    Default Pay fixation on promotion

    I was promoted to the rank of Personal Assistant on 31.3.2008 (pre-revised scale of Rs.5500-175-9000). I was in the scale of Rs.4000-100-6000 (pre-revised) from September 2004 till my promotion to the grade of PA on 31.3.2008. Please advise how my pay will be fixed if I opt to fix my pay on the date of my promotion i.e. 31.3.2008. As on 1.1.2006 my basic was Rs.4,100.

    Dear friend,
    If you opt for pay revision with effect from the date of promotion your pay as on 1-7-2008 will be Rs.10230+4200 whereas if you opt 1-1-2006 you will get Rs.8890+4200 on 1-7-2008. You will loose the arrears from 1-1-2006 till the date of promotion if you opt the date of promotion which will approximately Rs.70000/-. Fixation with effect from the date of promotion will be beneficial for future.

    Dear Friend,

    It is presumed that you seek to switch over to the revised pay structure from the date of promotion on 31.03.2008 by exercising revised option in terms of O.M. dated 05.07.2010.

    Date Basic pay
    01.01.2006 4100 old structure
    01.09.2006 4200 -do-
    01.09.2007 4300 -do-
    31.03.2008 10230 + 4200 new pay structure
    01.07.2009 10670 + 4200 -do-
    01.07.2010 11120 + 4200 -do-

    You will have to refund the arrears of pay already drawn for the period between 01.01.2006 and 31.03.2008.

    Sir, am I not eligible to draw arrears from 1.1.2006 till the date of my promotion i.e.31.3.2008, in my previous rank? why should I forgo the arrears, because I got promoted after clearing an examination, but not as a benefit of upgradation.

    Dear friend,

    Between 01.01.2006 and 30.03.2008 you held a post in the scale of 4000-6000 for which the pay must have been drawn in the revised pay structure after the recommendations of SCPC. The arrears of pay (being the difference of pay between the pre-revised and the revised pay for the scale of 4000-6000) paid for this period will not be admissible to you since you now intend to revise your option to switch over to the revised pay structure from 31.03.2008 instead of 01.01.2006 which you earlier opted.

    The revised pay scales are applicable w.e.f. 1.1.2006. Hence your pay as on 1.1.2006 will be revised and you'll be brought over to the revised pay structure from 1.1.2006. Further, increments due and promotions earned will be dealt with as per CCS(RP) Rules, 2008. Hence on promotion as PA as on 31.3.2008 your pay will be fixed as per Rule 13 of CCS(RP) Rules, 2008. Under this rule one increment (3%) and the Grade pay of the higher post is granted.

    However, all officials have a choice to switchover to the revised pay structure either from 1.1.2006 or w.e.f. a date later than 1.1.2006 viz. from the date of increment, promotion, upgradation, etc. So if you opt to migrate to the revised pay structure w.e.f. the date of promotion i.e. 31.3.2008 obviously you will receive salary as per pre-revised scales upto 30.3.2008 and revised salary w.e.f. 31.3.2008. So no arrears will be payable for the period 1.1.2006 to 30.3.2008.

    Now it is for your to see which option is beneficial and accordingly give your option for switchover to 6CPC.

    In view of the latest clarification issued on MACP will there by any change in the above reply. He may opt for revised pay structure wef 1.1.06. He will also be eligible for promotion in the revised pay structure wef 31.3.2008. But for pay fixation he may exercise option either from the date of promotion or from the date of next increment. He may also not loose any arrears of pay. Please offer your comments.

    If he opts 1-1-2006 for revised pay structure, and opts for promotion with effect from 31-3-2008 or 1-7-2008, his pay as on 1-7-2008 will be 8890+4200.

    Whereas if he opt 31-3-2008 or 1-7-2008 for the revised pay structure, his pay as on 1-7-2008 will be 10230(5500*1.86)+4200.

    In the former case he will not loose arrears. In the latter case he will loose arrears but the pay will be higher with effect from 1-7-2008 and will be beneficial for future.

    Dear Mr. Aneesh,

    This is not the case of upgradation under MACPS.

    The clarification of Mr. Sasi would hold good. The option to switch over to revised pay structure (in the above case) from 01.01.2006 or from 31.03.2008 will have to be exercised after weighing the benefits/ losses of both the options. If the option is from 31.03.2008 then the arrears of pay till 30.03.2008 will not be eligible.

    According to you the employee will be eligible for the grade pay as per hierarchy in the cadre when his upgradation under ACP is due before 30.08.2008. You are right. The employee can have his pay fixed in the revised pay structure from 01.01.2006 and on grant of ubgradation to higher grade pay in the hierarchy of promotion, his pay will be fixed by adding only one increment of 3% of his basic pay. In the above case such as Manohar’s if the promotion (from the scale of 4000-6000 to 5500-9000) is assumed to be upgradation under ACPS, option to revised pay structure from date of upgradation on 31.03.2008 will result in the basic pay of 10230 + 4200 with loss of arrears of pay for the period from 01.01.2006 to 30.03.2008. If the option is from 01.01.2006 there will be no loss of arrears of pay but the basic pay as on 31.03.2008 will be 8890 +4200 only.

    He should opt the revised pay structure from 31.03.2008 instead of 1.07.2008 as next date of increment will be 1.07.2009. He will not suffer any financial loss for April/2008 to june/2008. It will more benefial to opt the revised pay structure from 31.03.2008 .

    Assuming that he opted to switch over to revised pay structure w.e.f. 31-3-2008 and his normal date of increment falls on 1st July he will forgo arrear of Rs. 66096. This arrear might be recoup in 4 years. i.e 31-3-2012 in my opinion.
