    Question Revised option for mergerscale

    Sir, Thanks for your reply.
    For placement in 6500 scale wef 1.3.2006 which order I can quote . Sir I asked orrally they are said that the method of fixation in revised pay (6 CPC PAY) MOF to be done as per Ltr. MOF : 1/1/2008-IC dt: 13th Oct 2008 only.If not accepted my admin authorities .How can I proceed.

    My pay as on 1.3.2005 = 5850 in the scale of pay Rs. 5500-175-9000 and my pay has been fixed at 1.1.2006 = 10890 + 4200 Gp . As per CCS(RPR)2008 5000 and 5500 scales are merged with 6500 scale . Can I opt for placement of 6500 scale with efffect from which date either 1.3.2006 ie after granting of increment in 5500 scale OR 1.1.2006 and How give option for fixation of 6CPC pay and from which date .kindly clarify.     Dear Friend,

    You will continue in the old pay structure until you earn an increment in March 2006. Your scale of pay in the old pay structure from 01.01.2006 will be deemed to be 6500-10500. You will not get any arrears of pay for Jan-Feb 2006 and you will refund the arrears already received for this period. Your option to switch over to the new pay structure will be from 01.03.2006 when your pay in the pre-revised pay scale of 6500 will be increased by one increment and the pay so arrived re-fixed in the revised pay structure with grade pay of 4600.

    The revised option may be exercised in terms of O.M. No. 7/14/2010-E III(A) dated 5th July 2010.

    Sir I have one more doubt i.e after deemed the scale of pay Rs.6500-10500 , whether I can Increment at 1.3.2006 in the scale of pay 6500.     Dear Friend,

    Since you will opt to have your pay fixed in the revised pay structure from 01.03.2006 obviously invoking the provisions of FR22 (fixation of pay from the date of next increment), your increment in the revised pay structure will be due only in July 2007. You work out the pay difference in the cases of fresh option or no option. Decide yourself after weighing the advantage or otherwise.

    Mr.Tvenkatam,
    Mr.Vasu has mentioned his basic as 5850 (5500 - 9000). Since it stands merged in 6500-10500 w.e.from 1.1.2006, as on 1.3.2006, for grant of increment in the pre-revised scale, his basic will be fixed as 6500 x 1.86 + Grade pay - 4200? I was under that opinion. But I see in your posting:-

    I thought that since his pay far below 6500, he will be fixed in 6500 minimum. But, as you say, since scale itself has been revised to 6500 as on 1.1.2006 itself, he will be granted one increment in 6500 scale as 6500 + 200 x 1.86 + applicable grade pay.

    I could not understand this. Sorry for the inconvenience sir.

    Dear Friend,

    The corresponding grade pay should be 4200 and not 4600 which appeared inadvertently.

    When a person opts to continue in pre-revised pay structure as on 01.01.2006 and until the date of his promotion or upgradation or next increment, his pay will continue to be drawn in the old pay structure till the date of his promotion/increment. His pay in the revised pay structure will be fixed only from the date of promotion/increment. He will not be eligible for any arrears of pay from 01.01.2006 and till the date of option.

    When an employee opts to switch over to revised pay structure on a date later than 01.01.2006 his pay in the revised pay structure shall be fixed with reference to the fitment table corresponding to the pre-revised pay scale. The Implementation Cell of Ministry of Finance have recently clarified that in such cases and where the pre-revised scales have been upgraded by SCPC, the fitment tables corresponding to the upgraded scales will be followed for fixation of pay in the revised pay structure. This would effectively imply that the employee is deemed to be in the pre-revised upgraded scale between 01.01.2006 and the date of promotion/increment. The revised pay on the date of option is fixed after granting increment in the pre-revised upgraded pay scale.

    As per Govt. orders your band pay will fixed as per fitment tables for 5500-9000 and grade pay fixed at Rs. 4200/-. There is no order which says that you will be first fixed in 6500-10500 and then migrated to 6CPC using fitment tables for 6500.

    Hence your band pay has been rightly fixed at Rs. 10,890 and GP at Rs. 4200. If you opt for fixation from the date of increment in the old scale viz. 1.3.2006 then your band pay will be fixed at Rs. 11,210 + GP 4200. However, you won't be eligible for arrears for the period Jan-Feb 2006 and also you won't be eligible for increment due on 1.7.2006 in the revised pay structure. Kindly opt for whichever is beneficial.

