    Default Anomaly – points for consideration at the time of rectification.

    Some of the Ministries are not fully implementing the government decision on 6th cpc/gazettee Notification and the existing OMs under the presumption that they will get further clarification from Ministry of Finance. The MOF also is not giving further clarification. According to MOF, everything is OK. But the individual Ministries require illustration from MOF for each and every OM . The ultimate sufferers are the employees working in the field offices. The 6th cpc suggested parity among the Field offices and Secretariat upto the level of Assistants. The suggestions of CSS are available in report 3.1.9 and for Field Offices are available in report 3.1.14. It was also clear from the report, the demand of higher grade for Central secretariat was denied. So parity has been made upto the level of Assistants in the field offices and Secretariat. If any decision was implemented in the Central Secrertariat Service , that is more than enough to follow the same in the field officers as the government has made parity through the gazetee notification. As per gazette notification the following grade pays were given:

    1. Granted GP 4200 to pre-4500-7000 and 5000-8000 vide item No.II (office staff working in organizations outside the secretariat) at Page No.44.

    2. As per page No.44 of Gazette Notification the pre-revised scales of 5000-8000, 5500-9000 and 6500-10,500 are merged and upgraded to 7450-11,500 to claim GP 4600. Accordingly the MOF upgraded the post and enhanced the Grade pay from 4200 to 4600 vide OM No.1/1/2008-IC dated 13.11.2009 for all these merged categories not having Engg./law as minimum qualification in view of the request of various ministries as stipulated in Gazetee Notification vide PART-B Section I item (v). The same has been implemented by many field offices.


    3. Those posts of 6500-10,500 carrying minimum qualification of engineering/ law degree have also been separately granted GP4600/- as per Gazetee Notification page No.44 in PART-B Section I item No.(iii) and (iv)
    4. Further, the separate revision for the Section Officer of Secretariat has been given in the gazetee notification, page No.44, which also reveals there is no higher grade applicable for Central secretariat Assistants alone.

    5. As far as the assistants in the Central Secretariat are concerned, the MOF issued another OM dated 16.11.2009 wherin clearly stated “with this the field offices has already been given GP4600”. Similarly the individual Ministries were supposed to issue directions to their field offices which has not been taken place in many offices. Where ever the same received from individual Ministries, those field offices have claimed also.

    Many field offices have fixed their pay and granted 4600 GP to all these scales 5000-8000 to 6500-10,500 consequent upon the above upgradation of MOF dated 13.11.2009. But some of the field offices are not fixing their pay and not granting 4600 inspite of clear directions.
    I. The following are the likely doubts of field offices.

    1. Whether the field offices in the pre-revised scales of 5000-8000, 5500-9000 and 6500-10,500 are eligible for 4600 GP as per parity introduced between CSS and field office?

    2. In Central Secretariat, pay has been re-fixed corresponding to the fitment table of the pre-revised/replaced scale of 6500-10,500 for the pre-revised 5500-9000 as on 31.12.2005. Whether this is applicable to field offices also w.e.f 1.1.2006.

    3. The pay of UDCs(4000-6000) in the Central Secretariat consequent on their promotion to Assistants (5500-9000) between 1.1.2006 to 30.6.2008 were refixed in the pre-revised scale of 7450-11,500 and thereafter multiplied with 1.86 and added grade pay of Rs.4600/-. Whether this is applicable to the field offices also?

    4. In the field offices the promotion of UDC(4000-6000) will be first to 4500-7000 or 5000-8000 and thereafter from 5000-8000 to 5500-9000 (which takes minimum 10 years and practically 15 to 20 years), whereas in Central Secretariat only 5 years from UDC to Assistant. While fixing the pay of an employee who got promotion as Assistant on 30.12.2005 in the field office and another promoted as Assistant in the Central Secretariat on 2.1.2006(after a gap of 2 days) , there is a difference of Rs.3630/ in the basic pay itself in the same category. Example: 1. The CSS UDC drawing basic of Rs.4500 got promotion as Assistant ( pre-revised 5500-9000)on 2.1.2006 and his pay was refixed as 7450x1.86+4600=18460. Whereas an Assistant in the Filed office who was drawing basic of 5500 on 30.12.2005 was given fixation as on 1.1.2006 as 5500x1.86+4600=14,830/-. So the difference of the same scale/same designation though senior most will be drawing Rs. 3630/- less in the basic pay itself. Whether this fixation is correct or wrong when parity introduced as per the rules prevailing?

