PENSIONERS’ CASES / ANOMALIES / DISPARITIES-WILL THE ANOMALY COMMITTEE(S) LOOK INTO?

As all Pensioners may be aware, the OM on setting up of the 6CPC related Anomaly Committeee (AC) has been issued on 12th Jan 2009. Same is reproduced hereunder:

Setting up of Anomaly Committee to settle the Anomalies arising out
of the implementation of the Sixth Pay Commission's
recommendations.
The undersigned is directed to say that in terms of an agreement with the
Staff Side of the National Council, it has been decided that appropriate Anomaly Committees should be set up, consisting of representatives of the Official Side and the Staff Side to settle the anomalies arising out of the implementation of the 6th Pay Commission's recommendations, subject to the following conditions, namely:
(a) Where the Official Side and the Staff Side are of the opinion that any
recommendation is in contravention of the principle or the policy
enunciated by the Sixth Central Pay Commission itself without the
Commission assigning any reason; and
(b) Where the maximum of the revised scale is less than the amount at
which one is entitled to be fixed except in those cases where the
same is as a result of modified fixation formula adopted by the
Government; and
There will be 2 levels of Anomaly Committees, National and
Departmental, consisting of representatives of the Official Side and the Staff
Side of the National Council and the Departmental Council respectively.
(3) The Departmental Anomaly Committee may be chaired by the Additional
Secretary (Admn.) or the Joint Secretary (Admn.), if there is no post of
Additional Secretary (Admn.). Financial Adviser of the Ministry/Department
shall be one of the Members of the Departmental Anomaly Committee
(4) The National Anomaly Committee will deal with anomalies common to
two or more Departments and in respect of common categories of employees.
The Departmental Anomaly Committee will deal with anomalies pertaining
exclusively to the Department concerned and having no repercussions on the
employees of another Ministry/Department in the opinion of the Financial
Adviser. The items already taken up by the Fast Track Committee, will not be
considered by the Anomaly Committee.
(5) The Anomaly Committee shall receive anomalies through Secretary, Staff
Side of respective Council upto six months from the date of its constitution and
it will finally dispose of all the anomalies within a period of one year from the
date of its constitution. Any recommendations of the Anomaly Committee to
resolve the anomaly shall be subject to the approval of the Government
(6) Cases where there is a dispute about the definition of "anomaly" and those
where there is a disagreement between the Staff Side and the Official Side on
the anomaly will be referred to an "Arbitrator" to be appointed out of a panel of names proposed by the two sides. However, this arbitration will not be a part of the JCM Scheme.
(7) The Arbitrator so appointed shall consider the disputed cases arising in the
Anomaly Committees at the National as well as Departmental level.
(8) Orders regarding appointment of the Arbitrator and constitution of
Anomaly Committee at National Level will be issued separately.
(9) All Ministries/Departments are accordingly requested to take urgent action
to set up the Anomaly Committees for settlement of anomalies arising out of
implementation of the 6th Pay Commission's recommendations, as stipulated
above.

A.WILL THE AC COVER PENSIONERS’ DISPARITIES? ANOMALIES ALSO?-

Doubts- queries?

If you look into the subject title, it conveys anomalies arising out of the implementations of the 6CPC recommendations. No omission of recommendations in reg. to pensions! SO WE PRESUME IT COVERS pensioners also- though not specified or clear!

The two conditions laid down – one on policy/ principle and another -the second on REVISED SCALE- on wh pensioners had no say- perhaps only Staff Side (JCM) can interfere. Our bodies- (SCOVA) have no chance to intervene!.

Anyhow the doubts and queries are:

1.Will the AC take up the Pensioners’ Cases also?
2.Will the Pre-conditions exclude any aspects of Pensioners problems?
3.Who is the body equal to JCM to represent from Pensioners’ side?
4.Will the Pensioners’ cases be referred to their original/ parent Deptts? If so why?
5.If not whether DoP&PW will act as their “DEPTT” for presenting their grievances/ cases? (This situation will be a fallacy – as the DoP&PW itself has ti implement or refuse! So why one more channel -to delay?
6.Will the reps./appeals/Grievances already sent be taken up or fresh appeals are to be made to AC? If yes, then to wh address the same are to be sent? AC of DoP&PW?
7.Will there be Arbitrator? Who? I think all our cases have to go straight for arbitration as we are contesting the OMs of DOP&PW!
8.What is FAST TRACK/ wh are the cases covered by it? Pensioners are already aged/ cant wait long delays/ so will the Fast Track come to their rescue?
9. Time-frame? For pensioners, it must be made quicker & easier!
10. Any provision for involvement of some Pensioner Representatives/ Assns/ Federations etc?


