    Respected Sir,
    The third Pay Commission was appointed in April, 1970. The Commission submited its report in the year 1973. Based on the paragrsph 15 of the Chapter 60 of the report, it was decided by the Government of India in the Department of Personnel that civilian Government servants shall retire from services or posts from the afternoon of the last day of the month in which their date of retirement falls. Orders to this effect were issued by the Department in November, 1973 and May, 1974 in respect of Groups B, C and D employees and group A officials respectively vide their orders No. 33/12/73-ESts. At that time age of retirement of superannuation was 58 years. Subsequently, Ministry of Finance modified FR 56 (a) vide 7(7)-EV(A)/74 dated the 7th February, 1975 providing that every government servant shall reiter from service on the afternoon of the last day of the month in whihc he attains the age of fifty eight years. A note bearing No. 7 was also incorporated providing that a government servant whose date of birth is the first of a month shall retire from service on the afternoon of the last day of proceding month on attaining the age of fifty eight years or sixty years as the case may be. This provision took effect from the 5th April, 1975. This note about retirement on the afternoon of the last day of the preceding month was later incorporated in the main Rule, 567(a) as a proviso. The Fr was further modified to raise the age of retirement on superannuation for all in gerneral to 60 years in May, 1998. At present the relevant FR 56(a) reads as follows:
    Except as otherwise provided in this rule, every Government servant shall retire from service on the afternoon of the last day of the month in which he attains the age of sixty year;
    Provided that a Government servant whose date of birth is the first of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of sixty years.

    Actually this is all the so called babus' gimmick at high level. 6th CPC never mentioned that the benefit cannot be passed on to pre 2006 pensioners. It said it wiil take affect prospectively. Why not we all write to the Prime Minister directly in his web site 'interact with PM' for implementation of various judgements and see what he says. Some contempt cases are still pending in Supreme Court, the hearing fixed for 3rd Feb 2016.

    Government agrees to implement the judgement of CAT
    New Government has agreed to implement the judgement of the CAT within one month for grant of full Pension to Pre 2006 Pensioners who retired after 10 years of service on superannuation or 20 years of service on Voluntary retirement or absorption in PSU. This commitment was given by the Government Advocate in CAT PB New Delhi during the hearing of the Contempt of Court Case filed by Shri Pratap Narayan & others -vs - Union of India.

    Now it is more than 10 days the PL has given commitment, but the notification is not forthcoming for implementation
