    Default ACP after merger of Two posts in promotional Hirerchy w.e.f 1.1.2006

    Chronoligical Events in my service:-

    I joined Service as Technical Assistant in 1993 in pay Scale of 5000
    Got 1st ACP in 2005 in pAY sCALE OF Technical Officer i.e 5500 in promotional Hirerchy
    My pay Got fixed in GP 4200/- as on 1.1.2006
    I was granted benefit of 1 ACP in GP hirerchy w.e.f Sept 2008 in 2010 according to new MACP.(Means I got benefit of 1st ACP after 15 years of service in MACP Scheme)

    My Department merged Both the scales w.e.f 1.1.2006 and re designated the Post as Technical Officer on 28.3.2012.

    ""The Promotional Hirerchy is as under (Acc to V pay Commission)
    5000_Technical Assistant
    5500_Technical Officer
    8000_Assistant Director

    All my seniors had got 2 ACPs in promotional Hirerchy before VI CPC and got 3rd MACP in GP hirerchy.""

    My Query to senior Members of the forum is that.

    Can I demand my Department to give me benefit of 1st ACP in the Promotional Hirerchy of Scale i.e. 8000 (Now GP 5400) since the Post I am working on and the higher post in promotional hirerchy of which I got as 1st ACP has now been merged as on 1.1.2006.

    If any one have any such instances, where such merger and ACP had been granted, Kindly provide me orders or names of the Department / contact details. I will be highly Obliged.

    Such disparity is effecting almost 100 employees in my Department.

    DOPT had issued a clarification for dealing with such cases when the 5th Pay Commission Report was implemented (Sl.No. 1 of OM dated 10.2.2000 at http://circulars.nic.in/WriteReadDat...D)(Vol.IV).htm). However, no such clarifications were issued after 6th Pay Commission Report was implemented. Further, the clarification referred to above cannot be relied upon in the instant case as the ground realities are different in both the cases. Firstly, the ACP-1999 Scheme was a post 5CPC development while in the instant case ACP-1999 was in operation with 5CPC & 6CPC during the period 1.1.2006 to 31.8.2008. Secondly ACP-1999 has been replaced by MACP-2008 w.e.f. 1.9.2008. Thirdly no anomaly would occur if a junior joins the merged grade as he would be covered under MACP-2008 and not ACP-1999.

    As the ACP Scheme was based on the "existing" cadre hierarchy, in my view you can be entitled to 1st ACP to the scale of Asstt. Director w.e.f. 1.1.2006 only if the cadre restructuring was done with retrospective effect from 1.1.2006. However, I feel your Department must have done the restructuring with prospective effect. Kindly note that even if during the period 1.1.2006 to 31.8.2008 the posts of Technical Assistant and Technical Officer exists, although both in PB2+GP4200, then NO benefit would be admissible as ACP is applicable as per "existing hierarchy" and not as per pay-scale hierarchy.

    My department has done restructuring w.e.f 1.1.2006
    I am planning to represent to department to give me benefit of
    1st A C P on 1.1.06 in my promotional hierarchy which is now
    Asst Director.
    If I don't get this benefit , I will be the sufferers as the senior in my cadre are getting even 6600 GP after 3 macp.
    Actually they got benefit of both acp and Macp.
    They got asstt director scale in acp as it was in promotion hirerchy.
    Soon they got 6600 as soon as macp became applicable.
    Where as now ppl like me will not even reach 5400 even after 30 years of service.
    It seems to be injustice to me.
    I am really aggrrived, can any one help me in this regard,
    My be I have to go to CAT for justice.
    Kindly guide.