B. PREPARING THE ANOMALIES.

Within a short time we shd try to build up a list/ dossier of all anomalies/ disparities etc of COMMON NATURE to Groups of pensioners belonging to say pre1956/ pre1966/ pre1976/ pre1986/ pre1996/ pre2006/ pre 2008/ 20yr retirees/Family Pensioners etc.

Can we prepare bullet point presentation for each- say one para for each? No individual cases pl?

Shri S C Maheshwari, Gen Sec, RREWA has suggested/ sought for a draft to cover all the above- each group highlighted separately- so that the same can be used by Associations/ Federations? I also feel it must be done.

SO I REQUEST INDIVIDUALS TO PL. GIVE THEIR POINTS GROUPWISE/ or for ANY ONE GROUP so that we can finalsie the common draft!

C.CAN WE ASK A RTI Query in the meanwhile to clarify some doubts? ANYONE TO SUGGEST A DRAFT?

Dear All

I was waiting for some posting to appear- but even after 42 hits- no ideas have come up!

LET ME ATTEMPT:

(Pl note my short-comings- I am a good scientist- manager- administrator but poor w.r.t Rules etc etc!)

THIS PARAGRAPH IS INSPIRED FROM THE LETTER OF SHRI K S S in RREWA website- one of the excellent - thought provoking appeal made on behalf of the SSG Group and hence I am using it as applicable to many/ most Pre 1996/ even Pre 1986 Cases.

This is a generalised paragraph. Needs modification.Editing. Content re-writing. What not!

THIS HAS TO BE RAISED UNDER THE CATEGORY "PRICIPLES -POLICY"

Whatever it means, the RESULT is not acceptable to pensioners of Pre 1996 era as it undermines all their pension benefits, making their Baisc Pension to be almost at the minimum levels at every REVISION with the result they get only "DR rises" as benefits.
Such a principle or policy is not WHAT ANY pay commission tried to do!

HENCE THERE IS LOGIC to treat this as anomalous

Text as a Model/ Example( I may be wrong- so with hesitation I am placing the same):

POST 1986 – PRE 1996 PENSIONERS

Post- 1986 – Pre- 1996 Pensioners were victims of 5CPC implementations for fixing at the minimum of a Grouped scale for two or three merged grades/ scales. However, after appeals, partial relief was was given to Pre-1986 Pensioners vide GOI DP&PW’s OM F No 45/86/97-P&PW(A) Dt 10.02.1998

More such mergers have taken place now in 6CPC implementations. Even if similar partial relief or notional fixation are given to Pre-1996 Pensioners, the Pre-1986 may not get any benefits, except the benfits of DR rises (if any) every six months.They do not get any real benefits in the sense the repeatedly down-grading merger of pay-scales into pay bands, mostly AFFECTS the OLDER & OLDER- pensioners ,as this practice keeps their basic pensions at the minimum of the revised pay band always and forever.

(Each time, a few higher pay-scales disappear in the merger in a bunch or a Band causing a great loss to the affected Pensioners & Family Pensioners, becausie they are relegated to the minimum of the new pay-scale or new pay-band -NOT THOSE IN SERVICE/ future Pensioners/ Family Pensioners).

This policy and principle are anomalous and hence needs a review.

(WE CAN ADD COUPLE OF ILLUSTRATIONS & GIVE A SOLUTION SEPARATELY)

My dear VN. It is true that there are many on staff side in Anamolly Committee who are leaders but are even pensioners today. But can they diecide about the agenda themselves ? Would they not be bound by terms of refereces ? We have to take up the matter with the Govt. to include cases of pensioners also in the terms of references. As far as I know nobody has written any letter about it so far.

The letter drafted Sh. Kanaujia for issue by RREWA to the staff side of JCM ,for inclusion of pension anomalies under the purview of Anomalies committee may be seen in posts #112 &112 of the thread" JUSTICE THROUGH RESTORATION OF PARITY TO ALL OLD PENSIONERS"
If you have access to member units of JCM please use this opportunity to request them to take up with JCM as is being done by RREWA

Dear All

As Mr K has rightly pointed out, now that the composition of the Anomaly Committee (AC) is known, we all must act collectively and individually TO ADDRESS & REQUEST the Anomaly Committee (hope it already vested so)to consider the cases of anomalies/ infirmities as related to the 6CPC recommendations and implementation OMs of the Govt. wrt the various groups of Pensioners-old Pensioners- Family Pensioners etc.

