Thread: Pay fixation - regular promotion in continuation of adhoc promotion.

    Default Pay fixation - regular promotion in continuation of adhoc promotion.

    The following are the status of my pay fixation:

    Pay on 24-01-2010 9300-34800+4600(GP) Rs. 20800/- (basic pay)

    Got adhoc promotion on 25-01-2010 (pay fixation option not granted as per rules as adhoc.

    Pay on 25-01-2010 15600-39100+5400(GP) Rs. 22230/-
    Pay on 01-07-2010 same as above, annual increment not provided due to increment given in January.

    Got regular promotion in continuation of adhoc on 16/06/2011. As per rule, option of fixation of pay on promotion asked and I have opted for (b). Establishment has fixed the pay as under:

    Pay will be 16830+5400 = 22230/- w.e.f. 16/06/2011. (Pay will continue at Rs. 16830/- but granted grade pay of Rs. 5400/- as he opted to fix pay after grant of annual increment in lower grade.

    Rs. 17500+5400=Rs. 22900/- w.e.f 01/07/2011
    Rs. 18190+5400=Rs. 23590/- w.e.f. 01/07/2011 (pay fixed in higher grade after grant of annual and notional increment)

    Kindly clarify/ comment on following point:
    1. The above fixation is correct or not?
    2. As i have gone thro some rules, if regular promotion is in continuation of adhoc promotion then, option is available from initial date of promotion/ appointment (in my case it is 25/01/2011).
    3. Then my pay should be fixed as under:

    Pay on 24-01-2010 9300-34800+4600(GP) Rs. (16200+4600)=20800/-

    Pay on 25-01-2010 15600-39100+5400(GP) Rs. (16200+5400)=21600/- (only grade pay to be given)

    Pay on 01-07-2010 Rs. 20800 X 1.3% annual increment +difference of
    grade pay ie Rs. 5400-4600=800/
    OR TOTAL= Rs. 21430+800=Rs. 22230/-

    Pay on 1.7.2010 Rs. 22230 X 1.03 annual increment= Rs.22900/-
    (annual increment)17500+5400=Rs. 22900/-
    (pay fixed in higher grade after grant of annual and
    notional increment)
    Pay on 1.7.2011 Rs. 22900 X 1.03 (annual increment)= Rs. 23590

    kindly clarify or comment on it.

    You are right, the option will be available from the date of initial promotion. The pay fixation will be as under

    As on 24.1.2010 : Rs. 16,200 + GP 4600 = Rs. 20,800
    As on 25.1.2010 : Rs. 16,200 + GP 5400 = Rs. 21,600
    As on 01.7.2010 : Rs. 17,480 + GP 5400 = Rs. 22,880
    As on 01.7.2011 : Rs. 18,170 + GP 5400 = Rs. 23,570

    Angry change of option on refixation of pay

    Sir,
    I joined in IA&AD on 10.07.2003 as C/T in the pre-revised scale of Rs.3050-4590/- and w.e.f 22.02.2006 rendered service as DEO (ex-cadre) in the scale of Rs.4000-6000/-on deputation basis in the same office and on 25.05.2007 I was promoted to the post of Accountant in the scale of Rs.4500-7000/-(pre-revised). I was relieved from this office w.e.f 06.05.2011 to enable me to join to the post of AAO in other office on passing SAS deptmentl exam (grade pay Rs.4800)
    The fixation of my pay as done by the office under 6th CPC with option 1.1.2006 is found not in order as per 6th CPC Report, Notifications and clarifications.
    The fixation of pay as done by the office is as follow:
    01.01.2006 6060+1900 (CT pay w.r.t Rs.3200 in fitment table)
    22.02.2006 7440+2400 (DEO pay w.r.t Rs.4000 in fitment table)
    25.05.2007 8370+2800 (Acctt pay w.r.t. Rs. 4500 in fitment table)
    01.07.2008 8710+2800
    01.07.2009 9060+2800
    01.07.2010 9420+2800 (LPC)
    The fixation of pay under 6th CPC with per my fresh option (w.e.f 25.05.2007) may be done as follow:
    01.01.2006 Rs.3200/-(Rs.3050-4590/-) no change, 5th CPC
    22.02.2006 Rs. 4000/- (Rs.4000-6000/-) ex-cadre post of DEO (deputation) 5th CPC
    01.02.2007 Rs.4100/- 5th CPC
    25.05.2007 Rs.4500/-(Rs.4500-7000/-) promoted to the post of Acctt.5th CPC
    25.05.2007 Rs.8370/- + Rs.2800/- (PB-I) 6th CPC
    01.07.2008 Rs.8710/- + Rs.2800/-
    01.07.2009 Rs.9060/- + Rs.2800/-
    01.07.2010 Rs.9420/- + Rs.2800/- (LPC tallies)
    It is seen that the L.P.C already issued from the office need not to be changed as it tallies with LPC already issued earlier to me on my relieving on 06.05.2011. Only an overpayment of pay & allowances w.e.f 01.01.2006 to 24.05.2007 was paid to me..
    As per F.No.7/14/2010-E.III (A) Government of India, Ministry of Finance, Department of Expenditure the Govt. employees may be permitted to revise their initial option up to 31.12.2010 if the option is more beneficial to them.
    Sir, the office to deny to allow fresh option after 31-12-2010 and refixation done as hereunder
    01.01.2006 6060+1900 (Clerk pay w.r.t. Rs.3200/-)
    22.02.2006 7440+2400 (DEO pay w.r.t. Rs.4000/-) Ex-cadre post
    01.07.2006 6300+1900 (Presumptive pay w.r.t Clerk) Annual Increment FR26(a)
    25.05.2007 6550+2800 (Promotion to Acctt, FR-22C w.r.t. Rs.6300+1900)
    01.07.2007 6830+2800 (Annual Increment)
    01.07.2008 7120+2800 (Annual Increment)
    01.07.2009 7420+2800 (Annual Increment)- presumptive LPC-2 rate.
    06.05.2011 9300+4800 (Promotion to the post of AAO) (in PB-II, Rs.9300-39200)
    a huge loss shall be affected to my gross salaries. And in such case, the excess payment of pay & allowances shall be recovered and at the same time my pay from time to time as well as present existing pay shall also be reduced up to a large extent .
    sir, in such condition what should I do to avoid the life time recurring loss as shown above

