I am posted as Stenographer Gr. III (Rs.4000-100-6000/-) in the field office since 25-06-1996 and got 1st ACP Scheme (of August, 1999) after completion of 12 years continuous service on 25-06-2008 in my promotional grade (Rs.5000-150-8000/-) where grade pay of Rs. 4200/- before introduction of MACPS.

In the verification of my Pay fixation, PAO has not agreed with the granted my promotional grade pay i.e. Rs. 4200/-. PAO has stated that my GP will be fixed in next higher grade pay i.e. Rs. 2800/-.

I was represented to PAO that I have been granted ACP (between 01-01-2006 to 31-08-2008) from 25-06-2008, as per Ministry of Personnel, Public Grievances and Pensions (Department of Personnel Training) Office Memorandum No. 35034/3/2008-Estt. (D) dated 19-05-2009 in respect of Modified Assure Career Progression Scheme (MACPS) under Para 6.1. of Annexure (In the case of all the employees granted financial upgradations under ACPS till 01.01.20O6, their revised pay will be fixed with reference to the pay scale granted to them under the ACPS, the Government servant has the option under the CCS (RP) Rules, 2008 to have his pay fixed in the revised pay structure either (a) w.e.f. 01.01.2006 with reference to his pre-revised scale as on 01.01.2006; or (b) w.e.f. the date of his financial upgradation under ACP with reference to the pre-revised scale granted under ACP. In case of option (b), he shall be entitled to draw his arrears of pay only from the date of his option i.e, the date of financial upgradation under ACP.)

If I shall exercise my option (a), am I entitled to draw Grade Pay Rs. 4200/- w.e.f. 25-06-2008 or
If I shall exercise my option (b), am I entitled to draw my arrears of pay w.e.f. 01-01-2006 in revised pay structure with Grade Pay Rs. 4200/- from 25-06-2008.

Which option is benefited in respect of my case.

Dear Abhijeet JI,

You are right you are eligible for grant of Gr.Pay of 4200/- in old ACP scheme as you are completing 12 years before 31/8/2008. PAO has wrongly objected it. As far as fixation is concerned you should get your pay fixed in 4000-6000 from 1.1.2006 and after grant of ACP from 12 years your pay will be fixed accordingly. on 25/6/08 you should opt for fixation from 1,july,08 and you will get only difference of gr.pay i.e. 4200-2400=1800/- on 25/6/08 and in july,2008 and you will get 2 increment one normal and one for promotion/acp and your pay will be fixed as under:

Pay as on 30/6/08( in gr.pay 2400) * 1.03 again *1.03 + difference of gr.pay i.e. 1800/-

Dear Pradeep and Abhijeet

Your reply is definitely beneficial to Abhijeet. But how far his PAO will accept this is not known. There is confusion on this issue. For example take another case similar to abhijeet except that the date of is ACP after 1.9.2008. He will be covered under MACP and will get GP of Rs.2800 only on grant of first financial upgradation.

Rule 6.1 under MACPS has been defined by Mr. Abhijeet . Accordingly some PAO's are of the opinion that people like Abhijeet can get their pay fixation in the revised pay structure (a) wef 1.1.2006 in the pre revised scale or (b) from the date of ACP. In case (b) is opted they have to surrender the arrears drawn from 1.1.2006 to till the date of ACP. He will have the benefit of higher grade pay of Rs.4200/- which will benefit in the long run. It is presumed that in case if he opts for option (a) he will be eligible for MACPS to Grade Pay of Rs.2800/- and need not surrender any arrears drawn by him (40%). Some senior members have to clarify on these issues or DOPT may issue clarificatory orders.
