    Angry Fixation of initial pay under CCS(RP)Rules 2008 -- doubts

    This is is a doubt concerning the FIXATION OF INITIAL PAY to be done for implementing the 6PC as on 1.1.06.
    (1)My basic pay as on 1.1.06 is 11650/- on account of me holding a higher post on officiating basis (of scale 12000- 375-16500) by revision of my basic of 10650/- of my substantive grade ( of pay scale 10000- 325- 15200) revision being on account of application of FR22 & further FR35.
    It is to be noted that during salary drawn under 5Pay rules, I had been drawing all my allowances i.e. HRA, DA , DP etc based on basic= 11650/-.

    (2)My DDO says that for the fixation of initial pay , 11650/- cannot be considered as 'existing basic pay' as on 1.1.06 even if it is my 'offciating pay ' reason being 11650 does not correspond to any of the stages of the prerevised scales of the substantive or the officiating grade.
    Thus even if 11650/- was earlier considered as basic pay for calculations of various allowances , But now, during implementing of 6P rules, 11650/- is not being allowed to be considered as 'existing basic pay"

    WHETHER MY DDO IS RIGHT IN DOING SO???

    I feel your DDO is correct. The initial fixation of pay in the revised structure will be based on the substantive pay of the permanent post viz. Rs. 10650 and then restricted under FR 35 vide OM dated 8.3.2010 (http://circulars.nic.in/WriteReadDat...stt(Pay-1).pdf). Accordingly, the fixation will be as follows:

    w.e.f. 1.1.2006: Rs. 19,810 + GP 6600 = Rs. 26,410 (based on pre-revised pay of Rs. 10,650)
    w.e.f. 1.1.2006: Rs. 20,810 + GP 7600 = Rs. 28,410 (restricted under FR 35 vide OM dated 8.3.2010)
    w.e.f. 1.7.2006: Rs. 21,670 + GP 7600 = Rs. 29,270
    w.e.f. 1.7.2007: Rs. 22,550 + GP 7600 = Rs. 30,150
    w.e.f. 1.7.2008: Rs. 23,460 + GP 7600 = Rs. 31,060
    w.e.f. 1.7.2009: Rs. 24,400 + GP 7600 = Rs. 32,000
    w.e.f. 1.7.2010: Rs. 25,360 + GP 7600 = Rs. 32,960
    w.e.f. 1.7.2011: Rs. 26,350 + GP 7600 = Rs. 33,950

    Victor Sir,
    some queries for the explanation given by you please:
    (1)on what grounds 11650 is not to be considered as "existing basic pay" ?
    Whether reason stated that "11650 does not correspond to any of the stages of the prerevised scales of the substantive or the officiating grade" is a valid reason ? If this is valid then how come all these years DA,HRA, DP etc was allowed to me based on " basic pay = 11650" ?

    (2)does not the above pay fixation method (clarified by you)go against the CCS(RP)rules 2008 wherein it is permitted to get the "initial pay fixation " to be done based on the "pay drawn in the officiating post " ( and by all means the pay in the officiating post =11650/-. ).As such if CCS(RP) rules 2008 is contradicting with FR35 ruling then why not rule 15 to be invoked which permits " ..CCS(RP)Rules 2008 will have a overriding effect ....in case it is inconsistent with FR rulings..."

    (3)The application of FR35 requires that at every increment date, the additional amount ( i.e. 2000/- in calculation above) above the basic in substantive grade is not to be counted when calculating the increment and further, the minimum of the higher (officiating ) scale to be taken for comparision to arrive at the additional amount above the basic of substantive post.As such what is the "minimum of the higher scale " in this case? under 6P rules both these posts ( substantive and officiating) are now in PB3 .

    PLease do look into these 3 queries.
