    Respected sir,

I am grateful to you for the interest shown by you in my case.

Bebcause of the operation of FR 56 I was deprived of the benefits of the sixth Pay Commission, namely revision of pay scale, gratuity, leav encashment, revised pension

As the Department of Expenditure is not comming arroud despite strong and repeated communication from the adminstrtive Department, I have sent a detailed representation to my Administrative Department.i.e., Department of Chemicals and Petro-chemicals. I would email a copy of that detailed representation to you in a day or two. That would give complet background of the case. It would be relevant to mention here that I have an impression that as I had taken up the matter with CIC under RTI the Department of Expenditure are harrassing me by not concurring the decision/opinion of administrative Department on irrelevant grounds.
    With regards,

    Gopal Krishan

Dear Shri GK, I had seen CAT/ CIC proceeding on such a case and I have reproduced the same in the discussion biard. Perhaps it is your case only. As you are aware we the CGS29PA have won the MOd Carity case at the PR BENCH CAT Delhi on 1 11 2011. NOw the Govt is going for appeal in DHC. We are arming ourselves with more documents. If you happen to be a pre 2006 S29 pensioner, we can certainly poject this "threshhold" case as the most "affected one" and the glaring difference of how one day makes a huge loss in the pension of a pre 2006 pensioner!/ Even if you belong to some other scale, we can try to see how this example can effectively projected. Pl do notnhesitate to send us details by email at [email protected] - Ragards-VN

My date of birht being the Ist January, 1946, I retired on superannuation on the 31st December, 2005 and became as the Pre-2006 pensioner depriving benefits of the 6th Pay Commsion. This was as per the provision of FR 56 which provides that all those having the Ist as the date of birth would retire on the last day of the previous month. At the same time FR 5 A provided that if any of the FRs operated harshly against any person the same can be relaxed by the administrative Department concerned but with the concurrence of the Department of Expenditure. In my case the administrative Department did decide the relax the Fr 56 but the Department of Expenditure is creating unnecessary problems in concurring the decision/opinion of the administrative Department. What would be the way out. Any of the Associations of pensioners can help.