    I want to know one information. Whether any Assistant Audit Officer (Probationer) has joined your office (whose name was there in the gradation/seniority list) after your joining the office as Assistant Audit/Accounts Officer.

    If there was any, your pay in the pay band will be stepped up to 13,350 automatically from the date of joining of that person as AAO(P).

    I think, there was no order exists revising your option now.

    Default revision of wrong option for fixation of pay

    thanks sir for reply,
    As you sought for, no any DR AAO has joined in office who is junior to me.
    one thing i want to ask sir, the office is going to rectify its own mistake which occured in fixation of my pay under 6th CPC, whether i may not be allowed to revise my option under order DOPT 25.02.2003. I had given the option for fixation of pay w.e.f 01.01.2006 and office wrongly fixed my pay at higher stages applying wrong assumption/interpretation of rules and that time i took it as more beneficial, but it now office is going to correct the fixation, whether i may be allowed to revise the option since it is an unforseen developments taken place and a huge amount of recovery is likely to be made from my pay.

    It is very hard to say whether your department (say CAG) will give you the opportunity.

    However, first wait for the outcome of the meeting of the National Anomaly Committee to be held on 17 July 2012.

    Default regular promotion in continuation of adhoc promotion

    Dear Victor Sir,

    My case is similar to the above case.My department ABC has conducted DPC on 28-11-2008 and given adhoc promotion UDC for one year w.e.f 28-11-08 vide office order dated 4/2/2009.But, later on issued corrigendum that adhoc promotion is effective from the date of joining in the post. Is this correct? I have joined in this post on 24/2/2009 and pay fixation is done by my department as given below:-

    1)Pay on 23/2/2009 in the payband 5200-20200 is Rs.7160+ 1900(GP)
    2)pay after notional increment of 3% in the above pay band is Rs.7160+280+1900
    3)Pay in promoted post fixed as on 24/2/2009 in the pay band
    of Rs.5200-20200+GP2400 is Rs.7440+2400

    4) no annual increment has given on 1/7/2009
    Will i get annual increment ?
    5)My promotion is regularised w.e.f 01/5/2010 vide order dated 18/5/10
    6) No option for pay fixation has given by department but given increment on 1/7/2010

    Sir, the above is correct or not?

    According to me the pay fixation should be done as below:-
    1)pay on 27/11/08 is 7160 +1900(GP)
    2) pay to be fixed on 28/11/08 (w.e.f DPC date) is 7160+2400 (GP)(Grade pay to be given)
    3)pay on 1/7/2009 is 7440+1900 (GP) (giving annual increment in the lower grade)
    4)pay on 1/5/2010 is same as above because my option would be fixation of pay from the next date of increment(option for fixation of pay is admissible when ad-hoc promotion is followed by the regular promotion)
    5)pay on 1/7/2010 is Rs.7440+280+1900 (giving annual increment in the lower grade)
    and pay on 1/7/2010 is Rs.7720+290+2400 (giving notional increment on account of promotion.
    6) therefore pay should be on 1/7/2011 is 8330+2400 (after giving annual increment)
    7)pay on 1/7/2012 is 8600+2400(after giving annual increment)
    8)pay on 1/7/13 is 9000+2400(after giving annual increment)

    Sir, i shall be highly obliged for promptly reply

    Question wrong fixation and revision of option for pay fixation

    hi victor sir,
    i want to know whether the department may opportunity to give fresh option for fixation of pay during correction of wrongly fixed pay specially when the new fixation of pay is very much disadvantageous and when pay is fixed w.r.t. a new option date may remove such disadvantages.

    As per DOPT OM dated 25.2.2003 (http://ccis.nic.in/WriteReadData/Cir...ry,%202003.htm) revised option for fixation of pay under FR 22(I)(a)(i) can be exercised in case of unforseen developments or change of rules.

    Your case needs to be examined in the light of the above OM.