    Hence, I understand that since 5850 which is far below Rs.6500 scale (which is in prerevised scale of 5000-8000 which stands merged/upgraded with 6500-10500 scale and comes into effect from 1.1.2006), the increment in the old pre-revised scale i.e., (6500 +200) x 1.86 + Grade pay Rs.4200 will be given as per the present status. I think with that intention only the order dt.5.7.2010 for revised option has been issued. However, pl. also see Mr.Victor's posting below my query sir.

    Default fixation for the merged and upgraded scale

    Dear friend

    Kindly download OM dated 30.8.2008 and CCS(R.P)Rules 2008 gazettee notification and subsequent clarifications dated 13.9.2008, 13.10.2008. Accordingly fitment tables are not applicable for the merged as well as upgraded scales. For them pay is to be fixed vide Rule 7 (1)(A) (i) and (ii). (ie. Note 2A and Note 2 B). Eventhen our own friends are still arguing that they are eligible for fitment table.
    So the merged scales are eligible for fixation in 6500-10,500. By giving Rs.4200 GP itself, they have been granted the scale 6500-10,500. Further these scales upgraded to 7450-11,500, they became elgible for GP4600 and fixation as was clarified by MOF in its RTI replies. The best example that the CSS Assistants were in the pre-5500-9000 w.e.f. 1.1.2006 and they were got fixed in 7450-11,500. (It is under dispute). Their contention that their pre-revised 5500-9000 was further revised to 6500-10,500 from 15.9.2006 which is not agreed by cpc and they denied and said by doing so disparity has aggrevated. Even otherwise also for those who were holding 6500-10,500 were granted 7500-12,00o(for eg. CSS Section Officer). In fact, these assistants are eligible for fixation in 7450-11,500 w.e.f. 1.1.2006 with GP 4600 and simultaneously for those who were simply merged with 6500-12,500 will also get fixation in 6500. Failing which we cannot say that the cpc has been implemented w.e.f. 1.1.2006.

    Further, you may kindly see the gazetee notification page No.44 (Section II) and Page 45 where in the pre-revised higher scale have been granted (Eg. sl. post, present scale, revised scale etc. etc.)to those existing scale and fixation/GP are granted based on pre-revised higher scale only.

    Arrears up to 31-8-2008:Rs.133774

    If Opts 1-3-2006:
    Revised Pay as on 1-3-2006: 11210+4200
    RevisedPay as on 31-8-2008 : 12160+4200
    Arrears up to 31-8-2008: Rs.122316

    In any case option of 1-1-2006 is more beneficial.

    Kindly refer to OM dated 13.10.2008 available at (http://finmin.nic.in/6cpc/fno112008dt131008.pdf) clarifying the methodology to be used in all cases where posts have been upgraded as a result of the recommendations of the 6CPC. Para 3 of the OM clearly indicates that "pay in the pay band will be fixed in accordance with the fitment table of the pre-revised scale... To this the Grade Pay... corresponding to the upgraded pay scale ... will be added". An illustration has also been given which makes the case crystal clear.

    Therefore, the contention of Shri Krishnan that "fitment tables are not applicable for the merged as well as upgraded scales" does not hold water. As regards the fixation of CSS Assistants in the scale of 7450 which Shri Krishnan has referred to, the same is erroneous and not in consonance with the methodology clarified vide OM dated 13.10.2008. Para 4 of the OM ibid itself clarifies that "The above procedure is to adopted in all cases where pay scales have been upgraded... including .... Assistants and Section Officers of the Central Secretariat". .

    Further, FinMin has never issued an Order to all Ministries/Departments amending the methodology reiterated in their OM dated 13.10.2008. So you can't have a different methodology of fixation of pay for CSS Assistants and a different method for the rest of the Govt. of India. I believe matters relating to fixations are fundamental in nature and have to be uniform irrespective of Post/Grade/Service. FR&SR is supposed to be common for everybody.

    What you is correct only to some extent only if he opts for fixation w.e.f 1.1.2006 (this is applicable for those whose pre-revised pay has been merged/upgraded e.g., 5000 - 6500 upgraded/merged to 6500-10500 in which case existing basic x 1.86 + grade pay applicable is given). The OM says the position as on 1.1.2006. But what about those who opt for from their date of increment/promotion, etc.

