Sir

During the pre-audit before the release of 2nd installment of Arrears, following interesting observation is made by the PAO officer/officials which may please be commented upon including the correctness or otherwise please:

Whenever the promotion or MACPS/ACP effective after 1.1.2006, to the post having same GRADE PAY, no increment is to be given except what is universally paid to all in July. in effect pay will not be raised by one increment as in case of promotions with change in grade pay. That means no financial benefit after the promotion/MACP/ACP after 1.1.2006 to the post having same grade pay.

Dear Sir,

You may request your PAO to go through Page 159 Point No. 5 and 6 of Swamy's Manual DDO's and Heads of Offices - 2009, Fixation of Pay and then take a suitable decision. I personally feel that they will get one increment on promotion/acp 3 % as notional increment

I am in the opinion that your audit point is ok as per existing rule position but it required attention of Govt and got clarify and one time relaxation for the employees got ACP between 1.1.06 to 31.8.2009( upto implementation of old ACP scheme). There is no discripency after implementation of new MACP.

Reply to my query remains unresolved; the point which needs to be answered is weather fixation benefit of one increment is allowed in case of promotion/ACP/etc to the post carrying same grade pay or not?

answer is clear that you will not get increment of 3% when get promotion /ACP ion the same grade pay during 1.1.2006 to 31.08.2009 as per existing provision of CCS(RP) Rules. This position is unjustified and required further course of action from Govt . Whereas there is no discrpensy after 1.09.2009.

In my office the pay fixation of staff who got acp after1.1.2006 and before 1.9.2008 has been fixed as follows:

1. LDC drawing a basic pay of Rs.3875 got ACP in Feb. 2008 to the scale of 4000. His pay was fixed at Rs.4000/- in the pre revised scale and given GP of Rs.2400 and the corresponding band pay from the date of acp with DATE OF NEXT INCREMENT FROM 1.7.2009. Accordingly he will get 6 cpc benefits from the date of acp. He has to surrender arrears drawn till date of acp. Whether it is correct.

2. Steno Gr.II in the prerevised scale of 5000 got acp in aug. 2008 to the scale of Rs.5500/- after completion of 24 years of service. There is no fixation of pay in her case or grant of 3 % increment. What is the benefit of ACP to her? Whether she will be eligible for GP 4600 under MACP wef 1.9.2008. Her junior will be completing 20 years of in Dec. 2009. Functional promotion under the pre revised scale was from 5000 to 5500 as per recruitment rules. Whether the junior will be eligible for GP 4600 under MACP.

Please clarify on the above

My dear friends,
While I require some more time to answer the original query raised by learned friend, SSjee (SSudharshanajee), I restrict this post/review only on the averment that there is no dicrepency after implementation of new MACP. This assertive statement may require some reexamination for the following reason;-

In certain department, for those persons with grade pay of 4800, after their regular service of 4 years in such post their GP would be raised to 5400 on non functional basis. In such a case, if the officer completes 20 years/30 years of service, as the case may be, what would be the effect of MACP.....? Will he be given an increment in the Basic pay (on the sum of existing Basic pay and grade pay) or will he not be given?

Dear friends
Very first, I will reply to query raised by Shri Sudaji. The only thing I would like to clear that CCS(RP) Rules, 2008 has not superceeded the existing FR. It simply means, if the promotional post caries higher responsibilities, notional increment will be given in promtion whether it is in same pay scale or in same grade pay under FR 22(I)(a)(i). It can not be denied. Any one suffering due to his promotion in the same grade pay may claim for notional increment under this rule. Now, as regards query of Shri Badriji, it is clear that this point has not been clarified by the DoP&T yet. This has to be clarified on later date. But one thing is clear here that who so ever will get NFS in 5400 GP, his further pay fixation will not be made but only difference of Grade Pay will be given. But if he wll be granted GP 5400 under MACPS, he will get notional increment on pay fixation. Now I assumed that officers who became eligible for ACP after completing 10/20/30 years of service in GP of 4800/-(though already in receipt of 5400 GP after 4 years of service), their upgradation will be done only after completing 10 years service in 5400 GP and not from the date of completing 10 years service from GP 4800. This one is my assumption and I strongly feel that this needs to be clarified by the DoP&T at later stage.

