    Question Seniority, pay after promotion on Review DPC

    A colleage of mine has been promoted in 2006 as per the recommendations of review DPC. The review DPC was conducted as less vacancies were reported in previous DPC of 2002. The promotions were effected from 2002 with notional fixation. Whether arrears of pay etc is admissible to him form 2002 as there has been various pronouncements that in such a situation no work no pay is not applicable. Whether seniority and other benefits shall be admissible from 2002. Please enlighten with Govt orders in other cases, if any.

    Generally in such cases, notional fixation is given from retrospective effect and higher salary (due to fixation) from prospective effect. No arrears are payable as duty was not performed in the higher post.

    In the instant case, the incumbent had never refused to perform duties in higher grade. It was the mistake of Admn for having not promoted him in time nad thereby stopping him to perform at higher grade.

    If the mistake iss of Admn then why should he be denied his dues?
