    Default HRA diff on arrears

    A person drawn/received 6 CPC arrears(40% & 60% ) from 1.1.2006 to 31.8.2008 . Later he is granted ACP/Promotion wef 1.2.2007 in revised pay structure .Whether he is eligible HRA difference/arrears on Pay (revised) increase (i.e 3% benefit on acp/promoition) from 1.2.2007 to 31.8.2008.

    Dear friend,

    The effect of ACP should be given in the prerevised scale also. Difference of pay, da, hra etc with reference to the pre revised scale before and after ACP as well as arrears of Pay and DA in the revised Pay Scale is also eligible.(increase of 3% benefit is eligible)

    If promotion/ACP is given from retrospective date (i.e. 1.2.2007 in this case) then arrears of HRA, CCA, TA would also be payable as per the 5CPC scales & rates. However, arrears of Basic Pay, Dearness Pay and DA will not be admissible since it has already been taken into account in the arrears already received for the period 1.1.2006 to 31.8.2008.

    You can also revise your option for migration from 5CPC to 6CPC in the light of the ACP received, if the same is more beneficial to you.

    Sir ,
    In my opinion is that the ACP granted after implementation of RPR-2008 rules ie ACP orders issued on 31.3.2010 for the ACP wef 1.2.2007.The individual is already drawn REVISED PAY/arrears (1.1.2006 to 31.8.2008) and his ACP PAYFIXATION done in revised pay structure wef 1.2.2007 ( option Incr.date). So in DUE DRAWN stmt whether HRA difference can be claim from 1.2.2007 OR 1.9.2008 ? ( In RPR-2008 notification clearley mentioned all allowances will be eligible wef 1.9.2008 only).

    Dear friend,
    Since the ACP is with effect from 1-2-2007, it should also be taken in to account in the pre-revised scale. And hence eligible for HRA Arrears(difference of hra in the prerevised scale with ACP and without ACP).

    As per CCS(RP) Rules 2008, HRA arrears are not admissible as per revised pay under 6CPC. Here you are eligible for arrears of HRA/CCA/TA as per 5CPC rates. This has nothing to do with 6CPC. Had you got the ACP timely (i.e. before issue of CCS(RP) Rules) then you would have already got the arrears under 5CPC. It is only a question of late payment of arrears which is not your fault. However, arrears in Basic, Dearness Pay and DA has already been taken into account in the arrears received for the period 1.1.2006 to 31.8.2008 and hence not admissible.

    Whenever there is an increase in pay by way of promotion/ACP all allowance shall be increased
