    I have gone through the judgment available at http://www.judis.nic.in/supremecourt/helddis3.aspx. I presume that you are one of the appellants in the case, as the relief given by the Supreme Court is restricted to the appellants only. Accordingly, my comments on your query are as follows:

    (a) As per the judgment you will be entitled to the pay scale of 1640-2900 w.e.f. 1/1/1986. Hence your pay would need to be refixed w.e.f. 1/1/1986 and arrears paid to you accordingly.
    (b) On 1/1/1996 you will be entitled to the scale of 5500-9000 which is the normal replacement scale for 1640-2900 after 5CPC.
    (c) If you have received ACP-I on 9/8/1999 to the scale of 5500-9000, then this would need to be revised to 6500-10500, as you are already in the scale of 5500-9000. I presume that your institute has implemented the ACP scheme w.e.f. 9/8/1999.

    During the period 1/1/2006 to 31/8/2008, the old ACP Scheme of 1999 along with the clarifications issued would be applicable in the revised pay structure.

    As per the clarifications issued on the old ACP Scheme, Clarification No. 1 & 41 (http://persmin.gov.in/WriteReadData/...D)(Vol.IV).htm & http://persmin.gov.in/WriteReadData/...Vol.IV)-II.htm), which are attracted in this case, appear to be contradictory. So DOPT may have to issue a suitable clarification for admissibility of ACP in the revised pay structure consequent to merger of scales on the recommendations of the 6CPC.

    However, even if the scales are merged in the revised pay structure but the hierarchy continues with Post A & B in the same Grade Pay, then no additional benefits would be admissible. This is due to the fact that ACP Scheme is to be allowed as per the hierarchy existing after merger of scales.

    Please clarify my MACP 2008 entitlement or ACP 1999 entitlement:-

    1. Appointed as Statistical Assistant in the scale 425-700 (revised to Rs. 1400-2300 during Fourth Pay Com & to 5000-8000 during Fifth Pay Com) w.e.f. 09.01.1978
    2. Promoted to Senior Investigator in the scale of Rs.1640-2900 (revised to Rs.5500-9000 during Fifth Pay Com) w.e.f. 02.11.1987
    3. Granted second financial upgradation to the scale of 6500-10500 w.e.f. 01.01.2002 after 24 years of regular service.
    4. Promoted to Statistical Officer (Rs.6500-10500)
    5. Consequent on implementation of Sixth Pay Com, posts of Statistical Asst. & Senior Investigator (Group B Non-Gazetted) were merged w.e.f 01.01.2006 with GP of 4200 and posts of Statistical Officer (6500-10500) were granted replacement scale of 7450-11500 with GP of 4600.
    In my opinion I will get 2nd ACP w.e.f. 1.1.2006 as per clarification DOPT dt 9.9.2010 and 3rd MACP w.e.f.1.9.2008 but my Deptt has granted me 2 MACP w.e.f.1.9.2008

    The grant of grade pay Rs. 2800/- in PB-2 is not in order.

    As your case is covered under the old ACP scheme, you are entitled to the GP of the next hierarchical post in your cadre. If the next promotional post is in the GP 4600, then you are entitled to GP 4600. In case it is 4200, then you will get GP 4200.
