    Now in NAC it is clarified that in upgradation only higher grade pay is to be given and not the minimum of pre-revised upgraded scale. In many situation it has led to junior drawing more pay. For example ,A senior getting promotion from 5500 to 6500 scale in 2004 will be fixed at 6700*1.86 while his junior getting promotion on 1.1.06 will have the option to get fixed in minimum of 7450 sacle at 7450*.86. Similarly a senior joining in 2005 in 6500 scale will be fixed in 6500*1.86 +4600 while his junior joing in 2006 will get fixed at 17140. Strange enough but only option is stepping up and that too wil be given only if department approaches Finance ministry take approval and then issue orders. Great democratic set up !!! Of the people for the people and by the people.

    1. Question is that way back as per OM dated 9th Jan 1984 regarding FR 22 a ii it was clarified that in case of upgradation if minimum of the pay scale is not reached the pay should be fixed at minimum of the upgraded scale. How can the FR be changed unilaterally?

    2. What if a person in 6500 scale decides to remain in prerevised scale. Will it be fixed in 7450 scale as per upgradation or he will remain in 6500 scale?

    Sir, I am in the pre-revised scale of 6500. My scale is upgraded to 7450. I got promotion after 1.1.2006. My pay is fixed 6500*1.86+4600. after forgoing my arrears till to the date of my promotion. As per your quotation my pay has to be fixed at 7450*1.86+4600. Is there any orders? If you provide me any fixation orders it is very helpful to me. Thanks.

    sir,
    in my view, revised pay rules 2008 and further calrifications on them can solve your problem.

    pay as on 1.1.06 has to be multiplied by 1.86 that's it. a junior who got promotion on 1.1.06 cannot be taken to minimum of 7450 on the upgradation of the post. this fixation is wrong. fixation in pre revised scales has to be dealt strictly according to earlier pay scales and rules. so the pay of that junior has to be fixed in 6500 scale. and then multiplied with the 1.86 factor grade pay of 4600 is to be given in addition.

    Please give the complete details as to when you got your promotion. From what post to what post. How your pay has been fixed now etc. Only if there is change of pay band you will get the minimum of the pay band on promotion or higher. If there is no change in the pay band you are eligible for one increment and the grade pay of the higher post.

    I got promotion on 08.01.2008.
    From Senior Tax Assisstant to Inspector.
    Senior Tax Asst- 5000 Scale as on 01.01.2006 my Basic pay was Rs.5300/-
    Inspector - 6500 scale promotion on 08.01.2008 fixed minimum of Rs.6500/-

    VI th Pay commision forgoing the arreares upto 08.01.2008 fixed at 6500*1.86that is 12090+Grade pay of Rs.4200/- w.e.f 08.01.2008.

    After upgradation of the pay scale 7450 w.e.f 01.01.2006 my pay after forgoing the arreares upto 08.01.2008 fixed at 6500*1.86 that is 12090+Grade pay of Rs.4600/- w.e.f 08.01.2008.

    My question now is whether my pay is to fixed for 7450*1.86 that is 13860+Grade pay of Rs.4600/- w.e.f 08.01.2008 after forgoing the arreares upto the date of my promotion on 08.01.2008 as per FR23.

    Dear Friend,

    There is a clarification given to MEA by ministry of Finance (available in this forum also) according to which pay is supposed to be fixed in 7450 scale in such case, if you are ready to forego arrears till the date of promotion i.e. till 08.01.06. You can ask your department to seek clarification from Ministry of FInance.

    My point was this is the first time govt. is not giving benefit of minimum of the upgraded scale to all and the FR in this regard are changed unilaterally by Govt. The OM I mentioned is available at DoPT website its no. is 13/14/83-Estt (P-I) dated 9 th Jan 1984.

    I have found the DOPT Order and downloaded the same.

    But I could not find the clarification given to MEA by Ministry of Finance. You mentioned that it is available in this forum. Please help me to locate the clarification order.

    Upgradation - the magical word !!!
    In my view " Grade pay of Rs.4600 will be granted as a replacement of Rs.4200, Rs.4600 being the Grade pay of the 7450-....... Here your scale of Rs.6500-200 is merged ( rather upgraded) with the Rs.7450- . It does not mean 6500 to be "enhanced' first to 7450 then to give 4600. the scale of 6500-200.... is merged with 7450-.... in order to have Grade pay of Rs.4600 ( which belongs to 7450-....) Am I right sir?

    First Scale of pay of 5000, 5500, 6500 have been merged to 6500 scale.

    Now 6500 scale is upgraded to 7450.

    I was Publicity Assistant (Indian Information Servise Gr. B) in the pay scale of Rs. 5500. the next post of this grade was Rs. 6500 in the Gr. B. I was promoted in pay scale Rs. 6500 in June 2007. The 6th CPC recommended for IIS Gr B posts (Page 475, Para 4, copy enclosed):

    “These posts will come into lie in the same pay scale on account of restructuring the pay scales. Functionally, the posts are similar. It is therefore, recommended that these posts should be merged”.

    In the view of above recommendation, shoud my pay be fixed in the pre-revised scale of Rs. 6500 (which upgraded in Rs. 7450 later on) as on 1.1.2006? and in that case my promotion in june 2007 became null and void.
