View Full Version : Pay Protection on joining as Assistant(DR)

Respected Forum Members,

Please advise me regarding my pay protection.

I was working as SI in Delhi Police in the pay scale of Rs. 5500-175-9000 since April, 2005. I applied through proper channel and got selected for the post of Assistant(DR). I joined as Assistant(DR) on the basis of technical resignation from the post of S I in July, 2008. My past service as S I in Delhi Police has already been counted as approved service by my present deptt. My present deptt. fixed my pay to the minimum of PB-2 i.e., Rs. 13,500/-(BP 9300 + GP 4200). My previous deptt. i.e., Delhi Police, after the recommendation of 6th pay commission, sent the statement of pay fixation under CCS(RP) Rules, 2008 to my present deptt. by fixing my pay at Rs. 15,780/- on 01.07.2008.

so please advise me whether the last pay drawn in my previous deptt. i.e., Rs. 15780/- will be protected against the pay fixed by my present deptt. i.e., Rs. 13500/-.

i would say that you plz refer to the advertisement of your present organisation if the organisation accept your earlier service than i think u can get the benefit of previous experience as u have gone through proper channel , for more clarification i would advice u to consult the SWAMY HANDBOOK FOR GOVERNMENT EMPLOYEES .

since you are in service as on 31.12.2005; there is no iota of doubt that you are entitled for fixation of pay on baisc pay as on 01.01.06*1.86. since your resignation is technical and application is through proper channell, you get prtection for your pay.

pay as on 01.04.05 = 5500

pay as on 01.01.06 = 5500*1.86= 10230+4200=14430
pay as on 01.07.06=14430+430=14860
pay as on 01.07.07= 14860+460=15320
pay as on 01.07.08 = 15320+460=15780 by your previous dept is correct.

Therefore, you may appeal

Dear Hansraj
One thing is very clear that CCS(RP) Rules,208 has not superceded the existing Fundamental Rules(FRs). It is thus obvious that you will get pay protection if had applied through proper channel.

Dear Jitendraji,

In another post in this forum on Fixation of Pay, some one respondend that the protection of pay on a fresh appointment by DR will be granted only after completing the period of probation. If that rule is there, the pay of this officer will have to be re-fixed with pay protection after his confirmation and till that date, he will continue to draw the pay at minimum of scale. On refixation, he will be eligible for the arrears also. Please confirm.

Dear friend
As I know, after direct recruitment in a post, minimum of scale is given till completion of probation to that post. After that refixation is done from date of appointment. Arrear is admissible.
