    Sir,

    Following are my Scales and Grade Pays allotted to me by my Department

    Pay Band and Grade Pay as on 01.01.2006 :- PB-2 Rs. 9300-34800, GP - Rs. 4600

    (With respect to 6500-200-10500 scale in 5th Pay Commission)

    Grant of 1st ACPS on 01.08.2008 as :- PB-2 Rs. 9300-34800, GP - Rs. 4600

    (With respect to 7450-225-xxxxx scale in 5th Pay Commission and the scale to which i am eligible under ACP as i dont possess a requisite qualification for scale Rs. 7500-250-xxxxx scale)

    Sir,

    i have not been given any increment or higher grade pay as MACP is effective from 01.09.2008. There no financial up-gradation in my scale with this ACP fixation.

    I can provide any additional information....

    What should i do? Is it ok what my department has done?

    Can i make any representations? if yes kindly state the circular nos.

    What about my juniors? What Grade Pay they will get?

    Kindly let me know your date of initial appointment as also the scale of pay at the time of your appointment

    Date of Appointment :- 01.08.1996

    In Pay Scale of :- Rs. 2000-60-2300-EB-75-3200 (IVth Pay Commission)

    Revised to :- 6500-200-10500 (Vth Pay Commission)

    You will get the grade pay of rs 4800 w.e.f. 1.8.2008 under acp scheme

    But my department has already fixed my 1st ACP at PB-2 Rs. 9300-34800, GP - Rs. 4600 as on 1-8-2008 stating that i cant get GP 4800 as MACP is effective from 1/9/2008.

    My ACP fixation has been done with respect to earlier ACP scheme under which i am eligible for next higher scale of Rs. 7450-225-xxxxx (GP 4600) and not promotional scale Rs. 7500-250-xxxxx (GP 4800) as i don't possess a requisite qualification for that scale.

    If i can get GP 4800/- kindly specify the necessary circular nos. pls as 2maro i am going to meet Senior Accounts Officer's here.

    It is presumed that cadre structuring has been done in your department and the two posts with the same GP of 4600 does not exist after 1-1-2006. Then you are eligible for GP of 4800 with effect from 1-8-2008 with fixation benefit.

    2day i met Asstt. Accounts Officer here, according to him since there has been no upgradation of scale after granting ACP no pay fixation is required. and hence my GP remains as 4600 even after ACP.

    SASI Sir,
    As per recommendation of 5th Pay Commission the hierarchy in my department was as under:-
    Post & Pay Scale
    Craft Instructor 5000-125-8000
    Group Instructor 6500-200-10500
    Principal - 7500-250-12000 (Gazetted)

    Sir,
    i am a direct recruit as Group Instructor on 1/8/1996. Since i dont possess the requisite technical qualification required for Principal's Post my ACP has been fixed with respect to 7450-225-11500 as on 1/8/2008.

    The Grade Pay for my Existing Scale of G.I. is Rs. 4600 as on 1/1/2006 and has been kept same after ACP as Rs. 4600 (They remained same because of Scales) and no fixation has been done as there is no change in Grade Pay.

    Sir, kindly advice me what to do? is it correct what they have done?

    Para 5 of Annexure 1 to MACP order says:

    “5. Promotions earned/upgradations granted under the ACP Scheme in the past to
    those grades which now carry the same grade pay due to merger of pay
    scales/upgradations of posts recommended by the Sixth Pay Commission shall be
    ignored for the purpose of granting upgradations under Modified ACPS”.

    Hence your upgradation under ACP in 8/2008 is to be ignored, since both scales(6500-10500 and 7450-11500) carry the same grade pay and you are eligible for the Grade Pay of Rs.4800/- with effect from the date of implementation of the MACP(1-9-2008).

    You may represent to the authorities on this ground to grant you the Grade Pay of 4800/- with effect from 1-9-2008 with fixation benefit of one increment.

    Regarding fixation benefit of one increment on 1-8-2008 to the same grade pay of 4600/- government may issue clarifications. Kendriya Vidyalaya Sangathan has issued order stating that the Ministry of Finance has clarified to grant one increment in case of promotion to the same scale.

    SASI Sir,

    Hi...!

    Today i spoke to my Accounts Officer about PARA 5. I cant convince him as he feels that MACP benefits can be given only after 01/09/2008 and he says it has no relation with ACP granted earlier.

    With respect to Grant of One Increment can u please provide me the link or copy of clarification given by Ministry of Finance...

    i cant understand what to do?

    i have decided to represent but i doubt if people here will understand...guide me pls..

    Dear Friend, I have gone thru your question and in my opinion you are not eligible for your first ACP as you don't have essential qualifications for your next promotional post.. But luckily the MACP scheme is introduced from 1/9/2008 and on that date you have become eligible for next grade pay i.e. Rs. 4800 grade pay. So you should be given 4800 grade pay from 1/9/2011- SABAPATHI- sabapathi57@gmail.com

    But kindly specify under which clause i can claim Rs. 4800/- Grade Pay. SASI Sir has told about PARA 5 of MACP, but my department in not agreeing to it verbally. I will represent my case. Is there any circular or orders as evidence for same. Kindly reply

    Sub: Non receipt of benefits of ACP & MACP Schemes—regarding

    I was appointed as Group Instructor on 1-8-1996 in the scale of 6500-10500. On completion of 12 years of service I was given first upgradation under ACP Scheme to the Scale of 7450-11500 on 1-8-2008.

