Respected sirs,

With due respected, I and my colleague joined central govt. job in same scale (Rs5000-8000) on 6th May 1998 and 30th April 1998 respectively in same batch. I got promotion in 01st Sep 2003 in pay scale Rs. 5500-9000. My concerning department fix my pay on 01 Sep 2003 with Rs. BP 6025 (pay scale 5500-9000). My concerning department did not asked me about any option for pay fixation. It was my first promotion and I am not aware about the fixation rule. When I know the rule of pay fixation I asked my pay section to fix my pay at date of increment (01May 2004) but pay section refuse my request due to time bar and that time I compromised due to my mistake.

My colleague got same promotion after one year to me in 01 Sep 2004 and get Rs 100/ benefit at the promotion time and take option of pay fixation on date of increment (in April 2005) at that time also I got more pay to my junior till March 2005 and my junior also get more pay than me from April05 to Aug 05. We both are get equal pay from Sep05 to 31.12.2005.

After implementation of 6th pay commission we both are get same pay (BP Rs.11860 +GP 4200). In 01 Sep 2008 I got my second promotion (old pay scale 6500-10500) with GP 4600 and my junior get same promotion after two year in 01 Sep 2010 with GP 4600. At present I (BP 15630+4600) got more pay than to my junior (BP 15600+4600).

Now anomalies arise when Govt. decide to give one time benefit in pre revised scale with one extra increment (from Feb06 to June06). Now after this reason my junior colleague gets more pay than me with BP16000+4600 (at present BP 15600+4600). Now at present my BP 15630+4600. With the above matter my questions are:

Can I get the benefit of stepping up or any benefit of pay protection?
Is any rule to re-fix my pay in 01 May 2003 with taking option (I heard this rule is available if employ get financial losses in previous promotion) please guide me.
Can I get the benefit of Rule-7 note:7 of CCS RP-2008 because B.Pay was same on dt 31.12.2005 & 01.01.2006?

There is some doubt on para 2 of your post.your junior should have got more pay from 1/4/2005 t0 1/9/2005 means 6375/- where you got 6200/-.

In Feb. 2003 it was decided to extend a revised option for fixation of pay on promotion in the event of any unforeseen developments or change of rules. It was also said that past cases would be decided on case to case basis. Subsequent to issue of the OM by DOPT, till 2005 many would have opted for straightaway fixation or re-fixation on increment date, as in the instant case cited above. Consequent on implementation of 6th CPC in 2008, some of them who got promotion in the year 2005 till 2008 would have exercised revised option if beneficial, in accordance with the OM of 2003 owing to change in rules, viz. 6th CPC revision. Now, the grant of one increment is also an unforeseen development by which all promotees during the period between June to December of every year from 2003 to 2005 may be entitled to get a revised option, by exercising which, they may be entitled to get an additional increment as per the instant orders. A clarification in this issue will enable the concerned employees to act accordingly. Even otherwise also, based on the existing OM of 2003, the concerned are entitled for a revised option if the same enables them to avail the one increment as on 1.1.2006 in the pre-revised scale.

Dear Sir, Because you had not opted for fixation of pay from date of next increment, viz. 1.5.2004, your pay was lesser.
However, as per OM of 2003 you are eligible for revised option in view of the unforeseen development from 1.1.2006, ie. grant of one increment in the pre-revised scale. By such a revised option, your increment will remain as 1.5.2004 so that you can get one increment w.e.f. 1.1.2006 in the pre-revised scale. You may request for permitting you to submit the revised option for fixation of pay on promotion.

My establishment is not permitting me to take revise option.
Have you any rule to solve this problem? (Because I am not signed any option for pay fixation at promotion time in Sep 2003while my previous increment date was May)

Can we change option of 5th pay commission in 6th pay commission (if govt. servant in loss due change of rule i.e. One time increment (feb to june)

Dear Sir, Because you had not opted for fixation of pay from date of next increment, viz. 1.5.2004, your pay was lesser.
However, as per OM of 2003 you are eligible for revised option in view of the unforeseen development from 1.1.2006, ie. grant of one increment in the pre-revised scale. By such a revised option, your increment will remain as 1.5.2004 so that you can get one increment w.e.f. 1.1.2006 in the pre-revised scale. You may request for permitting you to submit the revised option for fixation of pay on promotion.
