    Default Clarification reg pay fixation

    Dear Senior Members,

    Here are my details..

    - I Joined heath dept as radiographer on 2/7/1980
    - There is no promotional post available in this category.
    - Got Ist financial up-gradation after 12 yrs in the scale of pay 5500-9000
    - Got 2nd financial up-gradation after 24 yrs in the scale of pay 6500-10500
    - Pre-revised basic pay is 7700 on 31/12/2005 and increment date is 1st August every year{Exercised option while up-gradation under FR 22(1) a(i),so there is a variation in DOI}
    - Revised basic was fixed on 1/1/2006 as (7700 x 1.86)+ GB 4200 = (14,330 + 4200) = 18,530.

    Clarifications

    1. Please verify if the above fixation is correct.
    2. As per the office memorandum F.No 1/1/2008-IC dated 13/11/2009 , the Grade pay of 4600 is applicable for me or not ? (our adminstration is not granting the GP 4600 since there is no existing post in that cadre)
    3. Kindly let me know what are the financial benefits that I can expect after MACP implementation ?

    The fixation of pay in the pay band at Rs. 14,330 is correct. However, your are entitled to GP 4600 in place of GP 4200.

    Kindly refer to para 4 of OM dated 13/11/2009 available at (http://finmin.nic.in/6cpc/omdated131...00gradepay.pdf). As per this para Govt. servants in the pre-revised scale of Rs. 6500-10500 are entitled to GP 4600. This para is generic and covers all cases of govt. servants who were drawing pay in the pre-revised scale of Rs. 6500-10500.

    Under MACP you are eligible for 3rd financial upgradation to GP 4800 w.e.f. 2/7/2010 (i.e. on completion of 30 years of service).

    Dear friend,

    Fixation should be 14330+4600.

    Government has issued orders allowing Grade pay of Rs.4600/- to those who were in the pre-reivised scale of 6500-10500.

    If the Scale of Radiographer is 5000-8000, then you are eligble for Second upgradation with effect from 1-9-2008 with the Grade Pay of Rs.4800/- and third upgradation with effect from 7/2010 with Grade pay of Rs.5400/-. If the Scale of Radiographer is below the Scale of 5000-8000, then only third upgradation with effect from 7/2010 with the grade pay of Rs.4800/- is eligible.

    There is a difference in opinion reg third up-gradation with effect from 7/2010 (after completion of 30 yrs of service). Please clarify whether third up-gradation of GP is 4800 or 5400.

    Since you joined in the scale of 5000-8000 your first upgradation to 5500-9000 will not be counted as these scales have been merged. So in effect you have got only one financial upgradation. Hence you will be eligible for 2nd financial upgradation under MACP to GP 4800 w.e.f. 1.9.2008 (i.e on the date MACP came into effect) and you will be eligible for 3rd fnancial upgradation under MACP to GP 5400 on completion of 30 years of service i.e. on 2/7/2010.

    As regards grant of GP 4600, the order dated 13/11/2009 is sufficient. However, you all can submit representations to the concerned authorities. In case I come across any other order which could be of help, I will share it with you.

    Promotion earned in past to the same grade pay will be ignored. Hence 4800 with effect from 1-9-2008 and 5400 from 7/2010.

    Grant of GP of Rs.4600/- is the Order of the Finance Department and are applicable to all and will be allowed to you.

    Dear friend,
    My replies to the querries are as follows:
    1. Pay Fixation on 01/01/2006 at Rs.14,330/- is correct.
    2. Since, Pre-revised Grades 5000-8000 & 5500-9000 have been merged so,
    you have got only one financial upgradation (ACP) in Grade 6500-10500.
    3. Your Grade Pay should be Rs.4600/- corresponding to Pre-revised Grade
    6500-10500 (As per Finance dept.O.M.)
    4. You are eligible for 2nd MACP w.e.f 01/09/2008 with GP- Rs.4800/-
    5. You are also eligible for 3rd MACP w.e.f 02/07/2010 after completion of 30
    yrs of service on 01/07/2010.

    Dear Friend,

    As on the date of inception of the MACP Scheme i.e. on 01.09.2008 you had completed more than 28 years of service in the entry grade of pre-revised scale of 5000-8000. 1st and 2nd upgradations under ACP Scheme to the scales of 5500-9000 and 6500-10500 were granted much before 01.01.2006 (the date from which you switched over to the revised pay structure). As on 01.01.2006 you are entitled to the grade pay of 4600 corresponding to the pre-revised 6500-10500. The O.M. of 13.11.2009 is enough for claiming the grade pay of 4600 w.e.f. 01.01.2006.

    Your administration must agree with the fact that the grade pay of 4200 initially attached to the pre-revised scale of 6500-10500 effective from 01.01.2006 was revised to 4600 with effect from the same date vide O.M. of 13.11.2009. The grade pay of 4600 will be applicable to all those who were drawing pay in the pre-revised scale of 6500-10500 irrespective of the fact whether this scale of 6500 is attached to their post or personal to them on grant of financial upgradation under ACPS. According to Rule 7(1)(A)(iii) of CCS (RP) Rules, 2008 the grade pay corresponding to the ‘existing scale’ will be payable in the case of all employees at the time of fixation of initial pay in the revised pay structure. Vide Rule 3(2) of CCS (RP) Rules, 2008 the ‘existing scale’ means the scale applicable to the post or personal scale applicable to the employee as on 01.01.2006. Your pre-revised scale of 6500 held on personal basis would, therefore, entail you to the grade pay of 4600 w.e.f. 01.01.2006.

    So far as the eligibility of upgradation under MACP Scheme is concerned, your 1st ACP upgradation from 5000-8000 to 5500-9000 will be ignored (para 5 of MACPS) since both these scales now carry the same grade pay of 4200. Having completed more than 20 years of service, you are eligible for grant of GP of 4800 under MACP Scheme as on 01.09.2008.