    On the implementation of the Sixth Pay Revision my pay was fixed with effect from 1-1-2006 with Grade Pay of Rs.4600. On 1-8-2008, my pay was to be further fixed on account of the upgradation under ACP. But on the contention that no fixation benefit is available when promotion is to the same Grade Pay no fixation benefit was given to me and my Grade Pay remained the same.

    MACP Scheme is effective from 1-9-2008. As per the MACP Order I am eligible for the 1st upgradation to the Grade Pay of 4800 with effect from 1-9-2008 since I had been working in the same the posts which now carry the same Grade Pay for more that 10 days on the date. For ready reference, I reproduce e Para 5 of Annexure 1 to the MACP Order dated 19-5-2009. “5. Promotions earned/upgradations granted under the ACP Scheme in the past to those grades which now carry the same grade pay due to merger of pay scales/upgradations of posts recommended by the Sixth Pay Commission shall be ignored for the purpose of granting upgradations under Modified ACPS”.

    Hence I humbly request you to grant me first upgradation under MACP and fix my pay with the benefit of one increment (as per para 4 of the Annexure to the MACP Order) to the Grade Pay of 4800, with effect from 1-9-2008 and allow me the arrears of pay and allowances at the earliest.

    My problem also relates to ACP and pay fixation. Please help me with solutions.
    I joined in 1991 at 1400-2300 ( pre revised 4th CPC and 4500-7500, 5th CPC). In 1998 I got promoted at a scale of 5500-9000 . Now it is 9300-34800, GP 4200. since joining i have not got any ACP. Was i eligible for ACP before 1.1.2006 or between 1.1.2006 and 1.9.2008?. The next scale in hierarchy is 15600-39100 GP 5400. What should i represent to my office- for ACP or MACP which will give only next GP of 4600. but the scale will remain the same. Some loss isn't it? As per latest clarification on MACP, point 3 , does it apply in my case?

    Please suggest.

    As you had got one promotion, you were never eligible for ACP before 1.9.2008. However, you are eligible for MACP-II in 2008 (on completion of 10 years of service in the scale of 5500-9000/ GP 4200) to the next GP in the hierarchy of Grade Pays recommended by 6CPC, i.e. Rs. 4600.

    MACP-II will be due on or after 1/9/2008 (depending on the date of promotion in 1998) as the MACP Scheme is operational w.e..f. 1/9/2008.

    Point 3 of Clarification dated 9/9/2010 (http://persmin.gov.in/WriteReadData/...-Estt.-D-1.pdf) is not relevant in your case.

    I have joined my service on 3/02/1982 in the scale of Rs. 440-750/-in the post of Craft Instructor, I was granted TBPS in the scale of Rs.6500-10500/- I was again granted ACP in Feb.2006 in the scale of Rs.7450-11500/

    Initially I was granted grade pay of Rs.4200/-on 1/1/2006, and my gross salary after ACP i.e. on 1/7/2006 was Rs.22440/-

    Later on re-fixation of my pay was done and my grade pay was raised to Rs.4600/-w.e.f.1/1/2006.Here my gross salary after ACP i.e. on 1/7/2006 was Rs.21800/-

    This re-fixation is absurd as increase in grade pay is causing loss in gross salary.

    Therefore I kindly place before you the details of Part-B section-I (enclosed) It is clearly mentioned that the scale of Rs.6500-10500 should be merged with the post in the scale of Rs.7450-11500 and not vice versa. Therefore as on 1/1/2006 my salary should be fixed as per the scale of Rs.7450-11500/-with corresponding scale of PB-2/9300-34800+4600 and I should be granted ACP-II on 1/7/2006 with grade pay of Rs.4800/-
    Is this case correct???? Kindly comment

    The basis of downward re-fixation is not clear. Could you please give more details like basic pay drawn from time to time in the pre-revised scales.

    As far as fixation on account of merger is concerned, kindly refer to OM dated 13/10/2008 (http://finmin.nic.in/6cpc/6cpc_pay_f...ay_upgrade.pdf) which gives the methodology of fixation in the case of upgradation of scales.

    As per this OM, your pay on 1/1/2006 will be fixed w.r.t. the fixation table of 6500-10500. Further, you will be entitled to an extra increment in Feb. 2006 on account of ACP but with no change in Grade Pay.

    Alternatively, you could have opted for switchover w.e.f. Feb. 2006 in which case the fixation will be done w.r..t. the fixation table of 7450-11500. However, in this case you will not be entitled for increment due on 1/7/2006 and also no arrears for the period Jan-Feb 2006.

    On 1/9/2008 you will be eligible for MACP-II as the ACP to the scale of 7450 will be ignored. You will get the benefit of one increment and Grade pay will be revised to Rs. 4800.
