taken as 61 years and benefit of added year of commutation value be there
