    @RPG.

    Only for the petitioners involved in the PB CAT CP Verdict - if there are no further tricks- ..even this the DOP is not able to take a decision as it is the "lowest ranked Dept" in the GOI in such matters. It survives at the mercy of DOE and DOLA ...failing which it tries to go on beating around the bush.....

    Earlier it is closed , the better!

    HRD MINISTRY CAN TAKE OVER OR DOPT CAN DIRECTLY DEAL WITH ALL SUCH MATTERS....

    Change of Govt. does not appear to make any difference in implementing clear judgments of the highest court of the land. perhaps the pensioners are dying portions of voting population and do not matter in 2019 when elections are due.
    Can we expect justice from the new Government?

    Dear Friends,

    You are aware of the rapid progress that had taken place wrt the CGSAGPA's case of OA 655/2010 in various venues of justice in 2013 and later in early 2014 culminating in the dismissal of UOI's Curative Petition on 30 4 2014 and the directives of CAT on 15 5 2014 wrt the pending CP against the UOi for implementation of its original judgment. However the UOI/ DOPPW as advised by the Min of Law have started implementation qua petitioners viz for CGSAGPA's 661 Members only as of now. Compliance has to be reported by 7 Oct 2014 to PB CAT.

    I STARTED THIS THREAD ON 7 OCT 2008.

    SIX YEARS LATER , in early OCT 2014 , I MAY GET THE CPAO'S SSA FOR MY REVISED PENSION BASED ON MPPB FORMULA say AROUND 7 OCT 2008.

    MANY MEMBERS (of CGSAGPA) HAVE STARTED RECEIVING REVISED PPOs/ SOME HAVE EVEN RECEIVED THE ARREARS.

    Others, few more groups- individuals , as litigants, have to wait the outcome of SLPs/CAs (49 nos of cases ) coming up in HSC on 14 Oct 2014. Much depends upon the Judicial System and its affectivity in terms of truth, fair-play and justice to all. Equals should get equal treatment at all times. WE OLDIES , LEFT WITH NO ALTERNATIVES, ARE PREPARED TO ACCEPT "MINIMUM EQUALITY WRT EQUALS"!...NOT "LESS THAN MINIMUM EQUALITY" OR "SUB MINIMUM EQUALITY WRT SUB-EQUALS" WHICH IS WHAT GOVT "apparently" WANTS TO ENFORCE at least wrt S29 Pre 2006 pensioners.

    Non-litigants (lika all) who had silently accepted the GOVT"S UNILATERAL SHOWERING OF THE REVISED CORRECT MINIMUM PENSION wef 24 9 2012 adopting the OROP Route have realized the possibility of losing the arrears part if they do not go to litigation. So new cases may come up.

    ALL AGGRIEVED SEGMENTS OF OLD PENSIONERS , WHO ARE FONDLY HOPING FOR ARREARS WITHOUT GOING FOR LITIGATION-........ WILL THEY GET JUSTICE? A MILLION DOLLAR QUESTION....

    HOPE GOVT RELENTS AND ISSUES ORDERS TO DO JUSTICE TO ALL SIMILARLY AFFECTED AGGRIEVED UNFORTUNATE PRE 2006 PENSIONERS.

    At least 661 who chose the litigation path are getting justice
    Remaining can hope better sense of fair play and justice dawns on the Babus in the DOPPT and Min of Law to even belatedly change their stance.

    DEAR AGGRIEVED SEGMENTS OF THE PRE 2006 PENSIOENRS WHO HAD BEEN DENIED JUSTICE SO FAR,

    TRUTH CAN NOT BE HIDDEN FOR LONG.

    TODAY, 6TH OCTOBER 2014, IS AN EPOCH MAKING DAY FOR ME- I HAVE RECEIVED MY "HARD COPY" OF THE "REVISED PPO WEF 1 1 2006" AUTHORISING ME THE "CORRECT MINIMUM OF THE BASIC PAY IN THE PAY BAND" IN THE ERSTWHILE S29 PAY SCALE. THIS IS THE JUSTICE FOR WHICH I AND MANY OF MY FRIENDS HAVE BEEN FIGHTING FOR - ON BEHALF OF SEVERAL SILENTLY SUFFERING LOT OF OLD/ HELPLESS PENSIONERS- FAMILY PENSIONERS - AND GCONNECT.IN HAD PROVIDED ME / MY FRIENDS AN EFFECTIVE PLATFORM FOR COMMUNICATION IN THIS HSITORIC STRUGGLE IN VOLVING SVERAL LEGAL EPISODES....

    SIX YEARS ARE OVER TODAY , SINCE 7 OCT 2008- DAY WHEN THIS THREAD WAS STARTED- THIS THREAD HAS THE MASSIVE VIEWERSHIP AMONG ALL BLOGS IN WEBSITES DELAING WITH PENSIONS/ PENSONERS ALL OVER THE COUNTRY ( WORLD ALSO...?) - ALMOST AVERAGING NEARLY 100 VIEWER HITS PER DAY (LAST FEW DYAS IT IS CROSSING 150)...SO FAR 20800 VIEWS IN SIX YEARS OR 2200 DAYS- MUST BE A RECORD IN THE BLOG HISTORY- CONSISTENT VIEWERSHIP WITH CONCERN, ANXIETY, EXPECTATION,--ALL FOR TRUTH AND JUSTICE...

    I AM ONE AMONG THE 661 FRIENDS OF MINE WHO HAVE REACHED THE GOAL.....GOAL OF TRUTH....BUT THE WINNING GOAL CAN BE THE ONE - WHEN ALL AND THE ENTIRE SEGMENT OF SIMILARLY SUFFERNG PRE 2006 PENSIONERS GET THEIR "CORRECT REVISED PENSIONS" TOGETHER WITH ARREARS- WEF 1 1 2006.

