My Friend is working as Junior Hindi Translator (pre-revised scale of 5000-150-8000) for the last 20 years. He had been granted ACP during 2000 and fixed his pay as per the Senior Hindi Translator Scale (5500-175-9000). His pay as on 01.01.2006 was Rs. 7250/-.

As per the OM dated 24.11.2008, the Scale of Senior Hindi Translator has been upgraded to 7450-225-11500 and granted the grade pay of Rs. 4600/-w.e.f. 01.01.2006.

The office has fixed the pay as on 01.01.2006 in the Pay Band 2 with a grade pay of Rs. 4200/-.

Wheher the fixation of pay with a grade pay of Rs. 4200/- by the office is correct? or the pay should have been fixed with a grade pay of Rs. 4600/-.

Views of the members solicited please.

Dear Sir,
One of my friends who is a junior Hindi translator in my department is fixed in accordance with pre revised 4500 with the grade pay of 2800 and even his scale is not considered with pre revised 5000. If you can pass on the GO dated 24-11 -08 at lest he may try to get the grade pay of 4200 in the revised scale.
Thank you
Fernandez

Dear friend
Since the pay scale have been upgraded, Grade Pay of Rs.4600/- should be paid. There can not be two grade pay for similar post i.e. one for ACP holder (granted before 1/1/06)and other for promotion and direct recruits. Represent your case to appropriate authority. Best of luck.

I request Shri Jitenderjee (JJee) to kindly go through Paragraphs 7.5.10; 7.15.9; 7.19.68; 7.22.17 and 3.1 of 6th CPC Report, for I feel he has given a full fledged opinion without reading the said paras.
Apart from this, I have one more doubt. The original Querist (quoted hereinabove) maintains that he continued to be in the Pre-Revised pay scale of 5500 as on 1.1.2006.
It appears that only Senior Translators who were placed by the 5th CPC in pre rev scale of 6500 have been granted Upgradation to pre rev 7450 for the purpose of GP of 4600. This being the case, if ,for any reason, our querist ( or his friend, as the case may be) was in Pre Rev scale of 5500 as on 1.1.2006, I do not subscribe to the Jjee's view in the instant case.
May I request my learned collegue (in this forum) Jjee to reconsider his view/review!
Before, parting, I request all querists to quote the department so as to enable to look for the fine prints, if any, in the OMs.
With regards,
Badri,
