    Post minimum qualifyng service for 1.706Increment

    Sir
    One of the my staff is on EOL W/O MC 5 days during the month of Feb-2006. His increment wef 1.7.2006 is stopped due to the individual has not completed Minimum qualifying service in revised pay structure wef 1.1.2006 to 30.6.2006. Wheher he is eligible 1.7.2006 increment as per lates orders
    No.16/2/2009-Esn.(Pay I) dated 02-Jul-10 .

    Dear friend,

    Clarification OM.No.F.No.1/1/2008-ICMinistry of Finance13th September, Para 2says "(i) As per Rule 10 of CCS (RP) Rules, 2008 there will be one uniform date ofannual increment, viz. 1st July of every year. Government servants completing 6 months and above in the revised pay structure as on 1st of July will be eligible to be granted the increment. Accordingly, all
    Goverrunent servants who earned their last increment between 02.01.2005 and 01.01.2006 would get their next increment on 01.07.2006". Hence he is eligible for increment on 1-7-2006

    Earlier increment date is 1.3.2005 and from 1.3.2005 he is completed 15 months service except 5 days EOL w/o MC during Feb-2006.

    In this case the incumbenet will get the increment w.e.ef 1.7.2006

    Sir,
    In my opinion that he is having minimum qualifying service 6 months from 1.3.2005 ( dt. of last incrment) or 1.7.2005 TO 30.6.2006. Hence he is eligible incrment at 1.7.2006 as per latest orders dt: 2.7.10 ( In that para-2 explained as for earning increment at 1.7.06, qualifying service to be count from previous year 1.7.2005 to 30.6.2006 ).

    Can any one elucidate.

    OFFICE MEMORANDUM

    Subject: Regulation of the Date of Next Increment in case of Extra-Ordinary leave (without medical certificate) after implementation of the CCS(RP) Rules, 2008 – clarification regarding.

    Consequent upon the implementation of CCS(RP) Rules 2008, the increments in the revised pay structure are to be regulated in terms of Rule 10 of the CCS (RP) Rules 2008.This rule states that ‘there will be a uniform date of annual increment viz. 1st of July every year. Employees completing 6 months and above in the revised pay structure as on 1st July will be eligible to be granted the increment.”

    2. The issue of regulation of date of next increment in case of EOL (without medical certificate) after implementation of CCS(RP) Rules 2008, has been examined in consultation with the Department of Expenditure.

    3. It is clarified that except as provided under the conditions laid down in this Department’s OM dated 18.2.1986, qualifying service of less than six months on account of EOL (without medical certificate) between 1st July of the previous year till 30th June of the year under consideration shall have the effect of postponing the increment to 1st July of the next year. The same stipulation will also be applicable to those cases where the increment became due on 1.7.2006. In terms of this Department’s O.M. No. 13017/20/85-Estt. (L) dated 18.2.1986, EOL granted for the following purposes automatically counts as qualifying service for pension and for increments without any further sanctions:-

    (i) EOL granted due to inability of a Government servant to join or rejoin duty on account of civil commotion.

    (ii) EOL granted to a Government servant for prosecuting higher technical and scientific studies.

    This particular OM clarifies the period of EOL without MC reckoning for increment after 6 CPC.
    Prior to this OM, a day of dies non/EOL (without MC) between 01/01/2006 to 30/06/2006 will result in postpone ment of Increment from 01/07/2006 to 01/07/2007. By virtue of this clarification OM, If the service counts for increment from 01/07/2005 to 30/06/2006 is more than 6 months ( even after reducing the dies non period of 3 days during Feb 2006 stated in the quoted case) he will be eligible for increment on 01/07/2006.

    The employee is eligible for Annual Increment due on 1.7.2006 if he has minimum 6 months qualifying service during the period 1.7.2005 to 30.6.2006. The order dated 2nd July 2010 clearly clarifies this position.