    I DO HOPE THOSE IN AUTHORITY RECOGNISE THE TRUTH, RELENT AND THEN REFRESH TO RENDER JUSTICE TO ALL....THEN ONLY I CAN WRITE THE "EPILOGUE' FOR THIS THESIS OF MINE....

    Again, it is not the money that mattered at this age but avoiding feeling of humiliation vis-a-vis younger pensioners...

    Law Ministry never advised DOP & PW to implement qua petitioners. The CAT judgement dated 01.11.2011 in OA 655/10

    Problem is we tend to view many times such references in a way which may suit us .....

    WE ARE DEALING WITH BUREAUCRACY... AND IN THIS PARTICULAR MOD PARITY CASE, LAW MINISTRY HAD ALWAYS BEEN HELPFUL TO THE DOP. I AHVE A LOT OF RTI FILE NOTES TO SUBSTANTIATE. EVEN MY LAST APPEAL TO LAW MINISTRY IS ON AN EXAMPLE OF CONTRADICTION BETWEEN THE TWO .. AND SO FAR NO REPLY IS FORTHCOMING FROM THE MOLAW ON THE APPEAL.

    Coming to Shri KS's RTI put up in the BPS site, pl read the sl no 4:

Having exhausted all the possible available remedies, the Govt. is left with no other alternative but to implement the order passed by the CAT, which has been upheld by the highest Court of the land. In so far as the pending SLPs are concerned, there may not be any objection in awaiting the final outcome of the cases before taking a final decision."

    Your interpretation would have been right had the MOL stopped at the first sentence which would have implied implementation for all pensioners. But with the addition of the second sentence, (bold letters) this has been limited only to OA 655/2010 (of CGSAGPA) , while advising "there may not be any objection in awaiting the final outcome before taking a final decision" referring to other SLPs, as the SLP/RP/Curative Petition were filed only in CGSAGPA's case and dismissed.

    Closer scrutiny is required.
    Many pensioners may get wrong impression if the full meaning is not realized.

    GOVT IS NOT MADE UP OF SUCH GULLIBLE ENTITIES THAT TOO IN LAW MINISTRY-

    Have not we seen the 49 cases coming up on 14 Oct 2014 at HSC...where were half of them lying all these days ? I had lodged complaint in Hon PM's portal on such "installment" approach of SLPs / CAs....... to delay justice?.....deny justice?

    DEAR AGGRIEVED SEGMENTS OF PRE 2006 PENSIONERS ,

    MANY ARE ENQUIRING ABOUT OUTCOME OF 7 OCT 2014 PROCEEDINGS IN PB CAT.

    PERHAPS THE BENCH DID NOT ASSEMBLE THAT DAY.

    NOW IT WILL COME UP ON 17 OCT 2014.

    A COUPLE OF INTERVENTION APPLICATIONS/ MAs FILED BY/ ON BEHALF/ IN PERSON BY THE "NEW LITIGANTS" ALSO COME UP ON THAT DAY FOR ADMISSION- INTERVENTION.

    MAHABHARAT CONTINUES....
    PANDAVAS MAY BE MISSING FROM THE WAR ZONE............

    THE 49 BUNCHED SLPs AND CAs CAME UP IN COURT NO2 - LSITED AT SL NO 13 - TODAY 14 OCT 2016 AT THE HSC.

    AS USUAL, TIME WAS SOUGHT AS SR GOVT COUNSEL COULD NOT BE PRESENT "INSIDE THE COURT" !!!!!!.

    AFTER TWO WEEKS, THE BUNCH MAY COME UP SAY ON 28 OCT 2014.

    LITTLE BIT OF DIALOGUE WAS THERE AS IT APPEARS. SR COU NSELS FOR MILITARY CAs AND CIVIL SLPs WERE PRESENT AND SPOKE.

    NO OTHER WAY....BETTER LUCK NEXT TIME....GOVT KNOWS THE FATE OF THE CASES.....

    NEW MAs- GOVT HAD TO PROTEST- WERE ADVISED THEIR SUBMISSIONS IN WRITING BEFORE NEXT DATE- WH CD BE AGAIN ON 17 12 2014....

    Dear Pre 2006 Litigant/ Non-litigant Pensioners,

    JUSTICE APPEARS TO BE ELUSIVE.

    ON 28 OCT 2014, UNFORTUNATELY THE SLP C LISTED AT SL NO 1 IN COURT 2 OF HSC TOOK THE ENTIRE DAY, ARGUMENTS WERE COMPLETED AND JUDGMENT IS RESERVED, AS NOTED FROM THE CASE STATUS OF THE SAID CASE.

    In fact I was monitoring the progress till 8 25 pm late I the evening and the display board of the cort proceedings at HSC showed no movement beyond sl no1 in court no 2!!!!

    CONTRARY TO THE EXPECTATION THAT EVEN IF THERE IS ADJOURNMENT OF THE REST OF THE CASES DUE TO LACK OF TIME, the same can not be more than a week or two, had been belied!!!!

    All are disappointed to note that the NDH is now Dec 2, 2014.

    Two best days - 14 Oct & 28 Oct 2014 have been missed.......Dec means Christmas - New Yr vacations....then next year.... busy always in the initial 3 months......summer....INEVEITABLE DELAYS.....

    LET ALL HOPE FOR THE BEST DEVELOPMENTS IN THE MEANWHILE,,...
