Thread: Pay fixation and 2nd ACP

    Question Pay fixation and 2nd ACP

    1. I was appointed as LDC on 31 Oct 1983.

    2. On 01 Jan 2006, I was drawing pre-revised pay f Rs.4900/- (scale 4000-6000).

    3. I was granted 2nd ACP after completing 24 years on 31 oct 2007 (Prerevised scale 5000-8000).

    4. If I opt for :-
    (a) New Pay on 01 Jan 2006 (Migration) and
    (b) 2nd ACP on 31 Oct 2007 (Pay Fixation).

    5. How will it work out? Will it be as:
    (a) wef 01Jan06 - 9120 + 2400;
    (b) wef 01Jul06 - 9470 + 2400;
    (c) wef 01Jul07 - 9830 + 2400;
    (d) wef 31Oct07- 10200 + 4200;
    (e) wef 01Jul08- 10640 + 4200;
    (f) wef 01Jul09- 11090 + 4200;
    (g) wef 01Jul10- 11550 + 4200;

    6. Please advise me whether I will get my arrears for the period from 01 Jan 2006 to 30 Oct 2007 (i.e. Rs.58,932/-) which was recovered by my office on the directions of PCDA(SC) Pune.

    If you opt for migration from 5CPC to 6CPC w.e.f. 1/1/2006 then you are entitled to arrears w.e.f. 1/1/2006. The action of your Office to recover arrears for the period 1/1/2006 to 30/10/2007 is NOT in order. You may represent.

    The pay fixation indicated by you is absolutely correct.

    Mr. Chandrakant you please give an option stating that you are opting for the CCS (RP) Rules only from 31st August, 2007 thereby forgoing all your arrears then you will be given the fixatiion benefit of Rs.6500 x 1.86 + 4200 = Rs.16290. You will be benefitted by long term. Instead of 10200+ 4200 = Rs.14400, you will get the fixation benefit of basic pay of Rs.1890 + DA + HRA = _________ x 39 months. You have to forgo the arrears upto 30th October 2007. The benefit will be huge. Please act fast.

    Mr. Chandrakant, you will be benefitted by the migration to the CCS RP Rules w.e.f. 30th October 2007.
    1) As on that date the higher scale is 6500-10500
    2) Hence, they have to give you the refixation benefit of Rs.6500 x 1.86 + Rs.4200 = Rs.16290
    3) You forgo the arrears, no problem even if you forgo the arrears.
    4) The arrears from 30th October 2007 to January 2010 is for 39 months i.e. minimum monthly benefit of Rs.3000.
    5) Your pay as on 30th October, 2007 will be Rs.16290
    6) You pay as on 01 July 2008 will be Rs.16290 + 3% = Rs.16780
    7) Your pay as on 01 July 2009 will be Rs.16780 + 3% = Rs.17290
    8) Your pay as on 01st July 2010 will be Rs.17290 + 3% = 17810
    See the difference. Represent your case with the concerned pay and accounts officer and get the pay refixed accordingly.

    Your total arrears will be from 30th October 2007 to January 2011 Minus Rs.58000

    Yes, you will get the arears. Recovery is not in order. Please refer to the DOP&T clarifications vide OM No 35034/3/2008-Estt (D) Daled 9th September, 2010. The calculation shown by Mr. ramadasg is not understood. Whether your scale (5000-8000) had been upgraded to Rs. 6500-10500 by your Department before the implementation of the VI CPC (Prior to October 2007). If yes, calculation of mr. ramadasg can be considered otherwise your pay fixation is in order and you should represent for payment of your arears.

    I believe if he has opted option to get his pay fixed as on 01.01.06, he is not entitled for pay fixation on 30.10.07 which in the scale of 5000-150-8000.

    If he wants benefit to have his pay fixed on 30.10.07 in the scale of Rs.5000-150-8000, he should exercise option (b) to have his pay fixed w.e.f. the date of ACP i.e. 30.10.07 and forego his arrears from 01.01.06 to 29.10.07.

    Please reply whether I am correct or wrong.

    There are two options involved here. One is the option for date of migration from 5CPC to 6CPC and the second is the option of pay fixation on promotion/ACP in the revised pay structure. Both are dealt with separately.

    In the instant case the option for date of migration is 1/1/2006. On grant of ACP on 31/10/2007 the option for pay fixation is date of ACP.

    Dear sir, While going through the reply, I had a doubt how he got Rs.6500-10500. Can you pease explain. I also want to know from the individual which option he has excercised and whether claeared by Audit.