    5. When such fixation as mentioned in item 4 happens, how much increment or amount of step-up is to be given to the seniors? Because this is the first time in India, the Seniors are given less salary whereas as juniors are given more. The question is for what?

    II. There are many other points, some of which are given below:

    1. Now a days, the Lower Division Clerk/L.D.Compilors etc. etc. are possessing Post Graduation and most of the work on computers (with exceptions) office files etc.are done by these people. When
    they are technically merged with group D and paid grade pay at par with a 4th standard peon/Sweeper , they are mentally worried in many offices.

    2. There are many news on the proposed sittings of National Anomaly Committee, it seems the meetings were held/supposed to hold on 16.12.2009, 16.1.2009 and 5.2.2010. Even the members attended the meeting from employees side are not aware what is the outcome of the meeting. There is no press release also after the meeting. No Departmental Anomaly Committees are constituted in many Ministries.

    3. Some of the so called paper unions have given some representations to the government wherein also the grievances of different cadres were not reflected properly in consultation with the employees.

    4. Even teaching staff/professors etc. are also treated at par with the teachers of polytechnic/Diploma holders

    5. Though the Ministry of Finance issued a time bound OM (dated 24.3.2009) for restructuring of posts within six months, it appears no other Ministry read such OM or implemented the same, except Labour Ministry for EPFO.

    In view of the skeleton points quoted, I appeal the readers who are working in the Ministries may at least come to the rescue of the fellow employees to properly initiate the files so that the
    Government will be in a position to sort out the issues within a reasonable time. Even the individual Ministries at least can send a reminder to the field offices asking whether, they have implemented the orders issued by MOF in connection with 6th cpc. I hope at least with this initiative, the file will be moved.
    Otherwise we may have to wait till 7th cpc.

    Dear Mr.Krishnan,

    You have covered all the points. You may also edit it by giving the link for the OMs you have quoted, so that all may see those OMs and cross check and give their opinion also. And also, it will be of more use, if you can also say which are the Departments which have granted GP-4600 for the merged scales of 5000, 5500 & 6500.

    Dear Mr. Krishnan,

    Neither the paras 3.1.9 and 3.1.14 of the recommendations of SCPC nor Section I of Part-B (page 44) and Section I of Part-C (page 49) of the First Schedule to the CCS (Revised Pay) Rules, 2008 contained any thing to suggest upgradation of the scales of 5000 and 5500 to the scale of 7450 corresponding to the grade pay of 4600. So far as the merger of the scales of 5000, 5500 and 6500 is concerned, the recommendation of SCPC was specific [para 2.2.21 (v)] and on its acceptance, Government notified the same by incorporating it in the CCS (RP) Rules, 2008 recommending Ministry/Department specific action [para (v) of Section I of Part-B/Part-C of the First Schedule to the CCS (RP) Rules, 2008]. In terms of these rules, the posts in these three scales are to be merged with the grade pay of 4200. If the merger of all three scales is not possible, at least the scales of 5000 and 5500 should be merged. While doing so, the posts in the scale of 6500 should be upgraded to the grade pay of 4600 corresponding to the scale of 7450. If the post with scale of pay of 7450 also exists in the same department, then the posts with the scales of 6500 and 7450 should be merged and the grade pay of 4600 assigned to the merged post. The relevant exact wordings as appearing in the CCS (RP) Rules, 2008 are reproduced below:
    “On account of merger of pre-revised pay scales of Rs.5000-8000, Rs.5500-9000 and Rs.6500-10500, some posts which presently constitute feeder and promotion grades will come to lie in an identical grade. The specific recommendations about some categories of these posts made by the Pay Commission are included in Section II of Part-B. As regards other posts, the posts in these three scales should be merged. In case it is not feasible to merge the posts in these pay scales on functional considerations, the posts in the scale of Rs.5000-8000 and Rs.5500-9000 should be merged, with the post in the scale of Rs.6500-10500 being upgraded to the next higher grade in pay band PB-2 i.e. to the grade pay of Rs.4600 corresponding to the pre-revised pay scale of Rs.7450-11500. In case a post already exists in the scale of Rs.7450-11500, the post being upgraded from the scale of Rs.6500-10500 should be merged with the post in the scale of Rs.7450-11500.”