    In the instant case, for grant of increment in March, what is to be done is that since the old pre-revised is merged and non-existent, he cannot be placed in 5500 scale i.e,, 5850 +175 is not possible. Hence, he is to be placed at the min. of upgraded scale i.e., 6500 scale plus grant Rs.200 increment then multiply by 1.86 + grant grade pay 4200.

    This should be correct position for whose who opt in upgraded scale as the old scale stands merged/upgraded in old pre-revised scale.

    Any other views are welcome.

    Please refer Para 2 ofGOI Min of def Deptt of Expenditure OM No F No 1/1/2008-IC dated 13 Oct 2008 in which it is clarified that where a post has been upgraded as a result of SCPC, “the fitment table attached with the OM of even number dated 30th August, 2008 correspoding to the pre-revised scale shall be used for the purpose of determination of the pay in the pay band.”

    Para 3 of OM dated 13.10.2008 only gives an example to explain how the procedure is to be followed. One cannot generalise from the example that this is to be followed in only those cases where option for switchover is given w.e.f. 1.1.2006. If this is the conclusion then the example can also be generalised further and the procedure followed only in the case of CPMF Constables who are drawing basic pay of Rs. 3575 in the scale of 3050-4590 and whose scale is now upgraded to 3200-4900.

    Also kindly refer to para 2 and 4 of the OM dated 13.10.2008 which gives the general rule to be followed in all cases of upgradation of posts and not specifically in those cases where option is given as 1.1.2006.

    Dear sir,
    It is said the old scale 5000-8000 & 5500-9000 stands merged into 6500-10500. In case of Mr.Vasu who was drawing 5850 before 31.12.2005 having increment in March, 2006, our argument is that he will have to be given increment of Rs.200/- in 6500-10500.

    But, Mr.Victor says that our argument is not correct. He says that fixation in respect of merged scale also should be as per Fitment table only.

    Our view is that Since merger has taken place, what increment he will be given (Rs.200 or 175/- in 5500 scale). Because, as on 1.1.2006, the scale that was stands merged into 6500-10500 scale. When scales are merged, some common new pre-revised scale should have been in place which I presum that to be 6500-10500. For those who opt on 1.1.2006, only their grade pay is given Rs.4200. But for whose who opt to draw from date of next increment like Mr.Vasu on March, 2006, should it be 6500 x 1.86 + 4200 gpay. Or if increment is to be given, how can that be given in old 5500 scale as that stands merged with 6500 scale.

    Pl. clarify sir. Any other views welcome.

    As per OM DT:13.10.2008 Para 4 clearly says that in upgradation of post fixation of methodlogy of new pay structure follow as per Para 2 for all CG staff including CSS/ AHHQ/MOE Depptt.

    Further vide MOF D/o Expenditure IC U.O No:10/1/2010 dated 27.01.2010 ( clarification to Ministry of Petroleum & Natural Gas) as per para 3 clearly says that "In the case of Assistant / PAs who are promoted after 1.1.2006 and who have opted to switch over to the revised pay structure w.e.f the date of their promotion as Assistant /PA , their pay will be fixed with reference to the fitment table of the corresponding to the pre-revised scale of Rs.7450-11500. However , they shall not be entittiled toa ny arrears of pay w.e.f 1.1.2006 till the date of their option. "

    So as per my opinion wrt above clarification is that "after 1.1.2006 the existing pre-revised scale comes into force as upgraded pre-revised scale OR merged pre-revised scale for those who opt to continue in old pre-revised scale on promotion/ upgradtion/ increment date in pre-revised scale.

    Eearlier fixation of method for new pay structure on upgrdation/merged pay scale given vide Om dt: 13.10.2008 and same is to be implement in all CG staff incuding CSS/ASST/AFHQ/MOE , Later on MOF vide above UO.NO clearly mentioned that those who are opt after 1.1.2006 to continue in pre-revised scale their fixation of pay in new pay structure to be follow wrt upgraded/merged pre- revised scale.

    Hence as per above orders it is clearly understood that (1) those are opt for fixation of pay of new pay structure wef 1.1.2006 the method of fxation to be wrt fitment table of pre-revised scale and after to be added upgraded GP. and (2) THOSE who are opted fixation of pay of New pay after 1.1.2006 their fixation of pay of new pay clarified above U.O No.
