    Default 3rd macp on account of merger of pay scales of 5500-9000 and 6500-10500

    Sir, I was appointed as steno grade-III in a subordinate office of Army, on 23 May 1984 and got first promotion to Grade-II on 01 Feb 1990 and second promotion to Grade-I in Sep 2000. Post 6 CPC, due to merger of pre-revised pay-scales of 5500 and 6500 my second promotion from Grade-II to Grade-I was ignored and granted 2nd financial upgradation to the GP of 4600/- wef Sep 2008. Now, I have completed 10 years in the same grade of Steno Grade-I on 18 Sep 2010 and my office says that I will be eligible for 3rd MACP only on completion of 30 years of service (on 24 May 2014).

    Since my promotion to grade I was ignored on account of merger of pay scales and granted 2nd MACP wef Sep 2008, and I have completed 10 yrs service in the same grade (ie Steno Grade-I), am I not eligible for 3rd MACP wef 18 Sep 2010? Will you please clarify if.

    Kindly indicate the pre-revised scales of Steno Gr.III, II & I.
    Also indicate the details of fixation under 6CPC.

    1. Pre-revised pay scales of Stano Grade-III was 4000-100-6000, Grade-II was 5000-150-8000 and Grade-I was 5500-175-9000.
    2. Post 6 CPC, my pay was fixed at 13,160 with grade pay of 4200/-. On account of merger of pay scale, I was given upgradation to GP-4600 wef Sep 2008. I was given 2nd upgradation due to merger of pay scales by ignoring my promotion from Grade-II to Grade-I, but not granted 3rd upgradation after completion of 10 yrs in that grade (Grade-I).
    3. Since I continue to be in Grade-I since 18 Sep 2000 and completes 10 yrs in that grade on 18 Sep 2010, please clarify the due date for grant of 3d MACP.

    3rd MACP would be admissible on completion of 30 years or service or on completion of 10 years of service in the same "Grade PAY" whichever is earlier. Kindly note that it is "Grade PAY" and not "Grade" which is the crucial factor. You will complete 10 years of servie in the same "Grade PAY" only on 1st Sept 2018.

    Hence, 3rd MACP to GP 4800 would be due in May 2014.

    Sir, i have one more doubt. Illustration B to MACP Annexure-I, indicates that 3rd macp can be granted when the person completes 10 yrs of service from the date of 2nd promotion. In my case, i was given 2nd promotion (ie Steno grade-II to Grade-I) on 18 Sep 2000 and now i completed 10 yrs, from the date of 2nd promotion, on 18 Sep 2010. With this clause in mind, clarification is requested to whether i am eligible for 3rd macp on 18 Sep 2010?

    The illustration referred to is different from the instant case as there is no occurrence of merger of scales. In the illustration the condition was that if a person has earned two promotions before completing 20 years of service then "ONLY" 3rd MACP is admissible on completion of 10 years of service in "Grade Pay" from the date of 2nd promotion. Here the assumptions are that there is NO merger of scales which is why 2nd MACP was NOT at all admissible.

    In the instant case there is a merger of scales which is why you got the benefit of 2nd MACP. Kindly note again that it is the GRADE PAY which is the crucial factor and not the Post/Grade. Even in the illustration which you referred to there is no change in the Grade Pay between 2nd promotion and 3rd MACP.

    You are wrongly interpreting the provisions of MACP, 2009. Merger or no merger, you will get the 3rd ACP on completion of 30 years from the date of your joining since you had already earned two promotions. In view of the merger of 5000 and 5500, you have been again granted benefit of 2nd ACP w.e.f. 1.9.2008 in GP 4600 under clause 5 of MACP read with Clarification 11 of 9.9.2010, because if your junior completes 20 years after 1.9.2008, he will be placed in GP 4600 and you will continue in GP 4200, therefore, the clause 5 has been inserted to compensate senior employees and to avoid anomaly due to merger. Since, you have joined in 1984, therefore, you will get 3rd MACP in 2014. But, there is no bar for promotion, if vacancy arise before 2014. No other solution.
