View Full Version : Pay fixation for whom pay has been reduced due to disciplinary case

Dear friends, May I have clarifications on the following pay fixation :

One of our staff members who was holding a technical post had retired on VRS wef 19.07.2010 F.N. On the date of his retirement he was drawing pay as follows :


Basic as on 1.2.2005 Rs.7075.00 in the pre-revised scale : 5500 175 9000

The Ministry in now in March 2013 have clarified (after consulting DOPT) that the pay scale of 5500 175 9000 is to be fixed with GP of Rs.4600.00 w.e.f. 1.9.2008 in the pay band of PB 2, 9300 34800 + 4600. Accordingly his pay was fixed as follows :

Due to a disciplinary case, the competent authority has ordered that the pay of the GS be reduced by two (2) stages for a period of two years with effect 04.03.2010 (ie.from the date of issue of that Order) and further directed that he will not earn increments of pay during the period of reduction, and that on the expiry of this period, the reduction will have the effect of postponing his future increments of pay.

Taking the date of issue of the Order as 4.3.2010, the reduced pay of the GS as on 04.03.2008 ie Rs. 14570.00 plus GP 4200.00 was fixed during that time. However, now the GP 4600 was granted w.e.f. 1.9.2008, it may please be clarified whether the GP of the Govt. servant is to be fixed on 4.3.2010 as Rs. 4200.00 or allowed to continue with GP of Rs.4600.00 (by reducing only basic).
