    Default Encashment of EL during LTC and consequential deduction of EL - reg

    I availed LTC during Dec.2010. At this point of time my EL A/C is 300+10. I opted for 10days encashment at that time. I was expecting a balance of 300 at the end of Decemeber 2010 after the encashment of 10days. In Jan.2011 my office is showing me 300+5 only, instead of 300+15. I was told that the encashment can't be from the surplus leave. My question is whether this is a correct practice supported by any rule as it defies my common sense. Once if my leave a/c becomes 290+10 in Dec.2010, I felt that it should be 300 by the end of dec.2010. Please educate me.. Thanks in advance and regards,

    What was the duration and the nature of leave taken to avail the LTC in Dec 2010.

    Leave taken for LTC was Casual Leave from 27-12-2010 to 31-12-2010. When I checked my leave statement, I found that the Encashment was pre-fixed with 25, 26/12/2010 and suffixed with 01, 02/1/2011. Is this because I was on casual leave upto 31-12-2010? How the CL can be clubbed for EL? Is this something special for LTC? Thanks and regards

    Please refer OM No. 14028/7/97-Estt.(Leave) dated 7th October, 1997 (http://persmin.nic.in/WriteReadData/...arnedleave.htm)

    As per this OM "the period of leave encashed shall be deducted from the quantum of leave that can be normally encashed by him at the time of superannuation."

    Since only 300 days can be encashed and not the surplus (if any), the action of your admin is in order.

    However, the issue of pre-fixing/suffixing of 10 days leave which was encashed, does not arise.
