I am working in an Autonomous university under MHRD. I have recruited in April, 1992 as Technical Assistant in the scale of 1640-2900 (Latter on revised 5500-9000) through an open advertisement, unfortunately there is no promotional scheme in my organization so I stagnated at the same post and scale since 1992 to till date, when I completed 12 years of service in the year of 2004, I expected one up- gradation under ACP scheme. But my employer denied the benefit of even ACP on the ground that the scale of Technical Assistant was 4500-8000 and wrongly it was advertised to 1640-2900 (for few years Technical Assistants were appointed over 1640 scale latter on 1994 onwards this University appoints TAs over 1400 scale), on this basis my employer consider me already got one up- gradation at the time of joining itself and only after 24 years I will be eligible for getting next.
With all this ill fate I was fixed at the grade pay of 4200 on 01.01.2006. Now I am seeking expert opinion whether my employer is doing justice with me? And at what forum I can raise my grievance for redressal? And in the last, with new MACP scheme am I eligible to get any benefit on date, since I am stagnated since my joining i.e over 17 years on the same scale??

Dear friend

It is surprising that the authroties wrongly advertised the post in the higher scale and continued the same. You may clarify this issue by seeking the recruitment rules of the post prevailing at the time of your appointment. If the pay scale notified is Rs.1640 revised to 5500 you can definitely claim I ACP to the next higher grade or next pay scale of Rs.6500 on completion of 12 years. Under MACP you are eligible for grant of GP of Rs.4600 on completion of 20 years of service

Thanks for so quick reply,but in my case as per my employer view suppose i recieved one upgradation at the time of joining itself i.e in April 1992 from 4500 to 5500, in that case also i will be eligible for the II upgradation after 10 years from April 1992 as per new MACP.It means as soon as new MACP implements i will be immediately entitled to get II upgradaion i.e 4600 GP,am i right?

Dear friend,
When you were appointed to the post, the pay scale was 1640-2900/- and this can not be changed at later stage to the disadvantage of you. It is not allowed under rules. Since you were also given corresponding pay scale of Rs.1640-2900 after 5th pay commission, you will definitely get ACP on completion of 10 years of service or from 1/9/08. They can not deny the benefit despite that later on they appointed employees one stage below what you get earlier. It may be that they have changed pay scales in further amendment of RRS. But this can not be applied to the employees already recruited in higher pay scale. in any case you can not be denied the advantage of MACPS.

I have joined as LDC on 01-04-1989 with basic pay of Rs.3050. I have received my first ACP with effect from april 2001. Due to this I am getting the Grade Pay of Rs.2400/- now. I have not received any promotion till today. Please let me know what grade pay will I get as per modified acp, after 20 years of service, i.e. II macp, as I have completed 20 years of serive on 01-04-2009.

I have joined as LDC on 01-04-1989 with basic pay of Rs.3050. I have received my first ACP with effect from april 2001. Due to this I am getting the Grade Pay of Rs.2400/- now. I have not received any promotion till today. Please let me know what grade pay will I get as per modified acp, after 20 years of service, i.e. II macp, as I have completed 20 years of serive on 01-04-2009.

Dear Mr JKB,

On completion of 20 years of service, you are eligible for 2nd upgradation under MACPS and your Grade pay will be Rs 2800 (Effective 01.04.2009)

Dear JKB,
It is right that you will be eligible of getting II upgradation (2800 GP) but effective date will be the date of implementation of MACP only,i.e 01.09.2009.

The date of implementation of MACPS is 01.09.2008 and not 01.09.2009

I joined govt service on 29-06-98 as steno in pay scale of Rs. 4000-100-6000. I have completed 10 years service. Am I eligible for ACP or MACP? if so, what will be my grade pay and how my pay will be fixed?

Dear Friend,

Since you did not complete 12 years of continuous service as on 31.08.2008, you are not eligible for upgradation under ACPS. You are, however, eligible for upgradation under MACPS from 01.09.2008 provided you fulfill the condition relating to ACR. The upgradation will be from the existing Grade pay of 2400 to 2800.

Dear Friend,

On your earning functional promotion, your Grade pay will be refixed corresponding to the Grade pay attached to the promotional post.

I joined as LDC in 1981. During the year 1983 (on adhoc) and in 1990(regular
basis )got promotion as UDC,both the times carried transfer, the promotion was not accepted by me. Finally during the year 1996 Igot promotion to the
post of UDC. After the post of UDC, In 18/1/2002 I ws promoted to the post of Office Superintendent(Rs.5500-175-9000) now in revised pay scale of
Rs.9,300-34,800 with Grade Pay of Rs.4,200/-. Now my question is whether I
will benefit from the MACPs? If so, how will my pay will be fixed? Please
enlighten.

My friend's service details are as follows:
Date of appointment as Junior Clerk(old 950 scale): 24.9.90
Date of first promotion as senior Clerk(old 1200 scale): 10/92
Date of second promotion as Head Clerk
(old 1400, Vth Pc scale 5000-8000) : 11/96
As per VIth PC, this grade has been merged
with 5500 scale.
No.of years since appointment : 19 years.
No. of years since 2nd promotion : 12 1/2.
Is my friend eligible for financial upgradation under MACPS? pl. enlighten.

Dear Friend,

You started your career in 1981 and had two functional promotions as on 18.01.2002 well before you completed 24 years and thus you are ineligible for ACP upgradation. Enroute you had refused promotion in 1990 and presumably even thereafter. You earned first promotion in 1996 after completion of 15 years of service without grant of ACP till then which means for about 3 years you stood debarred from promotion. On this basis, you will be eligible for 3rd upgradation under MACPS on completion of 30+3 years i.e. in 2014.

Dear Friend,

Your friend has completed more than 10 years of service in the existing Grade pay of 4200 as on the date of implementation of MACPS and his 3rd upgradation under MACPS is still to be availed. He is eligible for MACP upgradation w.e.f. 01.09.2008.
