dear sir,I am working as a Postal Assistant in Department of Posts, India since 20.04.1999 with educational qualifications of M. Sc (Physics) and M.Phil. Due to my qualifications I have applied so many jobs both scientific and administrative jobs through my employer i.e. Superintendent of Post Offices. In this connection I have received so many interview calls, but due to the local trade union politics, I haven't relieved for the attending the examinations and interviews, more over I haven't relieved for promotion test of Inspector of Posts Examination three times also. How I can take legal action against the error officials? The rule position may be given? I need the help from the members that rule position of CCS rules and what type of legal action will be taken against the officials? Can I get any compensation for such torts committed by the Department officials? Please clarify the matter with all details .
Dear Badri Ji, Pl. clarify me the following, I availed LTC during 27Dec. to 31Dec.2010 with CL. I also availed 10days encashment of EL. At that time(2nd week of Dec.2010) my EL account was: 300+10. I was under the impression that since 10 ELs are encashed, 300ELs would be carried to Jan.2011. My office has credited me with only 300+5 on 1-1-2011 instead of 300+15. Pl clarify the following 1) During ACP 1999 one has to fulfill all promotional norms as per RR for upgradation . But if an employee does not fulfil required promotional norms on the date of eligibility, will he be granted upgradation on a later date when he becomes eligible as per promotional norms. Please clarify my MACP 2008 entitlement or ACP 1999 entitlement:- 1. Appointed as Statistical Assistant in the scale of pay of Rs. 425-700 (revised to Rs. 1400-2300 during Fourth Pay Com & to Rs. 5000-8000 during Fifth Pay Com) w.e.f. 09.01.1978 2. Promoted to the post of Senior Investigator in the scale of pay of Rs.1640-2900 (revised to Rs.5500-9000 during Fifth Pay Com) w.e.f. 02.11.1987 3. Granted second financial upgradation to the scale of 6500-10500 w.e.f. 01.01.2002 after completion of 24 years of regular service. 4. Promoted to the post of Statistical Officer (Rs.6500-10500) without any pay fixation w.e.f. 16.01.2006 5. Consequent on implementation of Sixth Pay Com, posts of Statistical Asst. & the post of Senior Investigator (Group B Non-Gazetted) were merged w.e.f 01.01.2006 with GP of 4200 and the posts of Statistical Officer (6500-10500) were granted replacement scale of 7450-11500 with GP of 4600. The scale of pay of stenographers is defined to all the subordinate offices through out the government services depending on the grade. Keeping aside few departments like yours and in A.G. CBI etc.,the shifting of the stenographers from their stenography line is impossible. Hence, when hirearchy comes into the discussion is it not fare to have the hirearchy of stenographers than from other caders like Inspectors in your department. Moreover, I wish to know shall we say that the pre revised pay of assistants and stenographers has been revised to 6500-10500 before implementing 6th pay comission recommendations. Please reply.
The 6th pay Commission had revised the pay of Stenographers 'C' and Assistants of Subordinate offices (also Jr Hindi translators) to 6500-10500 (from 5000-8000/5500-9000). This act has nothing to do with the common merger of 5000, 5500, and 6500. But the Government has denied the fixation benefits by a specific order in the scale of 6500-10500 and directly placed them in PB2 with GP 4200. The reply by the government side for denying the representation (through the minutes published in the Ministry of Pers. site) is that the benefit of fixation in 6500 to these class of employees has already been given by extending their G.P. which is based on the 40% of the highest pay of the 5th pay commission scale which should have been 40% of 8000 i.e., 3200 but the Government has given them 4200 i.e., 40% of 10500 thereby fixing them in 6500-10500. Now that the Government has revised the grade pay of those posts which carry 6500-10500 pre-revised scale to 4600 from 4200. Many of the subordinate offices are not implementing this. Can any one clarify whether the sunographers 'C', Assistants of Subordinate offices should be placed in Grade Pay of 4600 with effect from the date of the order (somehwere in Sep.09). Dear Sir, Can you please provide me a link that contains govt.guidelines as to how conveyance charges for transport of personal conveyance(Car) is to be regulated if the vehicle is transported under its own propulsion when both places are connected by rail(From Jammu to Guwahati)?For settlement I have submitted rates issued by Railway dept.which is around Rs.30000/- for transporting a car "loaded in a 8 wheeler wagon attached to one mail/express train from Jammu to Guwahati" but our Head Clerk says this is mail/express train rate but I am allowed passenger train rate(not mail/express rate).While referring the case to Rail Dept.it says that no passenger train runs for more than 500km.Since Jammu to GHY is 2370km and no passenger train runs between two,only mail/express train rate has been given.Moreover,irrespective of the category of train runs,cars can not be booked in the parcel or luggage van of the train as in the case of motorcycle and in any case cars can only be booked and loaded to separate wagon which shall be attached extra to the train.Hence there is no separate rate for mail/express and passenger train.However,railway is agreed to give simple passenger train parcel rate which is very low and seems not logically correct to enforce in my case but our Head Clerk is forcing this passenger train parcel rate on Quintal basis which comes only less than Rs4000/-.Please guide me by providing suitable link of Railway rate/circular or any other govt orders to avoid the loss.The case is pending for more than one and half year hence pl.quick.Thanking you, nayakccw(nayakccw@rediffmail.com) This has been put on general forum but no specific clarification has been received so far.