Individuals/ Groups who are members of various Associations/ Federations, must also ask the latter to do so. (for e.g. Pensioners Forum is requesting the AIFPA (of wh it is an affiliate) to address the AC).

Mr K has already posted a Draft for addressing the AC in this regard in the other threads. The same can be consulted.

PL DO ACT. WE MUST CONVINCE THE AC THAT ANOMALIES EXIST FOR PENSIONERS ALSO.

My dear Pensioners friends. A large number of pensioners are having individual problems and anomalies. It is clear from views expressed by some of them on gconnect forum as well as elsewhere. Some of them have even sent e. mail to me. There are 12 members on Staff Side in Anomaly Committee, namely,

Sh VN has posted an item relating to reply from DP&PW to an RTI query on inclusion of the pensioners case in the Anomalies committee. The reply is encouraging to some extent.

Essential points of reply: from DoPPW lr dtd 25.02.2009
The DoPT which has constituted the AC has informed that the said Committee will examine all kinds of anomalies which are covered under the DEFINITION OF ANOMALY as given in the AC OM dtd 12.01.2009.
IF THE STAFF SIDE and THE OFFICIAL SIDE AGREE THAT A PARTICULAR ISSUE RELATED TO PENSIONERS IS COVERED UNDER THE DEFINITION OF ANOMALY, SAME MAY BE TAKEN UP FOR DISCUSSION IN THE NATIONAL ANOMALY COMMITTEE.

Therefore, the onus is ALSO partly now on us/ all Pensioners’ Groups/ Forums/Federations to appeal , sensitise and ensure that the matter is taken up on A HIGH PRIORITY BASIS by the NAC so that the MAIN damage is reversed and all other damages done are undone quickly, before many pensioners and family pebnsioners breathe their LAST!

PLEASE SUGGEST COURSES OF ACTION that can be pursued. I have a few, but I will come up later. (I have given in my earlier postings why the Non-implementation of Accepted Recommendations uniformly for both Pensioners and Employees is against the Principles/ Philosophy of the 6th CPC )

Dear all

With contributions from different sources in this forum and my own understanding/ efforts to the extent my knowledge permitted, I have drafted and posted six topics under the thread/ string titled "Injustice to ......" in Gconnect which can be used as material for reference/ background for making/ submitting appeals or representations to the Anomaly Committee by Individuals and Pensioners' Groups like Associations/ Federations. Of course with their own editing/ additions/ subtractions/ mprovements etc.

Posting them here will be repetition.

Please submit in large number representations to the Anomaly Committee as soon as possible- before elections please!!!!Make your associations also do the same!

Congatulation to the G connect team on this memorable day of one year of service to pensioners and senior citizen. This platform has done service through me to a number of pensioners and senior pensioners of age 80 years or more at Bangalore, in arriving at the Revised pension, through pension and arrears calculator in addition to serving as a platform to share views and informtion. all those who have got the service do not access like me aqnd wants me convey their gratitude.

I pray the god, the almighty, to bestow on the team long healthy life, prospeirity, and intellectuality to become a very big platform in this service.

Pensioners Friends. Mr. VN has done lot of hard work and reserach into whole matter of VI CPC Revised Pension. He has made ready a complete write up and has actually prepared a slide show also. Besides, he happens to be the President of Pensioners Association, Chennai. Therefore, I am of the opinian that he should be afforded facility of giving a presentation to the Anomaly Committee, so that he can present the case in right perspective and answers any questions and query right there in the Anomaly Committee, if occasion arises. I hope and trust Mr. VN would be agreeble to this. Once this is decided, ways and means can be found out for achieving this goal.

I am in full agreement with all of you and request Shri natarajan to accept and present of our case. I had sent by mail the copy of my representation to DOP &PW to shri VN. In that a paragraph says

"It is pertinent to state here that with view to prevent such discrimination suffered now, while implementing the V CPC recommendations on pension, the government wisely issued orders for notional fixation of pension of all the pre 1986 pensioners vide GOI D.P & P.W OM No F.45/86/97-P.&PW (A) dated 10-02-1998. A similar measure (or any other alternatively fair method) if adopted now will probably ensure justice to all pre 2006 pensioners."

This point may please be stressed