Dear Learned Members,
Please clarify the following with regard to the fixation of pay of a TGT Grade II (old scale 6500) in KVS ;

1 Post Held TGT Grade II (Senior Scale) 6500
2 Got Selection Scale (Rs.7500) II ACP in August 2005 but opted for fixation on DNA (I,e, July 2006)
3 Basic Pay on 1.1.2006 Rs. 8100/- (in the scale of 6500)
4 Option given now after VI CPC ; date of awarding Selection Scale Now the Selection scale of TGT (Grade I) is in PB-3 (15600-3900).
5 What should be the fixation of the teacher on 1/1/2006 and whether the teacher will get any benefit of bunching?

Please throw some light in the matter referred.

In our Department, based on some Court Orders, the NFS was applied to the grade of SO/PS (GP4800) at par with CSS with effect from 1998 with financial effect from Oct 2003, as in the CSS. Some officers, who were granted their ACP in 2000 is now facing a peculiar situation of losing their benefits. A direct recruit PA of 1976 (5500-9000, revised GP 4200) was promoted as PS (6500-10300, revised GP 4800)in 1994 (1st promotion). In 2000 he was granted ACP to post of PPS (10000-15300, present GP 6600/-). However, consequent to the implementation of the NFS to this cadre recently, in Jul 2008, he was granted NFS Scale for SO/PS (8000- ,present Grade Pay 5400/-) from 1998 with financial effect from Oct 2003. While fixing his pay, the CDA has denied him the benefits of 2nd ACP in PPS (Grade pay 6600/-) wef 2000 stating that the officer was granted an upgradation in 1998 (with fin benefits in 2003) and therefore, he is not eligible for 2nd ACP. As a result of this, he will get the Basic Pay of Rs.10,000/- in 2006 only, which he otherwise was drawing from 2000. Can somebody help this man, who is due to retire in the next year.

This peculiar situation ought to come in absence of clear guidelines on pay fixation in case of grant of NFS. He is really unfortunate to be a victim of this situation. This case realy needs to refer to DoP&T for clarification. He may ask his office to get it clarified from them at an early date failing which he has an option to go CAT for its redressal but he must try first with his department itself.

Sir,

Before implementation of 6CPC Section Officers/Private Secretary/equivalent grade were placed in 6500-10500 scale .After implementation of 6cpc they are placed in 7500-12500(PRE REVISED),Pay Band PB-2 with grade Pay of Rs 4800. and after completeion of 4 years of service they are placed in PB-3 Band with Grade pay of Rs 5400. As a result after granting of MACP they are placed in Grade pay of Rs 6600/-

Whereas Supdt/Appraiser/ITO were placed in 7500-12000 scale before implementation of 6cpc.After implementation of 6cpc they remained in 7500-12500(PRE REVISED)and placed in grade pay PB-2 with grade pay of Rs.4800. and after completeion of 4 years of service they remained in PB-2 Band (not in PB-3 Band) with grade pay of Rs.5400.As a result even after grant of MACP they will remain in Grade Pay Rs.5400.Thus, virtually there will not be benefit of even one increment to Supdt/Appraiser/ITO after grant of MACP.

Whether Association of Supdt of Customs/Appraiser/ Supdt of Excise/ITO has taken up this issue with the Ministry.

Please provide information.

Respected Members,
First I would like to reply to query of Mr.SS. If the ACP has been granted prior to implementation of 6th CPC from 5000 to 5500 and as per the CCS(RP) Rules 2008 it results in same grade pay no benefit of increment shall be given, Rule 13 of CCS(RP) Rules 2008 refers. Your audit opinion is correct. In order to derive the benefit of increment the recruitment rules of the promotional posts have to be revised and different grade pay should be granted because benefit of increment is given only on promotion from one grade pay to another and not from one post to another.
Second regarding first query of mr aneesh. The LDC can get his pay fixed wef from 01-01-2006 and on date of acp opt under FR 22(1) (a) (i) for refixation of his pay wef from 01-7-2008. He will get the benefit of revised option under FR 22 on implementation of 6th CPC even though his pay has been fixed in the minimum of pay in pre revised pay scale. Please refer to MOF OM F.No.1/1/2008-IC dated:29-01-2009 clarification No.1.
second query of mr. aneesh. the steno gr. ii granted acp will not get benefit of increment in august 2008 as the grade pay in respect of the 5000, 5500 have been merged till time the recruitment rules are revised and revised grade pay is granted to the promotional posts. However the steno gr. ii shall get second MACP to GP-4600 with effect from 01-9-2008 for completing 20 years of service and 3rd MACP to GP-4800 on completion of 30 years of service from date of joining in steno gr. iii. refer para 5 of annexure i of macp orders
