    Default Para 5 of MACPS - Government Needs more Clarifications

    Sir,

    Following are my Scales and Grade Pays allotted to me by my Department

    Date of Appointment :- 01.08.1996

    In Pay Scale of :- Rs. 2000-60-2300-EB-75-3200 (IVth Pay Commission)

    Revised to :- 6500-200-10500 (Vth Pay Commission)

    Pay Band and Grade Pay as on 01.01.2006 :- PB-2 Rs. 9300-34800, GP - Rs. 4600

    (With respect to 6500-200-10500 scale in 5th Pay Commission)

    Grant of 1st ACPS on 01.08.2008 as :- PB-2 Rs. 9300-34800, GP - Rs. 4600

    I happen to read many replies on Merger of Scales with respect to Para 5 of MACPS. I am facing similar problems as i have been granted grade pay under ACP on 1/8/2008 to Rs. 4600 (corresponding to scale 7450, previous being 6500).

    But, i find it difficult to explain the para 5 here in my state from my accountant to Under Secretary (Personnel Department). I represented with many OM/Departmental orders collected from internet...but no Hopes. They misinterpret Para 5 denying any changes to my Grade Pay.

    Sir, please explain what can i do next...They are ready to Grant Me GP 4800/- if i obtain a reply from Ministry of Finance/Public Grievances/Personnel, Government of India...How can i obtain this...

    As per clarifications issued by government on ACP(http://www.irtsa.net/pdfdocs/ACP.pdf), you are eligible for fixation benefit on grant of 1st ACP in 8/2008(clarification to item 52). Further you are eligible for GP of 4800 with effect from 1-9-2008 as first upgradation under MACP as per para 5 and illustrations thereunder. All the orders are in your favour. You may persuade your Department to seek clarification from Finance Department. As a last remedy you may approach CAT/High Court.

    Default File an RTI stating your case to the Ministry of Finance, Government of India, Delhi.

    You may please file an RTI stating in detail your case and quote the order issued for
    CSS to substantiate and claim fixation in the scale of 7450-11500

    Sir,

    I am waiting for reply from department against my representation asking for "MACPS Benefits" with Grade Pay of Rs. 4800/- w.e.f. Sept 08. But i have heard that it will be denied stating the following Para 11 from MACPS

    "11. It is clarified that no past cases would be re-opened. Further, while implementing the MACP Scheme, the differences in pay scales on account of grant of financial upgradation under the old ACP Scheme (of August 1999) and under the MACP
    Scheme within the same cadre shall not be construed as an anomaly."

    What does it mean?

    Sir, Kindly Guide how to reply to this.

    Resp. Sir,

    Thanks to all those who replied my queries. The department in consultation with Government has agreed to give MACP benefit to me by Granting me GP of Rs. 4800/- from Sept. 2008. As a result of which i will also get an Increment from Sept. 2008.

    Kindly reply whether i should also get an Increment as ACP benefit fixation in August 2008....?

    Congratulations.

    As regards pay fixation, you will be entitled to one increment and change in grade pay to GP 4800 w.e.f. 1.9.2008. The benefit of pay fixation earlier accrued to you under ACP (during 5CPC) will be automatically adjusted in the due-drawn statement for calculation of arrears. I presume that you did not get any fixation benefit in Aug 2008 in 6CPC.

    Right Sir, I did not get any fixation benefit in August 2008 in 6PC. Do i entitle for any kind of benefit when my ACP in august was release..? Because some of my colleagues were given ACP (1-1-2006 to 31-8-2008) in same merger scale with one increment.
    Thinking that it may be an error and as they may loose that benefit i dint represent...but can i officially get an Increment..?

    If there is NO change in Grade Pay on account of promotion/ACP then NO pay fixation is admissible in 6CPC. Hence, you will be entitled to pay fixation in Sept 2008 when your GP changes to 4800.