    In terms of these rules, upgradation of the scale of 6500 to 7450 could be considered only on functional considerations or where the post with scale of 7450 already exists in the line of promotion. The Implementation Cell of Ministry of Finance, in its carefully worded order F.No.1/1/2008-IC dated 13.11.2009, gave effect to universal upgradation of the scale of 6500 to 7450. This order provided the necessary vent to pave subsequent upgradation of the scales of Assistants/PAs of CSS. This has led to unforeseen (?) advantage to the Assistants/PAs of CSS and other organized services causing further imbalance in the proposed parity between Field and Secretariat offices. In order to enforce the parity, the Implementation Cell vide its order of 16.11.2009 proposed to introduce a new grade in the hierarchy of CSS in the grade pay of 4200 which shall be termed ‘at par’ with the analogous posts out side the Secretariat. The proposal for introduction of new level of 4200 in CSS is also expected to bridge the otherwise large gap between the pay of Assistants and UDCs.

    Under these circumstances, can any one still hope for upgradation of the scales of 5000 and 5500 of Field offices to the grade pay of 4600 in the name of maintaining parity between Field and Secretariat offices?

    I am not in a position to understand your thesis, which was not in confirmity with cpc report or resolution appeared or in the OM 13.11.2009.
    If your argument is OK, kindly let me know the reason for specifically stating GP 4600 for the pre-revised 6500-10,500 having Engg/law degree vide gazetee notification page 44, Part B section I item No.iii and iv. If your argument is correct, they would have simply used one sentence that..so and so.. is only upgraded to....... Can u show anywhere such senetence in these lines. Further kindly read the cpc report 3.1.9 and 3.1.14 and Gazetee notification page No.44 and OM dated 13.11.2009. Until and unless the resolutation is withdrawn by government, the conscious decision taken by the cpc and delayering introduced by the government will continue. If at all the three scales merged and upgraded to 7450 only even 6500-10,500 will get GP 4600. Otherwise one must have minimum qualification of Egg.or Law as per gazetee notification

    The specific recommendations about some categories which are included in Section II of Par-B can be viewed at page No.44 and 45. In it, for office staff working outside the CSS, the scales of 4500 and 5000 are merged with 6500 scale with GP-4200 and 5500 is left alone. and there is no mention of GP-4600.

    A. For other than the section II Part-B, the three scales of 5000, 5500 & 6500 should be merged. That means, these 3 scales should be merged.

    BIf not feasible to merge these 3 scales of 5000, 5500 with 6500 based on functional considerationwithout any functional disturbances, the [COLOR="rgb(255, 0, 255)"]POSTS[/COLOR] of 5000 & 5500 should be merged with the [COLOR="rgb(255, 0, 255)"]POST[/COLOR] of 6500 being upgraded to the next higher grade in pay band PB-2 i.e. to the grade pay of Rs.4600 .

    Here I would like to state that if on functional consideration, these 3 scales could not be merged, the 2 posts of 5000 & 5500 should be merged with the POST of 6500 and the Post of 6500 should be merged with 7450 ( if 7450 scale exists in the hierarchy) if not, the 6500 scale should be upgraded to 7450. In both the cases GP-4600 should be given.

    Here another thing to be noted is on MERGER, the existing pay is multiplied with 1.86 for the scales of 5000 & 5500. On UPGRADATION from 6500 to 7450, the bunching benefit is given.

    Mr.Krishnan, and Mr. T.Venkatam please give your comments.

    Thanks for the query. The recommendations of SCPC and the notified revised pay rules with respect to the merger of the three pay scales 5000, 5500 and 6500 are very clear.

    Let us first consider and discuss the issue to which I had originally responded. Following is the extract of your post #1 above in this thread.

