    Sir,
    My first appoinment was as Auditor in N.F.Rly, Assam w.e.f. 01.02.1988 to 20.01.89.On selection as Assitant by the UPSC in the Central Secretariat(M.o.Health & F/Welfare, New Delhi),I was releived from the post of Auditor in the Rly on 20.01.089 and and directed to join in the M.o.Health & F/Welfare, New Delhi. Accordingly, I joined in the Ministry on 27.01.89 and the Ministry has regulated my previous service in the N.F.Rly Audit by the terms & conditions laid down in the G.O.I.M.O.H.A's O.M. No. 60/37/63-Esst(A), dt14.07.67. The interim period of 21.01.89 to 26.01.89 was treated as unavailed Joining time and hence credited to my E/L account.Thereafter, on being selected as Inspector of Customs & Central Excise in Shillong, I resigned from the said Ministry and joined Customs & Central Excise on 25.08.89. The then Collector of Customs & C.Ex.had accepted my service rendered in the Ministry w.e.f.21.01.89 to 25.08.89 to count in this Deptt in terms of Rule 26(2) of CCS (Pension) Rules,72.As a result,I was allowed 1st ACP w.e.f. 01.02.88(initial appoinment in the Audit). Now, at the time of 2nd MACP, I was denied benefit of my past service and allowed benefit only from 21.01.89 (the date was mentioned as 1st entry into Govt. service & infact on the date I was on relieve period). Now, I wish to know Sir, whether I am eligible for the benefit of past service on MACP w.e.f. 01.02.88(initial appoinment in the Audit). The matter is case senisitive and an early reply is solicited.-Pankaj Das, Supdt. of Central Excise.

    Kindly refer to para 9 of Annexure-I of MACP Scheme (http://persmin.nic.in/WriteReadData/...8-Estt.(D).pdf) in this regard.

    Regular Service for MACPS will commence from the date of direct recruitment in an organisation. However, past continuous regular service in the same Grade Pay will also be counted under MACPS.

    Please indicate the pay scales granted from time to time.

    1. Auditor(N.F.RLY):Rs 1200-30-1560-40-2040 (w.e.f. 01.01.86)
    & Rs 4000-100-6000 (w.e.f. 01.01.96)
    2.Assistant (Central Secretariate):Rs 1640-60-2600-75-2900 (w.e.f. 01.01.86)
    & Rs 5500-175-9000 (w.e.f. 01.01.96)
    3.Inspector (Central Excise):Rs 1640-60-2600-75-2900 (w.e.f. 01.01.86)
    & Rs 5500-175-9000 (w.e.f. 01.01.96)

    You will be entitled to 2nd MACP on completion of 20 years of service or on completion of 10 years in the same grade pay whicever is earlier.

    Your regular service for the purpose of MACP will commence w.e.f. 27.1.1989 (since the scale of Assistant & Inspector are same).

    I presume that you got 1st ACP w.e.f. 1.2.2000 (However, this is not in order as the date of joining service should have been taken as 27.1.1989 for the purpose iof ACP).

    Hence you will be entitled to 2nd MACP w.e.f. 27.1.2009.
