Dear members,
Please clarify the following ;
In a Deptt. IT has not been deducted from the salary till the salary of August/09 and the 60% arrear of VI cpc is to be paid with the salary of Sept/09. For calculation of IT during 2008-09 on the total salary (Payment of salary upto August + 60% arrear + salary due from September/09 to Feb/10) is taken into account and IT is calculated thereon. For example the total tax comes to to Rs. 30,000/- Can the deptt. straightway deduct the whole amount of Rs.30,000/- from the arrear of 60% in one instalment or it (Rs.30,000) should be deducted in 6 months salary(September to February months salary). Can the deptt. deduct the whole amount straightway from the arrear ? is there any clear rule in this regard, if it is there please give the link.
Learned members are requested to throw some light on the issue.
Regards,

Dear friend
Deptts are normally calculated tax on anticipated annual income of an individual after taking his savings in to account. Tax is generally deducted from salary every months in installments. There is no order as to how the amount of tax should be deducted but normally the above procedure is followed by all deptts. This is however surprising that your office has not deducted any tax till August though Arrear was also anticipated during this financial year. I still think that they will deduct the entire amount of tax in installment till you ask them otherwise. It is my view based on procedure followed at my office. Some other learned member well versed in I.Tax laws may have different view.