    It appears that the above inference drawn by you is based on the following sentences of para (ii), Section I, Part-B (page 44)/Part-C (page 49) of the First Schedule to the CCS (RP) Rules, 2008

    “As regards other posts, the posts in these three scales should be merged. In case it is not feasible to merge the posts in these pay scales on functional considerations, the posts in the scale of Rs.5000-8000 and Rs.5500-9000 should be merged, with the post in the scale of Rs.6500-10500 being upgraded to the next higher grade in pay band PB-2 i.e. to the grade pay of Rs.4600 corresponding to the pre-revised pay scale of Rs.7450-11500”

    The language in the above sentences needs to be correctly understood. Your assertion that all the three pre-revised scales of 5000-8000, 5500-9000 and 6500-10,500 are merged and upgraded to 7450-11,500 to claim GP 4600 is not correct. The correct interpretation of the above rule is as under:
    1. The scales of 5000, 5500 and 6500 have already been merged into a single grade pay of 4200. The consideration here is only on merger of posts and not scales.
    2. Ministries/Departments should review and consider merger of all the posts in the three scales of 5000, 5500 and 6500. (Evidently with the grade pay of 4200).
    3. Wherever the merger of all three posts is not feasible, the posts in the scales of 5000 and 5500 should, at least, be merged to the grade pay of 4200 and the post in the scale of 6500 is to be upgraded to the grade pay of 4600 corresponding to the scale of 7450.

    Following is another sentence extracted from your post #1 above:

    “Accordingly the MOF upgraded the post and enhanced the Grade pay from 4200 to 4600 vide OM No.1/1/2008-IC dated 13.11.2009 for all these merged categories not having Engg./law as minimum qualification in view of the request of various ministries as stipulated in Gazette Notification vide PART-B Section I item (v). The same has been implemented by many field offices”

    This stand taken by you is also not borne out of facts. The link to the order of Ministry of Finance dated 13.11.2009 is given below.

    The operating part of para 3 of the above order is reproduced hereunder:
    “The matter has been considered and it has now been decided that the posts which were in the pre-revised scale of Rs.6500-10500 as on 1.1.2006 and which were granted the normal replacement pay structure of grade pay of Rs.4200 in the pay band PB-2, will be granted grade pay of Rs.4600 in the pay band of PB-2 corresponding to the pre-revised scale of Rs.7450-11500 w.e.f. 1.1.2006”

    A cursory reading of the above sentence will reveal that only those posts in the scale of 6500 (earlier granted with the grade pay of 4200) are now granted the grade pay of 4600 corresponding to the scale of 7450. The order has nothing in support of your view that the grade pay was enhanced from 4200 to 4600 for all these three merged categories of posts.

    After understanding the above facts in the right direction, you may again read my clarifications at post #3 above and revert back if you still have any queries.

    The reply to your query is available in your question/clarification itself. However, I want to ask you the following points.

    1. Who were drawn GP 4200 as on 1.1.2006 (whether GP 4200 has been given to existing and also for the replaced scales/merged scales).

    2. What is the criteria for arriving GP 4200. Is it not 40% of 10,500. So it gives the clarity that all these merged scales were given GP 4200 revised scale from 1.1.2006.

    3. The OM 13.11.2009 says GP 4600 has been granted for those who were drawn 4200 GP on 1.1.2006 and those who were exising 6500-10,500.

    4. Your stand will be alright if the existing pay as on 31.12.2005 were alone considered for GP 4600.

    5. Further, this is only a mere difference of Rs.400. Instead of fighting for this 400 alone there are many other grievances related to 6500-10,500 which is to be given more importance.

    6. Whether the pre 6500-10,500 and the pre 6500-10,500(having Engg/Law) were equalized to draw GP 4600 from 1.1.2006. Can you show me any order other than 13.11.2009.

    7. Accordingly to me the pre-6500-10,500 (other than Engg/Law) are elgible for GP4600 when they are merged with other scales and upgraded to 7450-11,500 . So that was done by OM 13.11.2009.

    8. If your stand was right what was the necessity to merge these scales (5000,5500 and 6500). 6500-10,500 is part of the merged one. Once it is merged all these three scales, one particular scale from that cannot be demerged for the purpose of GP 4600 alone.

    9. If your stand was correct, there was no necessity of OM 13.11.2009 and also the para ii in page.44 of gazetee notification were not at all necessary. Simply they would have followed the para iii and iv of the same page.
    10. There are many offices drawn GP4600 for all the merged scales including Accountant General offices.

    In view of the above, I am not convinced with your argument.

