    Default 3rd macp...if promoted twice...only on completion of 30 years of service - check it

    The MACP Order No. No.35034/3/2008-Estt. (D) dated 19th May, 2009 states in page No. 9 para (C) "If a Government servant has been granted either two regular promotions or 2nd financial upgradation under the ACP Scheme of August, 1999 after completion of 24 years of regular service then only 3rd financial upgradation would be admissible to him under the MACPS on completion
    of 30 years of service provided that he has not earned third promotion in the hierarchy."

    This para if read with the clarification to Quiry No. 3 in the Department of Revenue circular issued in concurence with DOPT, states that "if a person has earned two promotions within 15 years period then the 3rd MACP is due only on completion of 30 years."

    However if one goes para (B) of MACP Order No.35034/3/2008-Estt. (D) dated 19th May, 2009 page No. 9 it reads ” However, if two promotions are earned before completion of 20 years, only 3rd financial upgradation would be admissible on completion of 10 years of service in Grade Pay from the date 2nd promotion or at 30th year
    of service, whichever is earlier".


    The usage of the term “earlier” in the MACP order and usage of the word “Later” in the clarification creates a big confusion.

    Can anyone illustrate the carification given to the quiry No. 3 in the Deptt. of Revenues order??

    Dear friend,

    The MACP order of May 19, 2009 is very clear in this regard and has legal validity. Clarification of March 10, 2010 given to the query No. 3 by MOF is factually incorrect. The word ‘later’ appeared inadvertently (?) in place of the word ‘earlier’ and a second clarification may soon issue to further clarify (!) the matter.

    I do not think it is a typographic error. The clarification is very much intentional as the sentence doesn't stop at the word ...whichever is later but goes on to justify as to why "later".

    Moreoever, what is worth noting is that Department of Revenue after taking the concurrence from DOPT issued a clarrification in september 2009 and on 10th Feb, 2010 circulated it to other Commissioners also.

    This order was very much available on net for a period of over 5 months before they reiterated it again with the order dated 10th Feb, 2010. It is almost the middle of April and we dont seem to get any clarification on the clarification, so I believe it to be true.

    Anyway, I have sent a RTI to DOPT seeking information in this regard. Will share with all when I get a reply.

    "LATER" envisages two conditions:-
    1. eligible for MACP as on 01.09.2008 as per MACP criteria of completion of 10,20 & 30 years.
    OR
    2. 10 years in a grade pay or completion of 20, 30 years of regular service from direct entry grade whichever is EARLIER.
    MOF in its clarification to Revenue deptt has has mentioned that completion of 10,20 or 30 years is the outer limit
