    Arrow regulation of pay on appt to higher post in higher pay band

    One of my friend serving as SO in central govt. (drawing basic pay 15850+4800GP)in pay band-2 i.e 9300-34800 has been selected as librarian in one of central university in pay scale 15600-39100 with GP 5400. He had applied for that post through proper channel. How is pay will be regulated in new deptt.? what will he get on joining Rs. 15850+5400 or 15600+5400. whether his pay will be protected?

    Since he applied through prpoper channel ans his pay shall stand protected. He was drawing pay of Rs. 20650 (15850+4800).
    But as per CS (RP) Rules, 2008, initial pay in case of DR in PB-3 GP5400 is 15600+5400 i.e. 21000 which is more than what he was drawing. So he will draw 15600+5400.

    His pay should be fixed under FR 22 (1) (a) by adding one increment on his last pay i.e. 15850+4800=20650x3% = 639/50 i.e Rs. 640. He should draw Rs. 16490+5400. His next date of increment will 12 months from the date of appointment on the ex-cadre post. Though, an employee is entitle for pay fixation on promotion or appointment on a post carrying higher duties and responsibilities under FR 22 but on appointment, he does not have the option to get his pay fixed from the date of increment. In the case of promotion, the employee has the option either to fix his pay from the date of promotion or from the date of increment, whichever is beneficial under FR 22 (1)(a) (i).

    Dear Sh. Munjal,
    I wish to invite your attn to OM No. 12/3/2009-Pay-I dated 30/03/2010 (http://circulars.nic.in/WriteReadData/CircularPortal/D2/D02est/12_3_2009-Pay-I.pdf) wherein guidelines for pay fixation of appointment to Central Government from PSU/AB are given. The extract of sam eis as under:


    "In case of candidates working in Public Sector Undertakings, Universities, Semi- Government Institutions or Autonomous Bodies, who are appointed as direct recruits on or after 1.1.2006 on selection through interview by a properly constituted agency including Departmental Authorities making recruitment directly, their initial pay may be fixed by granting them the Grade Pay attached to the post. Further, their pay in the Pay Band may be fixed at a stage so that the pay in the Pay Band +Grade Pay and DA as admissible in the government, protects the pay +DA already being drawn by them in their parent ofganisations. The pay in the Pay Band fixed under this formulation will not be fixed at a stage lower than Entry Pay in the Revised Pay Structure (corresponding to the Grade Pay applicable to the post) for direct recruits on or after 1.1.2006 as notified vide Section 11, Part A of First Schedule to CCS(RP) Rules, 2008. The pay in the Pay Band fixed under this formulation will not exceed Rs. 67000, the maximum of the Pay Band PB-4."

    In light of this will not his pay get protected only or he will be allowed Entry pay to that grade pay i.e. 15600+GP 5400.

    Even other wise his case is of direct recruitment and either way he gets higher start (15650+5400=21000) than what he was drawing (20650).

    Your reply seems proper. But, the GP is equivalent to next stage under FR 22, therefore, I am of the opinion that the comparison of pay drawn in previous post may not be made by adding GP in the first instance.

    This is not a promotion or deputation. This is selection by the method of Direct Recruitment; hence, the increment is not applicable at the time of initial fixation. It is a fact that his future increments will be regulated as per his date of appointment to the new post.