    Genetlemen,

    The anxiety of the promotion stiven government employees in the grade (VPay) of 5000-8000 who would have joined at the level of LDC and have completed decades of services is natural. The 6 PC has drawn a parity between two classes of employees, under reference from the Government. The first is the employees who have tremendous knowledge of Government rules and regulations and accounting procedures but does not owe any responsibility for their say as they are in Group 'C' level and on the other hand the employees ('B' Gazetted officers) who are unlikely to have as much knowledge of rules and regulations and government procedures indealing with individual cases but are responsible and answerable and accountable for the public money. Thbe is what the 6 PC IS COMMENTING BY USING THE WORDS "ACTUAL DELIVERY". THIS IS APPLICABLE TO ALL CADRES ALSO EVEN IN WORKSHOP STAFF ETC.

    Scales of Rs.5000-8000, Rs.5500-9000 andRs.6500-10500 have been merged to bring parity between field offices; the secretariat; the technical posts; and the work shop staff. This was necessary to ensure that due importance is given to the levels concerned with actual delivery.     these anomalies. The scale of Rs.6500-200-6900 was an intermediary scale identical to the scale of Rs.6500-200-10500, albeit with a shorter span.
    Since the length of a pay scale is not very relevant in the revised scheme of running pay bands, no rationale existed for retaining the scale of Rs.6500-6900 as a distinct scale

    The 6 PC has put these category of employees at par and brought in responsibility for the 5000-8000 guys and made the 6500-10500 guys to work (not by being a mere signatory of the papers) by bringing these scales together under one g .p. of 4200. To make it specific the 6 PC has revised the scale of 4500-7000, 5000-8000 to 6500-10500. (here not I am not talking about the merger which is common in all categories).

    While on the one hand the merged scales of 5000, 5500, 6500 would be placed in the G.P. of 4200, the scales of certain categories of posts that are mentioned in the Annexures to the 6PC have been revised to 6500. While working on the gp of 4200 the minimum of 6500 (ie.,. the minimum of the scale) has been taken into account for 40% for common categories. For these common categories the 6 PC and the OM is only merging the scales and placing them in 4200 gp. But the posts that have been offered revised scales of 6500, have also to be given higher responsibilities and hence eligible to be placed in 6500-10500 although the fitment table speaks otherwise. Hence, there is a anamoly of not offering correct fitment to those posts whose pay has been revised to 6500-10500 before placing them in 6PC scales, which the Government on its 12th December meeting with the staff side attempts to justify it in its favour by illustrating the the GP formula worked on 40% of 6500, which has also been given to the merged scales of 5000, 5500, 6500.

    In nutshel, there are two categories of 500,5500,6500 clubbed to 4200 gp. One the merged scales of 5000-5500,6500 and the other the posts those carry that carry revised pay of 6500-10500. The second category, in common parlance and prudence need not have been created by the 6 PC at all as the effect of 5000-5500-6500 itself give them the desired results. The very fact that the 6 PC has specifically recommended the higher pay scales of certain categories of posts in the 5000-8000, 4500-7000, and 5500-9000, itself shows clearly that the 6 PC and the government orders wants these posts to shoulder higher responsibilities and hence the revised scale of 6500-10500 to these posts.

    As some body pointed out in this column it is not a matter of Rs.400 alone. It is something mroe than that. It is the fixation at 12090 in the PB 3 for the employees in the posts whose scales have been revised to 6500 as on 1.1.06 who would also get 4600 g.p. But those posts whos get 4200 only by virtue merger of 5000,5500, and 6500 would continue to be in 4200 even after that. From the minute of the meeting publilshed in MIN. OF PERS,. on 12/12/09 meeting, it is unclear whether the govt. would accept the genuine demand of the staff side or not.

    Meanwhile, the govt. employees whose scales have been revised to 6500 from 5000 or 5500 or from 4500-7000, should equip themselves for a long standing litigation with the government preferably under one platform, in case the govt,. fails to agree the demand. The demand is genuine, it has reasoning and logical application. Because the Government can not say that it is revised the pay and has given higher responsibillities, without actually fixing the empooyees intherevised scales of pay.

    Dear Mr. Krishnan,

    I have no bias on the subject and I am unconcerned about the outcome of these orders. My view is limited to the extent that innocent employees of the forum should not be mislead even unintentionally.

    I stand by what I have stated in my posts above. It is simply a matter of correct understanding of the language. I am not good at teaching English and, therefore, wish to withdraw from further debate on this issue..

    Before leaving, I may also mention that your views are supported by the Hindi version (page 12 & 16) of the same CCS (Revised Pay), Rules, 2008. Unfortunately, the Hindi version has no legal sanctity.
