Pension is payable equal to either 50% of 10 months average emoluments or 50% of last pay drawn which is beneficial to the employees. My question is if an employee retires voluntarily on 15.7.2009 and whose pay is 12800 with grade pay of Rs.4200, whether the last pay drawn is Rs.12800/- plus applicable grade pay or 12800*15/31 i.e the pay which he would have actually drawn for 15 days. In other words whether last pay drawn means the pay he is entitled to draw or the actual pay drawn. Please clarify

As on 15.7.2009, the pay was Rs.12800+4200=17000. 50% of the same is 8500. The last pay drawn means the pay he is entitled to draw.

Last Pay Drawn for the purpose of pension means Emoluments as defined in Rule 33 of CCS[Pension] Rules 1972, which means basic pay as defined in Rule 9(21)(a)(i) of Fundamental Rules which a Government servant was receiving immediately before his retirement or on the date of his death. However, after introduction of 6th CPC basic pay means Pay in the Pay Band plus Grade Pay. The Note (1) to (10) under Rule 33 should also be taken into account while arriving the Last Pay Drawn.
